1. Participation Acknowledgment & Assumption of Risk
I understand that participation in dance classes, rehearsals, performances, or workshops involves physical activity that carries a risk of injury, disability, or even death. These risks may result from my own actions or omissions, the actions or negligence of others, or conditions of the studio or equipment. By registering and paying the registration fee, I affirm that I am voluntarily participating and assume these risks.
2. Release & Waiver of Liability
In consideration for being allowed to participate and to have paid the registration fee (refundable or non-refundable as per studio policy), I, on behalf of myself (and my child, heirs, executors, administrators, and personal representatives), do hereby release, hold harmless, and forever discharge Art & Soul Dance Academy, including its owners, directors, instructors, employees, agents, volunteers, successors, and assigns (“Released Parties”) from any and all claims, demands, liabilities, causes of action, injuries, damages, costs, or expenses (including attorneys’ fees) arising out of or related to my (or my child’s) participation—including any arising from ordinary negligence, but excluding claims for gross negligence, intentional misconduct, or the unlawful acts of the Released Parties.
3. Indemnification
I agree to indemnify and defend the Released Parties against any claims or legal actions brought by myself or by any party acting on my behalf, unless such claim arises from gross negligence or intentional misconduct by the Released Parties.
4. Medical Treatment Authorization
In the event of an emergency or injury, I authorize the Released Parties to secure medical treatment deemed necessary. I understand that I (or my health insurance) will be financially responsible for any medical expenses.
5. Media Release (Optional)
I grant permission to the Studio to photograph or record video/audio of me (or my child) during studio activities. I agree these may be used for promotional materials, websites, social media, or other marketing, without compensation.
6. Policies & Fees
I acknowledge the Studio’s policies—such as the registration fee, tuition, refund policy, class rules, dress code, conduct code—have been made available to me and that registration constitutes my agreement to comply.
7. Governing Law & Severability
This Agreement shall be governed in all respects by the laws of the State of Idaho. If any provision is found invalid or unenforceable, the remainder of the Agreement shall remain in full force and effect.
8. Voluntary Execution & Digital Signature
I affirm that I have carefully read and fully understand this Waiver & Release, and I agree to its terms voluntarily.
