All the following, including waivers, releases, policies and procedures, are subject to modification as deemed necessary, and the most current version shall take precedence over any previous editions or communications.
Waiver and Release of Liability
ACKNOWLEDGMENT OF RISKS
I, the undersigned, acknowledge that participation in the classes and activities offered or organized by WAVE of Tampa Bay LLC, herein referred to as WAVE, may involve inherent risks. These risks include, but are not limited to, physical injury, emotional stress, property damage, and other potential hazards associated with the activity. I fully understand that these risks may arise through the actions or inactions of myself, other participants, and/or third parties.
ASSUMPTION OF RISK
I voluntarily and willingly assume all risks, both known and unknown, associated with participation in the activity, including the possibility of injury or harm. I acknowledge that I will consult with a physician prior to participating if I have any concerns about my or my child's health or fitness to participate.
WAIVER AND RELEASE
In consideration for being allowed to participate in any class, activity, or event, I hereby release, waive, discharge, and hold harmless WAVE, its members, managers, officers, directors, agents, employees, volunteers, rental facilities, and all other individuals or entities associated with the activity from any and all liability for any injury, loss, damage, or expense, including attorneys' fees, arising out of or in any way related to my participation in the activity, even if caused by the negligence or fault of WAVE.
This waiver and release includes, but is not limited to, claims for personal injury, property damage, emotional distress, and any other claims related to the activity.
MEDICAL AUTHORIZATION
In the event of an emergency, I hereby authorize WAVE and its representatives to seek medical attention for the participant if necessary. I agree to bear all costs related to such medical treatment.
PHOTO/VIDEO CONSENT
I consent to the use of photos, videos, or other recordings of the participant made during the activity for promotional or educational purposes by WAVE.
PARENTAL CONSENT
As the parent or legal guardian of the child(ren) concerned herein, I consent to the participation of the child(ren) in this activity and agree to the terms of this waiver and release on their behalf. I understand that I am responsible for ensuring that my child complies with all safety rules and instructions during the activity.
SEVERABILITY
If any part of this waiver and release is found to be invalid or unenforceable, the remainder of the document will remain in full force and effect.
GOVERNING LAW
This waiver and release shall be governed by and construed in accordance with the laws of the state of Florida.
MODIFICATION CLAUSE
WAVE reserves the right to modify, alter, or amend any and all parts of this waiver, release, payment policy at any time without prior notice. Such modifications shall be effective retroactively to all parents currently registered with WAVE.
Conduct Policy
This conduct policy aims to establish a safe, respectful, and productive environment for all students and families participating in our Christ-centered co-op. We believe that following biblical principles and exercising common sense will create a supportive learning atmosphere for everyone.
General Behavior Expectations
1. Respect and Kindness: Treat every person with respect, kindness, and dignity, as stated in Ephesians 4:32. Encourage and uplift one another in all interactions.
2. Common Areas: Students should remain in designated areas during co-op hours. Congregating in empty rooms, stairwells, or other non-designated spaces is not permitted for safety and supervision reasons.
3. Physical Space: Maintain a respectful distance from others and respect personal space. Engaging in any form of bullying, harassment, or inappropriate behavior will not be tolerated.
Classroom Conduct
1. Cell Phone Usage: Students may keep their cell phones on, but must be on silent mode, stored away, and not visible during class. Phones should only be used to make calls to parents during designated breaks – last 10 minutes of each hour, not during instructional time.
2. Class Time: Students are encouraged to engage in class discussions, adhere to classroom rules, and respect the authority of teachers and facilitators.
3. Materials and Supplies: Students must take care of classroom materials and personal belongings. If materials are damaged or lost, students may be responsible for replacement.
Safety and Responsibility
1. Emergency Procedures: Follow the on-site directions of your teachers and/or co-op facilitators.
2. Personal Responsibility: Students are encouraged to take responsibility for their own actions and choices, and to resolve conflicts amicably and respectfully.
Dress Code
1. Modesty: Dress in a manner that reflects a Christ-like attitude. Clothing should not be distracting to others and should honor the values of the co-op family. No crop tops.
2. Footwear: Appropriate footwear is required for indoor and outdoor activities, ensuring safety and comfort.
Consequences for Misconduct
1. Warning System: Minor infractions will result in a warning from a teacher or co-op leader.
2. Parent Notification: Repeated or serious infractions will be communicated to parents through electronic notice.
3. Disciplinary Action: Persistent disregard for the policy may result in temporary suspension or removal from the co-op, depending on the severity of the behavior.
Acknowledgment
By enrolling in this co-op, students and parents agree to abide by this conduct policy, fostering an environment that reflects our shared values and goals. We appreciate your cooperation and commitment to maintaining a positive experience for everyone involved.
PAYMENT & REFUND POLICY
1. STEP UP FOR STUDENTS DIRECT PROVIDER PROGRAM
WAVE is a Direct Provider in the Step Up For Students direct payment program, herein referred to as SUFS. As such, any parent or guardian that uses direct payment of funds, for any and all services, tuition, fees, or other remittances to WAVE agrees to the following: 1. There are no refunds given in any capacity whatsoever, as required by SUFS rules. 2. Once SUFS direct payment is remitted, that transaction is final, whether or not the student starts, continues, or discontinues involvement in any classes, offerings, services, events, participation, or other such items as provided by WAVE. 3. WAVE requires that direct payments made through SUFS are remitted within THREE calendar days of your class registration submission. 4. If SUFS direct funds are not remitted within THREE calendar days of the class registration submission, the student's registration may be cancelled, and the registration and payment process will have to be repeated.
2. SUFS SPOT HOLDER
“Spot holder” funds may be allowed for families that meet ALL the following conditions: A. You have been approved by SUFS to receive funding for the current season. B. Your SUFS balance for the student it concerns is below $250 as of today. C. You have received an email or text from WAVE with our express approval for the spot holder.
Spot holders are non-refundable in ALL circumstances. If direct payment from your SUFS account is not reserved/remitted to WAVE for all outstanding balances due and/or funds have not been remitted by any other means, within THREE calendar days of SUFS funding being added to your account, your spot holder will be forfeited in its entirety and the student(s) will be dropped from classes immediately.
3. REFUNDS
If you use Direct Funding from a Step Up For Students account, refunds are not permitted.
If you use a payment method such as credit/debit card, check, etc., for tuition and/or fees and if you or the student have one of the following extenuating circumstances: debilitating illness or immediate-family relocation greater than 35 miles further away from WAVE’s current class meeting location, submit an email to us 15 days or more prior to the start date of classes, with the reason for the request, for the following schedule of refunds…
A. If we cannot fill the spot(s) by the start date of class for the class(es) you are requesting to drop, we will refund 75% of the tuition charged.
B. If we can fill the spot(s) by the start date of class for the class(es) you are requesting to drop, we will refund 100% of the tuition charged.
C. In all cases, the annual registration fee and any CC processing fees are not refundable.
D. Within 15 days of the start date of any semester or season, refund requests are not accepted.
E. Spot Holder payments (using any payment method) are non-refundable in their entirety.
