The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. Governments and health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. Studio J Dance Collective, LLC has put in place preventative measures to reduce the spread of COVID-19; however, Studio J Dance Collective, LLC cannot guarantee that you or your children will not become infected with COVID-19. Furthermore, attending dance classes or recitals could increase your risk and your families’ risk of contracting COVID-19.
By signing this agreement, you acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that your children, your family members and you may be exposed to or infected by COVID-19 due to attendance at Studio J Dance Collective, LLC classes, events or recitals and that such exposure or infection may result in personal injury, illness, permanent disability, and death. You understand that the risk of becoming exposed to or infected by COVID-19 at Studio J Dance Collective, LLC classes, events or recitals may result from the actions, omissions, or negligence of yourself and others, including, but not limited to, Studio J Dance Collective, LLC employees, independent contractors, directors, volunteers, and program participants and their families.
With full awareness and appreciation of the risks involved, you voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to your children, your family or yourself including, but not limited to; personal injury, disability, and death, illness, damage, loss, claim, liability, or expense, of any kind, that you or your family may experience or incur in connection with your child’s attendance at Studio J Dance Collective, LLC or participation in Studio J Dance Collective, LLC programming. Additionally, you willingly agree to comply with the Studio J Dance Collective, LLC COVID-19 Protocols and Guidelines and if you, your family or your child observes violation of said protocols you will remove yourself, your family and your child from participation and bring such violation to the attention of the nearest Studio J Dance Collective official immediately.
On your behalf, and on behalf of your children, family members, spouse, estate, heirs, executors, administrators, assigns and personal representatives, you hereby release, covenant not to sue, discharge, and hold harmless Studio J Dance Collective, LLC its board members, officers, independent contractors, affiliates, employees, agents, and representatives, of and from any and all Claims, including all liabilities, claims, demands, actions, causes of action, damages, costs or expenses of any kind arising out of or relating thereto. You understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Released Parties whether a COVID-19 infection occurs before, during, or after participation in any Studio J Dance Collective, LLC programs.
