Release of Liability
ACKNOWLEDGEMENT/ASSUMPTION OF RISKS
In consideration for being permitted to participate in dance warm-ups, practices, training, instruction and performances facilitated by Dance AS Dance Academy, LLC, and for other good and valuable consideration, the receipt of which I hereby acknowledge.
ACKNOWLEDGEMENT OF RISKS: I recognize that, as with all athletic activities involving physical contact, there are dangers inherent in and elements of risk associated with participating in the Activities and that the dangers and risks may result in LOSSES due to hazards that include but are not limited to injury or death from (i) bodily contact with other participants, (ii) slipping, falling or tripping, (iii) the physical condition of the facility, (iv) lack or insufficiency of mats or other protective equipment, (v) lack or insufficiency of supervision, or rules, regulations or instruction, and (vi) disparity between and among other participants with respect to experience level, strength, height, weight, age, and ability. I further understand that in the event of a medical emergency, Dance AS Dance Academy will call EMS to render assistance, and that I will be financially responsible for any expenses involved. I do hereby consent and agree that Dance AS Dance Academy has the right to take photographs and use these photos on the company website, company facebook pages, and promotional material without compensation. I understand that my child's name and identity will not be revealed. If you prefer we not photograph you/you child, please notify us via email DanceAsDanceAcademy@GMail.com.
ASSUMPTION OF RISK: I acknowledge the dangers in the Activities, and I voluntarily ASSUME ALL RISKS, BOTH KNOWN AND UNKNOWN, for myself, AND ACCEPT FULL RESPONSIBILITY for LOSSES, EVEN IF CAUSED BY THE NEGLIGENCE OF THE RELEASEES. I am free of any medical condition that might create undue risk for me or for others who might participate with me in the Activities. I agree that this RELEASE AND WAIVER OF LIABILITY is intended to be as broad and inclusive as permitted by the laws of the State of Virginia, and that this RELEASE AND WAIVER OF LIABILITY shall by governed by and interpreted in accordance with the laws of the State of Virginia. This RELEASE AND WAIVER OF LIABILITY shall bind my heirs, executors, assigns, legal representatives, and family members.I HAVE CAREFULLY READ THIS RELEASE AND WAIVER OF LIABILITY AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE AND WAIVER OF LIABILITY OF ALL RELEASEES AND THAT BY SIGNING THIS AGREEMENT I AM WAIVING VALUABLE LEGAL RIGHTS. I UNDERSTAND AND FREELY SIGN THIS RELEASE AND WAIVER OF LIABILITY AND AGREE THAT NO ORAL REPRESENTATIONS, STATEMENTS, OR INDUCEMENTS HAVE BEEN MADE APART FROM THOSE MADE IN THIS RELEASE AND WAIVER OF LIABILITY. I FURTHER ATTEST THAT I AM AT LEAST 18 YEARS OF AGE UNLESS A PARENT OR GUARDIAN’S SIGNATURE IS PRESENT.
