RELEASE OF LIABILITY


I hereby assume all of the risks for my child(ren), participating in any/all activities being conducted by LIGHTHOUSE THEATRE ARTS at 713-A MERCHANT ST. VACAVILLE, CA 95688, including, but limited to, any risks arising from negligence or carelessness on the part of the persons or entities being released, from dangerous or faulty equipment or property owned, maintained, or controlled by them, or from their potential liability without fault.

I certify that my child(ren) is physically healthy, that they have adequately prepared or trained for participation in this activity, and that they have not been told by a competent medical expert not to participate. I confirm that there are no medical reasons or difficulties that prevent them from participating in this activity.

I understand that the terms of this Release of Liability Form will govern my conduct and duties during said Activity.

In consideration of your acceptance of my application and permission to engage in this activity, I hereby take the following action for myself, my executors, administrators, heirs, next of kin, successors, and assign as follows:

I waive, release, and discharge LIGHTHOUSE THEATRE ARTS and/or their directors, officers, employees, volunteers, representatives, and agents, as well as the activity host, from any and all liability, including but not limited to liability arising from the negligence or fault of the entities or persons released, for my child(ren)'s death, disability, personal injury, property damage, property theft, or actions of any kind that may subsequently occur to my child(ren), including our travel to and from this activity.
Indemnify, hold harmless, and agree not to sue the entities or people mentioned in this paragraph for any and all liabilities or claims arising from participation in this activity, whether caused by the release’s carelessness or otherwise.

I understand that Lighthouse Theatre Arts, and their directors, officers, volunteers, representatives, and agents will not be held liable for the errors, omissions, actions, or failures to act by any party or entity conducting a specified activity on their behalf. I understand that this activity may include a test of a person’s physical and mental limits, as well as the risk of death, serious injury, and property damage. The dangers include, but are not limited to, those caused by terrain, facilities, temperature, weather, participants, volunteers, monitors, and/or activity producers. These dangers are not only there for participants, but also for any volunteers.

I hereby consent to any medical care that may be judged necessary in the case of an injury, accident, or sickness while participating in this activity.

The Release of Liability Form should be interpreted broadly to give a release and waiver to the greatest extent permitted by applicable law.

I have read, understood and fully acknowledge the contents of this Release of Liability.

I grant LIGHTHOUSE THEATRE ARTS my permission to use photographs taken of my child(ren) while receiving instruction from or performing with LIGHTHOUSE THEATRE ARTS, for any legal use, including but not limited to: publicity, copyright purposes, illustration, advertising, and web content, including social media.

Furthermore, I understand that no royalty, fee or other compensation shall become payable to me by reason of such use.

The following policies will be effective for all Lighthouse Theatre Arts students, registered for any time or season.

Class Tuition
-Class tuition will be the same each month, regardless of the number of classes in the month due to weeks in the month or scheduled breaks. Tuition is viewed as installments of a total yearly tuition fee and not a monthly per-class fee.

-In the event a scheduled class must be cancelled, either the class will be rescheduled within a 60 day period or the director will issue a refund based on student's tuition rate. The director reserves the right to decide which option is best suited for the circumstance.

-Tuition is due on the 1st of every month. In the event tuition is paid late, an $8.00 late fee will be added to the account to be paid immediately with tuition, on the 3rd of the month. The best way to avoid late fees is to enroll in our auto-pay program, which will be run on the 1st of each month.

-Participating families reserve the right to drop classes at any time with immediate notice. However, any unused tuition will not be refunded. Participating families can notify Lighthouse Theatre Arts of a future drop and continue classes through previously paid classes.

-Lighthouse Theatre Arts reserves the right to refuse service to anyone, for any reason, including but not limited to: delinquent tuition payments, unsafe or offensive student behavior, unsafe or offensive parent behavior.

Performance Fee Policies

-Fees charged to participate in performances will be paid in full upon registering for performances, unless previously arranged and agreed to by the director.

-The director and staff of Lighthouse Theatre Arts reserve the right to include students as they deem appropriate based on their age, skill level/ability and attendance. All rehearsals for performances are mandatory and missed rehearsals can mean students will be removed from parts of scenes/choreography. Performance fees will not be refunded if student participation is reduced due to poor attendance or behavior.

-In the event a student becomes ill, injured, or otherwise unable to participate in a registered performance due to unforseen circumstances, the director will issue a partial refund appropriate to the amount of services already received, including rehearsals, t-shirts and costumes.
