Liability Waiver, Account Billing & Policies Consent
Understanding of Services & Policies:
As a participant of any program or class at Dance by Carly, I recognize and acknowledge there are certain risks of physical injury, and I agree to assume the full risk of injuries, including death, damages or loss that I or my minor child(ren) may sustain as a result of participating in any activities connected with such program or class. I agree to waive and relinquish all claims I or my minor child(ren) or I may have as a result of participating in any program or class against Dance by Carly, and its instructors, agents, employees and independent contractors.

I have read and fully understand the above waiver and release of all claims. As a participant of any program or class at Dance by Carly, I have read and fully understand all the content of the Studio Handbook. I further acknowledge that any questions or concerns that I may have regarding account billing & studio policies have been answered to my full understanding.

Media Release Form
Consent for Use for Still and Video Images:
This consent form will authorize Dance by Carly and its partners to use and print student photographs and film/video footage of students and student activities for educational, informational and promotional purposes. Images may be used, but are not limited to, Dance By Carly publications and newsletters, newspaper articles, advertising material, web listings, websites, etc. This Media Release Form will be kept on file by Dance by Carly and is valid for the duration of the student's enrollment. Consent can be withdrawn in writing by the parent/guardian or student at any time.

After reading the explanation above, I authorize Dance by Carly to take and use any photographs or video of my child in any Dance by Carly publication, production or presentation, including electronic/internet marketing material, for the purpose of promoting Dance by Carly in a positive manner.


Payment Policies

-Tuition Payments will be due by the 1st of each month. After the 3rd, a late fee of $10 charge will be added to accounts with a remaining balance. If payment is not made by the 6th, an additional $15 charge will be added.

-Absence from class, no matter the cause, will not be prorated or credited towards tuition. You may have the option to make up for that class by attending a technique class or another class that corresponds to the class missed. After you have missed 60 days of class, you will be required to pay another $60 registration fee.

-If there is a class cancellation due to an instructor's absence, the class will be rescheduled for another date, or you will be prorated. We follow the AISD Calendar regarding holidays and closures. We will not pro-rate for these days. We require a 30-day notice of withdrawal to not be charged tuition. We do not offer refunds at all. If you are charged incorrectly, we will credit your account.

-After-School Pick Up Policy: Notice of days missed will need to be given at the first of the month. Unless a child is not at school one day. If pick-up is not necessary for a day that has already been paid for, that amount will not be refunded. We must be notified of a child not needing pickup, or you could be charged a $20 fee.

ACKNOWLEDGEMENT OF RISK AND WAIVER OF LIABILITY

As a condition of use of Dance By Carly, LLC participation in any class, camp, intensive, or activity, you agree as a participant or parent/guardian of a participant in the program, to assume all risks and hazards of engaging in or spectating at our facility, including assuming all risks of personal injury, death and property damage.

You further agree to hold harmless Dance By Carly, LLC, their staff, instructors, volunteers, sponsors, partners, or representatives from liability for any losses, damages or injuries that may occur in any way as a result of these activities or facility uses - regardless of cause.

You further certify that you are properly prepared to engage in any activities you have selected and that you have recently consulted a physician to establish that it is safe and appropriate for you to engage in these activities.

Participants (or the parents/guardians of minor children) may also be required to complete a medical health history and/or sign an additional waiver of liability prior to participation in any programs or classes. Anyone recovering from an injury or illness must first discuss their return to physical activity with their physician and Dance By Carly, LLC prior to enrolling/participating.

You further agree that there is risk associated with the COVID-19 pandemic and possible exposure. If your child has symptoms, they are not allowed in class. We do not pro-rate for COVID-19 sickness, tardy or absence.

Therefore, having read and understood this waiver and in consideration of your accepting my entry into Dance By Carly, LLC or the program. I, for myself and anyone entitled to act on my behalf, waive and release Dance By Carly, LLC, their staff, instructors, volunteers, sponsors, partners, or representatives from all claims or liabilities of any kind arising out of my participation in (or as a spectator of) any program or use of any facility.

NOTE: If a facility user or program participant is under 18 years of age, you, as a parent or legal guardian, agree to the same terms, conditions and waiver of liability outlined in this agreement.
