Welcome to Ethnique Performing Arts! We're glad you're here, and we hope registration was a smooth experience.
**A note on our name.** Our legal business name is **Stage Skuare LLC**. You may see this name on invoices, receipts, AutoPay statements, or other official correspondence — rest assured, "Ethnique Performing Arts" and "Stage Skuare LLC" refer to the same company. Throughout this document, "we," "us," "our," or "the Studio" refers to Stage Skuare LLC d/b/a Ethnique Performing Arts.
To manage your account, update student information, or view schedules and payments, log in to our customer portal at **https://app.gostudiopro.com/online/ethnique**.
Please read this document carefully. It governs your (and, where applicable, your child's) enrollment and participation in classes, performances, and events at Ethnique Performing Arts, and it includes a release of liability, an assumption of risk, and an indemnification agreement. **By registering, enrolling, or allowing your child to attend a class — including a free trial class — you agree to be bound by these Policies, Terms & Conditions in full.**

## 1. Definitions and Acceptance of Terms
"You" and "Parent/Guardian" refer to the adult who registers a student, and "Student" or "Participant" refers to the individual — adult or minor — enrolled in classes. Where a Student is a minor, the enrolling Parent/Guardian represents that they are the child's parent or legal guardian and have full authority to enroll the child and agree to these terms on the child's behalf.
These Policies, Terms & Conditions may be updated from time to time. We'll post the current version to our website or customer portal and, where changes are material, notify enrolled families by email. Continued enrollment or attendance after an update takes effect constitutes acceptance of the revised terms.

## 2. Payment Procedure
Your first class is a free trial — no payment is required to try us out. If you decide to enroll, a **one-time, non-refundable registration fee of $35** applies.
We use AutoPay exclusively, charged to a credit card, debit card, or ACH bank draft on file. We are not able to accept cash, checks, or PayPal. A valid payment method must remain on file for the entire duration of active enrollment, and it's your responsibility to keep that payment method current.
Monthly tuition is **$80** (competition team classes are billed separately — see your competition agreement) and is auto-debited on the **1st of each month**.
## 3. Late & Declined Payments
To avoid late fees, please make sure your payment method on file is valid and up to date before the 10th of each month. Late fees apply as follows:
- **$10** if payment has not processed by the 10th of the month
- An **additional $10** if payment still has not processed by the 20th of the month
If a balance remains unpaid for more than one month, the Student will not be permitted to attend class until the account is brought current. A **$9.75 fee** applies to each declined AutoPay transaction. If a card is declined three times, a **$1 fee** applies per additional decline, and you'll be required to add a new payment method before further attempts are made. Keeping your card, expiration date, and billing information current is your responsibility — we are not able to waive late or decline fees caused by an expired or invalid card on file.
## 4. Billing Cycle, Absences & Proration
Our billing cycle runs from the 1st of each month. We're happy to prorate tuition for missed classes — even a single class — but we do need advance notice: email **office@ethnique.org** at least **15 days before the start of the next billing cycle** to request proration. Requests received after that 15-day window cannot be applied retroactively, so please reach out as early as you can.
If your Student misses a class, a make-up class may be taken on another day or at another location, subject to availability. The song, choreography detail, or instructor for a make-up class may differ from the regular class, but the same core dance skills will be taught. Make-up classes are available only to Students who are currently enrolled and current on payment; a Student who is not active in the billing cycle (including during a period of non-payment) is not eligible for make-ups, with no exceptions.
## 5. Withdrawal & Cancellation
We'd love to keep your Student dancing with us, but if you need to withdraw, we ask for **written notice by email to office@ethnique.org at least 15 days before your next billing date**. AutoPay will continue to draft on the 1st of each month until we receive and confirm your written cancellation notice — verbal notice to an instructor, front-desk staff, or a note left at the studio is not sufficient. Because tuition is billed in advance for the month, we do not issue partial-month refunds for a withdrawal that takes effect mid-cycle. The $35 registration fee is non-refundable under any circumstances, including withdrawal shortly after enrolling.
## 6. Administrative Authority
Only the Administrator has authority to make changes to tuition, fees, and billing; class schedules; or account updates and exceptions (including proration and refund exceptions). Instructors — whether junior or senior — are wonderful resources for your Student's dance training, but they do not have authority to make administrative, scheduling, or financial decisions on behalf of the Studio. For any account changes, please contact **office@ethnique.org**.
