Activity:
Participation in dance classes, rehearsals, performances, workshops, competitions, special events, and other activities offered by Bre Dance Studio (collectively, the "Activities").
Assumption of Risk:
I understand and acknowledge that participation in dance and related activities involves inherent risks, dangers, and hazards. These risks include, but are not limited to:
-Physical exertion and strenuous movement that can lead to muscle strains, sprains, fractures, tendonitis, and other injuries.
-Falls due to slippery surfaces, uneven flooring, or accidental contact with others.
-Collisions with other participants or objects.
-Aggravation of pre-existing medical conditions.
-Injuries resulting from improper technique or lack of supervision (despite reasonable care by Bre Dance Studio).
-Emotional distress or psychological injury.
-Risks associated with travel to and from Activities.
-Risks related to the spread of infectious diseases.
I freely and voluntarily assume all such risks, dangers, and hazards, and the possibility of personal injury, death, property damage, or loss resulting therefrom, whether caused by the negligence of Bre Dance Studio or otherwise.
Release of Liability, Indemnification, and Covenant Not to Sue:
In consideration for being permitted to participate in the Activities, I, on behalf of myself, my spouse, my children, my heirs, executors, administrators, personal representatives, and assigns, hereby:
1. Release and Forever Discharge: Irrevocably release, acquit, and forever discharge Bre Dance Studio, its owners, officers, directors, employees, instructors, agents, representatives, volunteers, successors, and assigns (collectively, the "Released Parties") from any and all claims, demands, actions, causes of action, damages, losses, expenses, and liabilities of any kind or nature whatsoever, whether known or unknown, foreseen or unforeseen, arising out of or in any way connected with my (or my child’s) participation in the Activities, including but not limited to any injury, illness, death, or property damage, even if such injury, illness, death, or property damage is caused by the negligence, active or passive, sole or concurrent, of the Released Parties, or any defect in the premises or equipment.
2. Indemnify and Hold Harmless: Agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, actions, causes of action, damages, losses, expenses (including attorneys' fees and costs), and liabilities of any kind or nature whatsoever arising out of or in any way connected with my (or my child’s) participation in the Activities, including but not limited to those caused by my (or my child’s) negligence or the negligence of third parties.
3. Covenant Not to Sue: Covenant not to sue, initiate, or prosecute any claim, demand, action, or cause of action against the Released Parties for any injury, illness, death, or property damage arising out of or in any way connected with my (or my child’s) participation in the Activities.
Medical Treatment:
In the event of any injury or illness resulting from my (or my child’s) participation in the Activities, I authorize Bre Dance Studio to obtain or provide necessary medical treatment for me (or my child). I understand that I will be solely responsible for all costs and expenses associated with such medical treatment.
Acknowledgement of Understanding:
I have carefully read this Liability Release and Assumption of Risk Agreement and fully understand its contents. I acknowledge that I am signing this agreement voluntarily and with full knowledge of its legal consequences. I am aware that by signing this agreement, I am giving up certain legal rights, including the right to sue the Released Parties.
Consent for Minors:
If the participant is under 18 years of age, I, as the parent/legal guardian, hereby represent that I have the full legal right and authority to execute this Liability Release and Assumption of Risk Agreement on behalf of my child, and I consent to my child’s participation in the Activities and agree to be bound by all the terms and conditions of this agreement.
