In consideration of participating in the activities Studio of Dance and Gymnastics conducts within the building and beyond the grounds of gym, which includes cheerleading, dance, tumble, aerobics, and any other activity that involves motion. I represent that understand the nature of this Activity and that I am qualified, in good health, and in proper physical condition to participate in such Activity. I acknowledge that if I believe bodily injury, including permanent disability, paralysis and death, which may be caused by my own actions, or inactions, those of other's participating in the event, the conditions in which the event takes place, or the negligence of the "RELEASEES" named below; and that there may be other risks either not known to me or not readily foreseeable at this time; and I fully accept the assume all such risk and all responsibility for losses, cost, and damages I incur as a result of my children's and/or my participation in the Activity.

I release the Ann Cumbest Fallo Enterprises, LLC and Fallo Holdings, LLC its instructors, independent contractors, and all other associates from liability for harm, theft, or injury that maybe suffered by me and/or members of my family traveling to or from or during participation in activities and programs sponsored by Ann Cumbest Fallo Enterprises, LLC. I hereby acknowledge that I am voluntarily assuming full responsibility for all risk of physical injury arising out of active participation in a dance/gym class or other dance/gym related activities that may occur with my child(ren), family members or myself. I acknowledge the contagious nature of COVID-19 and other contagious diseases and viruses and, voluntary assume the risk that I and/or my children may be exposed to or infected by COVID-19 by attending and participating and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I release Ann Cumbest Fallo Enterprises, LLC and Fallo Holdings, LLC its instructors, independent contractors and all associates from liability for harm, injury or death pertaining to COVID-19 and other contagious diseases and viruses. I understand that there is no refund for registration fees, costumes, recital fees or classes. I understand that my student must have this release form signed before attending class.

I understand that I am entering a contract with the Studio of Dance and Gymnastics to receive thirty-six (36) weeks of dance and tumbling instruction over a ten (10) month period. I understand that tuition is billed monthly, and auto-drafts are drafted on the first (1st) of the month and cash or check payments must be made by the tenth (10th) of each month to avoid a ten dollar ($10) late fee. I understand that there is a forty-dollar ($40) fee associated with all returned checks. In order to receive my child(ren)'s costume(s); I am aware that my account must be paid in full by April 10 of the current year. I am aware that some years Recital date will fall before the tenth (10th) of the May. I am aware and understand that May tuition and any other fees must be paid in full for my child to pre-register/register for the summer and following dance year. I understand that my child will be dismissed from participating in all classes if my account becomes 2 months in arrears. I understand that if my child no longer wishes to participate in classes at The Studio of Dance, I must submit a written withdrawal letter to ann@studio-of-dance.com within 15 days, in order to cancel tuition charges, auto-drafts, and pay any remaining balances on my account.

I hereby release, discharge, and covenant not to sue the Studio of Dance & Gymnastics, its respective administrators, directors, agents, officers, volunteers, and employees, other participants, any sponsors, advertisers, and, if applicable, owners, and lessors of premises of which the activity takes place (each considered on the "RELEASEES" herein) from all liability, claims, demands, losses, or damages, on my account caused or alleged to be caused in whole or in part by the negligence of the "Releasees" or otherwise, including negligent rescue operations and future agree that if, despite this release, waiver of liability, and assumption of risk I, or anyone on my behalf, makes a claim against any of the Releasees, I will indemnify, save, and hold harmless each of the Releasees from any loss, liability, damage, or cost, which any may incur as the result of such claim.
