DANCECAPADE WAIVERS AND STUDIO POLICIES
Assumption of Risk and Release of Liability
I understand that participation in dance, Pilates, tumbling, performances, competitions, rehearsals, and related activities may include, without limitation, stretching, barre work, choreography, across-the-floor combinations, tumbling, the use of props, and other physical activities. I acknowledge that participation in these activities involves inherent risks, including but not limited to bodily injury, illness, disability, property damage, or death. On behalf of myself and/or my child(ren), I voluntarily assume all such risks and agree to release, waive, discharge, covenant not to sue, and hold harmless Dancecapade, Inc. ("Dancecapade"), including its owners, directors, officers, employees, contractors, volunteers, renters, and agents, from any and all claims, liabilities, damages, losses, costs, or expenses arising out of participation in any Dancecapade program or activity, whether on or off Dancecapade premises. This release applies to injuries, illnesses, property damage, disability, or death resulting from participation in Dancecapade activities, including those resulting from the negligence of Dancecapade to the fullest extent permitted by California law. I further agree to indemnify and hold harmless Dancecapade against any claims brought by or on behalf of myself or my participating child(ren). If any portion of this agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
COVID-19 Assumption of Risk
I acknowledge that COVID-19 and its variants have existed throughout the United States, including California and Los Angeles County. I understand that due to the nature of dance instruction and youth activities, social distancing may not always be possible. Although Dancecapade has implemented reasonable measures to provide a safe environment, Dancecapade cannot guarantee that students, parents, or family members will not be exposed to or contract COVID-19. I agree that neither I nor my child(ren) will attend Dancecapade classes, events, or activities if we are experiencing symptoms associated with COVID-19, including fever, cough, or shortness of breath, or if we have a suspected, diagnosed, or confirmed case of COVID-19. I agree to notify Dancecapade immediately if any of these circumstances apply. By participating in Dancecapade programs, I voluntarily assume all risks associated with exposure to COVID-19, including illness, quarantine requirements, permanent disability, or death, whether resulting from my own actions or the actions, omissions, or negligence of others.
Medical Emergency Authorization
I understand that Dancecapade does not provide medical insurance coverage for its students and that all students must maintain their own individual or family medical insurance coverage. In the event of an accident, illness, or injury involving myself or my child(ren), I authorize Dancecapade staff to administer basic first aid and to obtain emergency medical treatment if I cannot be reached. I understand that any medical expenses incurred are my sole responsibility and will be covered by my personal insurance. I acknowledge and accept all risks associated with emergency treatment and waive any claims arising from emergency care provided in good faith.
Photo and Video Release
I understand that Dancecapade may photograph or record students during classes, rehearsals, performances, competitions, studio events, and other Dancecapade activities. I grant Dancecapade permission to use photographs and videos of myself and/or my child(ren) for promotional, educational, and marketing purposes, including publication on the Dancecapade website, social media platforms, printed materials, and other advertising media. If I do not wish for myself or my child(ren) to appear in photographs or videos, I understand that I must provide written notice to Dancecapade prior to enrollment or participation.
Payment, Enrollment, and Cancellation Policies
I understand that I am financially responsible for all tuition, fees, and charges associated with my enrollment and/or my child's enrollment at Dancecapade. Monthly tuition is due by the 10th of each month. Cash or check payments may be submitted prior to the 10th; otherwise, the credit card on file will be automatically charged on the 10th of each month. A $25 late fee will be applied to any declined or returned payment. Session tuition may be available to returning students and may include additional discounts for cash payments. Payment in full is required at the time of enrollment for drop-in classes, private lessons, camps, intensives, annual showcase participation, and competition team activities.
Private lessons require a minimum of 24 hours' notice for cancellation in order to receive a full credit. If proper notice is not provided, the full lesson fee will be charged. To withdraw from a class, a Drop or Pause Class Form must be submitted through the Dancecapade website by the 15th of the current month in order to discontinue enrollment and avoid charges for the following month. Failure to submit the form by the deadline may result in the next month's tuition being charged. All tuition and fees are non-refundable. Tuition credits may be considered on a case-by-case basis in situations involving serious injury or illness that results in an extended absence and is supported by appropriate medical documentation.
Makeup Class Policy
Students who miss a class may schedule a makeup class within 30 days of the absence. A Makeup Class Request Form must be submitted through the Dancecapade website. Proper dance attire and required dance shoes must be worn when attending any makeup class.
Studio Policies
For the safety and well-being of all students, parents are responsible for dropping off and picking up dancers on time. Supervision is not provided in the lobby, waiting areas, or common areas, and Dancecapade is not responsible for students who leave the facility without parent or guardian supervision. To maintain safe traffic flow, dancers should be dropped off at the front entrance and picked up at the side exit door. Families are encouraged to use designated parking spaces and refrain from double parking at the front entrance.
Proper dance attire and dance footwear are required for all classes. Students who do not meet dress code requirements may not be permitted to participate in class. Only water bottles are allowed inside classrooms; all food and other beverages must remain in the lobby or common areas. Studio closure dates, holidays, and special events are posted on the Dancecapade website, and families are responsible for reviewing the current calendar throughout the year. Group class schedules are subject to change without notice, and the most current schedule will always be available on the Dancecapade website.
Any personal belongings left at the studio will be placed in the Lost and Found area. Unclaimed items may be donated at the end of each session. Dancecapade is not responsible for lost, stolen, or damaged personal property. Dancecapade reserves the right to refuse service to any individual at its discretion.
Acknowledgment
By enrolling in Dancecapade programs and accepting this agreement, I certify that I have read, understood, and agree to all Dancecapade waivers, releases, policies, and procedures contained herein.