## 7. Studio Holidays & Closures
We observe the following holiday schedule. Unless a holiday is specifically marked as prorated below, tuition is not adjusted for studio closures on these dates, as our monthly tuition is calculated on an annual basis, not a per-class basis:
- **Memorial Day** — no proration
- **Labor Day (September 7)** — no proration
- **Thanksgiving Break (November 27–30)**, including Thanksgiving Day on November 26 — no proration
- **Winter Break (December 22 – January 3)** — prorated
From time to time, the Studio may also need to close for inclement weather, facility issues, a public health concern, or other circumstances beyond our control. See **Section 20 (Force Majeure)** for how these closures are handled.
## 8. Performances, Recitals & Costume Fees
Participation in our annual recital is mandatory for all enrolled Students; other showcases, guest performances, and competitions are optional unless otherwise specified for a competition team. A scheduled performance day counts as a regular class session and is not eligible for make-up credit. Regular classes continue to be held both before and after performance dates on the normal schedule.
Costume, recital, and performance-related fees are separate from monthly tuition and will be communicated to families in advance of each season, along with ordering and payment deadlines. Once a costume has been ordered or a venue/production cost has been committed on your Student's behalf, that fee is non-refundable, including if your Student later withdraws or is unable to attend the performance.
From time to time we may also organize Parent Presentations based on a class's readiness and venue availability; details will be shared with affected families in advance.
## 9. Discounts
**Referral Discount.** Refer an immediate family member — child, sibling, or parent — and receive **$20 off your next billing** once they enroll and pay. The new Student must list your name at registration, and you should email office@ethnique.org with the new Student's name, class location, and batch name so we can apply the credit.
**Family Discount.** When a third immediate family member enrolls, that Student receives a **$20 discount**. All three family members must remain actively enrolled for the discount to continue.
**Special Discount.** We occasionally offer discounts to families who help us launch a new class batch or who refer five or more new Students. We'll reach out directly with details if you qualify.
Discounts cannot be combined unless we say so in writing, and all discounts require the referring and referred accounts to remain active and current on payment.
## 10. Attendance, Dress Code & Studio Etiquette
We ask Students to arrive on time, dressed and ready to dance — please check with your instructor about the appropriate attire, footwear, and hairstyle for your Student's class style. For safety, dangling jewelry should be removed before class, and hair should be secured back from the face.
Food, drinks (other than water), and gum are not permitted inside the studio space. Cell phones should be silenced and put away during class time. We understand plans change — if your Student will be late or absent, a courtesy heads-up to the studio is always appreciated, though it does not itself entitle you to proration or a make-up (see Sections 3 and 4).
The Studio reserves the right to place, group, or move a Student between classes or levels based on age, skill development, attendance, or class balance, in the Studio's reasonable discretion and with the goal of supporting your Student's growth.
## 11. Illness & Health Reporting
Please keep your Student home if they have a fever, contagious illness, lice, pink eye, or similar condition, until they are no longer contagious per guidance from their physician or the CDC. If your Student is injured during class or on our premises, please notify a staff member immediately so we can document the incident and provide any necessary first aid or emergency response. Any medical condition, allergy, injury, or physical limitation that could affect your Student's participation must be disclosed to us in writing at registration or as soon as it arises, and a physician's written clearance may be required before your Student returns to class following an injury or medical procedure.

## 12. MEDIA, PHOTO & VIDEO RELEASE
**Please read this section carefully — it affects your rights and continues even after your Student is no longer enrolled.**
As part of enrollment, and in consideration of your Student's participation in our program, you grant Ethnique Performing Arts / Stage Skuare LLC, its owners, employees, agents, and contractors an **irrevocable, perpetual, worldwide, royalty-free right and license** to photograph, film, video-record, and audio-record you and/or your Student during classes, rehearsals, performances, recitals, competitions, and studio events, and to use, reproduce, edit, publish, and distribute those photographs, videos, and recordings (and your/your Student's name, likeness, and voice as captured in them) in any medium now known or later developed, including but not limited to:
- our website, social media accounts (Instagram, Facebook, TikTok, YouTube, and similar platforms), and email marketing;
- printed and digital promotional material such as flyers, brochures, banners, and advertisements;
- dance reels, highlight videos, recital or competition footage, and studio archives; and
- submissions to media outlets, competition organizers, and venues in connection with our programs.
