BBharts 2026–2027 Agreement, Waiver & Release of Liability
This Agreement, Waiver, and Release of Liability (“Agreement”) is entered into between Bilingual School of Business & Performing Arts Inc. and BBharts LLC (collectively “BBharts”) and the undersigned (“Parent/Guardian” and/or “Student”).
By selecting “I Agree,” entering my name, or otherwise electronically accepting this Agreement, I acknowledge that this constitutes a legally binding signature under applicable Florida law.
1. Electronic Funds Transfer (EFT) Authorization
I authorize BBharts to process recurring payments using the payment method provided. This authorization remains in effect until all balances due under this Agreement are paid in full.
BBharts may retry failed payments and use any payment method on file to collect outstanding balances.
2. Membership Term
I agree to a minimum membership commitment of thirty (30) consecutive days and understand that I am financially responsible for the full term regardless of attendance, schedule changes, or withdrawal.
3. Payment Structure
Initial payment due upon registration
Monthly tuition due on the same calendar day each month
4. Membership Renewal
After the initial term, membership continues month-to-month at the current rate until canceled in writing.
5. Program Enrollment
Enrollment is based on the classes selected during registration.
Completion of a program phase requires a new Agreement for continued participation.
6. Payment Policies
$45 late fee for payments more than 10 days past due
Three late payments may result in acceleration of the remaining balance
Tuition is non-refundable and non-transferable
Failure to attend does not relieve financial obligation.
7. Cancellation Policy
Cancellation requires:
30 days written notice
Payment of 40% of the remaining prorated balance
8. Right of Cancellation
You may cancel within 10 days of signing for a full refund with written notice.
9. Assumption of Risk & Physical Condition
I acknowledge that participation in performing arts and physical activity involves inherent risks, including but not limited to:
Slips, falls, and physical injury
Contact with other participants or surfaces
Physical exertion or strain
I certify that I/my child is physically able to participate and voluntarily assume all risks.
10. Release & Waiver of Liability (Florida-Compliant)
To the fullest extent permitted by Florida law, I voluntarily release, waive, and discharge BBharts, including its owners, directors, instructors, staff, contractors, and affiliates (“Releasees”), from any and all claims, liabilities, damages, or expenses arising out of:
Participation in any class, rehearsal, performance, or program
Presence on BBharts premises or surrounding areas
Any act of negligence by the Releasees
This includes claims for injury, illness, death, or property damage, whether caused by negligence or otherwise.
11. Indemnification
I agree to indemnify and hold harmless BBharts from any claims, damages, or liabilities arising from my or my child’s actions while participating in any program or on the premises.
12. Communicable Disease Waiver
I understand that participation may involve exposure to illnesses such as COVID-19, influenza, or other communicable diseases.
I acknowledge:
Exposure risk cannot be eliminated
Illness may result in serious complications
I voluntarily assume all risks related to exposure and release BBharts from all related claims.
13. Supervision & Off-Premises Liability
BBharts supervision applies only during scheduled program times when a student is checked in and under direct supervision.
Areas and Situations Not Fully Supervised Include:
Patio Area
Limited supervision
Risks include weather, strangers, and physical hazards
Dismissal & Parent-Directed Release
If I permit my child to leave without staff escort, I assume full responsibility
Stairs, Elevator & Second Floor
Risks include slips, falls, and mechanical issues
I assume all risks associated with these conditions and release BBharts from liability.
14. Media Release
I grant BBharts permission to photograph and record me/my child for promotional purposes.
I waive:
Right to inspect media
Right to compensation
Any claims related to privacy or publicity
This consent is irrevocable.
15. Privacy Policy
BBharts collects personal information solely for operational purposes. Full policy available upon request.
16. Termination by BBharts
BBharts may terminate this Agreement with 10 days written notice for failure to comply.
17. Entire Agreement
This Agreement represents the full understanding between parties and supersedes all prior agreements.
18. Electronic Acknowledgment & Consent
I acknowledge that:
I have read and fully understand this Agreement
I understand I am waiving significant legal rights
I agree voluntarily
I agree that selecting “I Agree,” typing my name, or submitting this form constitutes my legally binding electronic signature.
Parent/Guardian Certification
I certify that I am at least 18 years old and legally authorized to sign on behalf of the student listed.
