Dance LA – Liability Waiver and Hold Harmless Agreement
PLEASE READ CAREFULLY. THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS.
In consideration for being allowed to participate in dance classes, workshops, performances, or other activities offered by Dance LA (the “Studio”), I agree to the following terms:
1. Assumption of Risk
I understand that participation in dance and movement activities involves inherent risks, including but not limited to falls, sprains, strains, broken bones, illness, and other physical injuries. I voluntarily accept and assume all such risks on behalf of myself and/or my child(ren), whether participating on or off the Studio’s premises, including during special events or performances.
2. Waiver and Release of Liability (Including for Negligence)
To the fullest extent permitted by California law, I hereby waive, release, and discharge Dance LA, its owners, instructors, staff, volunteers, affiliates, and representatives (“Released Parties”) from any and all claims or causes of action for personal injury, property damage, wrongful death, or other loss, including those arising from the ordinary negligence of the Released Parties. I understand that this release does not apply to claims arising from gross negligence, reckless conduct, or intentional acts.
3. Indemnification and Hold Harmless
I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all liabilities, claims, damages, costs, or expenses (including reasonable attorney’s fees) arising out of or in connection with my or my child(ren)’s participation in Studio activities.
4. Medical Treatment Authorization
In the event of an emergency, I authorize Dance LA staff to obtain necessary medical treatment for myself or my child(ren). I understand I am responsible for all associated costs.
5. Fitness to Participate
I certify that I or my child(ren) are in good physical condition and have no known medical or mental condition that would prevent safe participation. I agree to inform the Studio in writing of any health conditions or accommodations needed.
6. Photo/Video Release
I grant permission to Dance LA to take and use photographs or video of me or my child(ren) for lawful promotional purposes in print, digital, and social media. No names will be used without additional consent.
7. Governing Law
This agreement shall be governed by the laws of the State of California. Any disputes shall be resolved in the courts of Los Angeles County, California.
By enrolling, I acknowledge that I have read, understood, and voluntarily agree to this Waiver and Release. I understand that I am giving up legal rights, including the right to sue the Released Parties for ordinary negligence.