This license is granted **for no fee or additional compensation**, and we are under no obligation to use any particular image or recording. We may edit, crop, or combine footage at our discretion.
**This release survives disenrollment and withdrawal.** Media captured while your Student was enrolled remains subject to this license after your Student leaves the program, transfers elsewhere, or otherwise disenrolls — for example, a recital video, class photo, or promotional reel that includes your Student may continue to be displayed, distributed, or used after enrollment ends. Because this license is irrevocable, **you may not request that previously captured photos or videos be deleted, taken down, or removed from use**, and we are not obligated to honor such a request, before or after disenrollment. If you are not comfortable with this arrangement, please let us know in writing before your Student's first class, as this is a condition of enrollment and not something we're able to waive on a case-by-case basis after the fact.
If, at any time, you wish to be excluded from a *specific future* recording (for example, a particular sponsored shoot), you're welcome to make that request in writing to office@ethnique.org, and we'll accommodate it where reasonably possible for that instance — but this does not affect footage already captured, and general classroom, rehearsal, and performance recording will continue as part of normal studio operations.

## 13. HEALTH, ASSUMPTION OF RISK, AND LIABILITY WAIVER
**READ CAREFULLY BEFORE ENROLLING — THIS SECTION AFFECTS YOUR LEGAL RIGHTS.**
**13.1 Physical Fitness and Medical Disclosure.** Dance and performing arts training is physically demanding. By enrolling, you represent that you (and/or your Student) are physically fit to participate, with no condition that would make participation unsafe, except as disclosed to us in writing. Any medical condition, injury history, allergy, or physical limitation requiring special attention or accommodation must be disclosed in writing at registration or as soon as it arises. Where a condition warrants it, we may require a written medical release ("No Objection Certificate") from a treating physician before permitting participation to continue.
**13.2 Assumption of Risk.** Dance, choreography, partnering, tumbling, jumps, lifts, and related performing-arts activities carry inherent risks of injury, including but not limited to sprains, strains, fractures, joint and muscle injuries, collisions with other students or objects, and, in rare cases, more serious injury. **You understand these risks and voluntarily assume them** on behalf of yourself and, where applicable, your Student, as a condition of participating in our classes, rehearsals, performances, and related activities, whether on our premises or at an off-site venue.
**13.3 Release of Liability.** To the fullest extent permitted by law, **you release, discharge, and agree not to sue** Ethnique Performing Arts, Stage Skuare LLC, and their owners, officers, instructors, employees, agents, and contractors (collectively, the "Released Parties") from **any and all claims, demands, or causes of action arising from ordinary negligence** of the Released Parties in connection with your or your Student's participation in classes, rehearsals, performances, or other studio activities, including claims for personal injury, property damage, illness, or death. This release does **not** extend to claims arising from the Released Parties' **gross negligence, willful misconduct, or intentional acts**, which are not waived by this section.
**13.4 Important Note for Parents/Guardians of Minor Students.** Under Texas law, a parent or guardian generally cannot waive a minor child's own independent legal claim for personal injury — this release binds the claims of the enrolling adult signing below, and serves as your acknowledgment and assumption of the risks described above on behalf of your family, but it may not eliminate a minor Student's own right to pursue a claim in their own name. Because of this, we also rely on the Indemnification provision in Section 15, and we strongly encourage all families to maintain their own health/accident insurance coverage as described below.
**13.5 Medical Treatment and Insurance.** In the event of an accident, injury, or medical emergency, you agree that your (or your Student's) own personal health insurance is the primary source of coverage for any resulting medical treatment, and the Studio does not provide accident or health insurance coverage for Students. See Section 14 for emergency medical treatment authorization.
**13.6 No Warranty.** We take reasonable precautions to maintain a safe studio environment, but we make no warranty or guarantee that participation is free of risk of injury.
## 14. Emergency Medical Treatment Authorization
In the event your Student is injured or becomes ill while in our care and we are unable to reach you or another authorized emergency contact promptly, you authorize Ethnique Performing Arts / Stage Skuare LLC staff to: (a) administer basic first aid; (b) call 911 or otherwise seek emergency medical treatment or transport for your Student, including by ambulance if deemed necessary by staff or emergency responders; and (c) consent to emergency medical treatment on your behalf until you or another authorized emergency contact can be reached. You agree that you (not the Studio) are responsible for any costs of medical treatment or transport arising from such emergency care. Please keep your emergency contact information, physician information, and any relevant medical or allergy information current in the customer portal.
## 15. Indemnification
To the fullest extent permitted by law, you (the enrolling Parent/Guardian or adult Student) agree to **indemnify, defend, and hold harmless** the Released Parties identified in Section 13.3 from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your or your Student's participation in Studio classes, rehearsals, performances, or events; (b) any injury, property damage, or other harm caused by your Student's actions while at the studio or a Studio-sponsored event; or (c) your breach of these Policies, Terms & Conditions — except to the extent such claims, damages, or losses arise from the gross negligence, willful misconduct, or intentional acts of the Released Parties. This indemnification is in addition to, and not a substitute for, the release and assumption of risk described in Section 13.

## 16. Parent Responsibilities & Code of Conduct
Parents and guardians are responsible for supervising Students before and after scheduled class hours; our instructors are not responsible for Students outside of their designated class time, and it is not safe for a Student to wait outside or leave the premises unsupervised, so please arrange for prompt pick-up. Families are financially responsible for any damage to studio property, equipment, or facilities caused by their Student.
We're committed to a positive, respectful, and safe environment for every dancer, family, and instructor. A Student who is disruptive, disrespectful, or physically aggressive toward staff or other students may be dismissed from class for that day, with the parent notified. After two documented incidents, we'll schedule a meeting with the family to discuss next steps; continued behavioral concerns may result in dismissal from the program without a refund of tuition or fees already paid.
This expectation applies to parents and guardians as well: instructors and administration reserve the right to ask a parent, guardian, or other adult to leave the premises, and, in serious or repeated cases, to end a family's enrollment, in order to preserve a safe and respectful environment for our students and staff. Harassment, threats, or abusive behavior toward staff, students, or other families will not be tolerated and may result in immediate dismissal from the program without refund.
## 17. Lost Property
The Studio is not responsible for personal belongings left on the premises. Unclaimed items may be placed in a lost-and-found and periodically donated or discarded if not claimed within a reasonable time.
## 18. Non-Solicitation of Instructors
Our instructors are valued members of the Ethnique Performing Arts team, and their placement, training, and availability to teach at our studio represent a significant investment on our part. While enrolled, and for a period after your Student's enrollment ends, you agree not to directly hire, engage, or solicit any current Studio instructor to provide private dance instruction outside of the Studio without our prior written consent. If you'd like private lessons, please contact office@ethnique.org and we're happy to help arrange them.
## 19. Communications & Electronic Notices
By enrolling, you consent to receive communications from us by email, text message, and/or the customer portal regarding billing, scheduling, closures, and studio announcements. It's your responsibility to keep your contact information current in the portal so you don't miss important notices, including notices under Section 1 about updates to these Policies, Terms & Conditions.
## 20. Force Majeure
We are not liable for a failure or delay in providing classes, performances, or other services due to causes beyond our reasonable control, including severe weather, natural disaster, fire, public health emergency, government order, utility or facility failure, or other events of force majeure. Where a closure of this kind extends for a significant period, we will communicate with enrolled families about make-up plans, remote options (where feasible), or billing adjustments at the Studio's discretion.
## 21. Governing Law, Venue & Dispute Resolution
These Policies, Terms & Conditions are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising out of or relating to your enrollment or these terms will be brought exclusively in the state or federal courts located in DFW, Texas, and you consent to the personal jurisdiction of those courts. Before filing a claim, we encourage you to contact office@ethnique.org so we can try to resolve the issue directly.
## 22. Severability
If any provision of these Policies, Terms & Conditions is found by a court to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will continue in full force and effect.
## 23. Entire Agreement & Amendments
These Policies, Terms & Conditions, together with any registration form, competition team agreement, or costume/recital order you've signed, represent the entire agreement between you and the Studio regarding your Student's enrollment, and supersede any prior verbal or written understanding on these topics. We may update these terms as described in Section 1; no other modification is effective unless made in writing by the Administrator.
## 24. Acknowledgment
By registering a Student, attending a free trial class, or continuing enrollment at Ethnique Performing Arts, you acknowledge that you have read, understood, and agree to these Policies, Terms & Conditions in full, including the Media, Photo & Video Release (Section 12), the Health, Assumption of Risk, and Liability Waiver (Section 13), the Emergency Medical Treatment Authorization (Section 14), and the Indemnification provision (Section 15).
