PARTICIPATION AGREEMENT, RELEASE OF LIABILITY, ASSUMPTION OF RISK & INDEMNITY
This Agreement (“Agreement”) is entered into by the undersigned adult participant, or parent/legal guardian of the minor participant named below (collectively, “Participant”), in favor of Melinda Leigh Performing Arts Center, its owners, directors, officers, employees, independent contractors, volunteers, agents, successors and assigns (collectively, “Releasees”).
1. Scope of Activities
This Agreement applies to all classes, rehearsals, performances, camps, parties, use of facilities, and any other events or activities (collectively, “Activities”) offered or sponsored by Releasees, whether conducted on‑site, off‑site, or virtually.
2. Health & Fitness to Participate
Participant represents that they (or the minor) are in good health and physical condition to safely engage in the Activities. Participant agrees to notify Releasees immediately of any condition that may affect safe participation.
3. Assumption of Inherent Risks
Participant understands that dance and related Activities involve inherent dangers—including but not limited to falls, collisions, muscle strains, permanent disability, paralysis, illness, and death. Participant voluntarily and knowingly assumes all such risks, whether foreseeable or not, including risks arising from the negligence of Releasees or others.
4. Waiver & Release of Liability
To the fullest extent permitted by law, Participant releases, waives, and forever discharges Releasees from any and all claims, demands, actions, or causes of action for personal injury, illness (including exposure to communicable diseases such as COVID‑19, influenza, MRSA), property damage, or wrongful death arising out of or relating to the Activities, whether caused by the negligence of Releasees or otherwise.
5. Indemnification
Participant agrees to defend, indemnify, and hold harmless Releasees from any loss, liability, damage, or cost (including reasonable attorneys’ fees) arising out of or related to (a) Participant’s participation in the Activities, or (b) claims brought by or on behalf of Participant or any third party.
6. Medical & Insurance Responsibility
Participant is solely responsible for obtaining and maintaining adequate medical, health, and accident insurance for all risks associated with the Activities. Participant authorizes Releasees to obtain emergency medical care for Participant at Participant’s expense if deemed necessary.
7. Photo & Video Authorization
Participant grants Releasees the irrevocable right to photograph and record Participant during the Activities and to use such images, videos, or likenesses for any lawful promotional, instructional, or commercial purpose in any medium, without compensation. Participant waives any right to inspect or approve such use.
8. Financial Commitment & Policies
By registering, Participant acknowledges and agrees to all Studio Policies and Procedures, including:
Full‑Year Enrollment (Aug–May). After September 1st, families remain financially responsible for the full tuition of any class until that spot is filled by another student. Tuition is non‑refundable and non‑transferable.
Tuition is billed in monthly installments and is non-refundable and non-transferable under any circumstance. Tuition will not be prorated for missed classes, vacations, holidays, or unexpected closures.
Virtual Instruction. Releasees may convert any class to live‑stream or recorded virtual instruction (e.g., via Zoom) without refund or credit.
Late & Returned‑Payment Fees. $20 late fee on any balance unpaid after the 15th of the month; $35 fee for returned checks.
Recital Participation. Accounts must be current for a student to perform.
Drop‑Off & Pick‑Up. Arrival no earlier than 10 minutes before class; $20 fee per half‑hour if more than 15 minutes late for pick‑up.
9. Code of Conduct
Respectful behavior is expected from all students, parents, and guardians. Disruptive behavior may result in dismissal from the program without refund. Students should come dressed appropriately for class, ready to learn, and with a positive attitude.
10. Credit‑Card Authorization
Participant authorizes Releasees to automatically charge tuition and fees to the credit card on file on the 5th of each month (August 2025 – May 2026).
11. Severability
If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
12. Entire Agreement & Governing Law
This document, together with the Studio Policies referenced herein, constitutes the entire agreement between the parties and supersedes all prior oral or written representations. It shall be governed by and construed in accordance with the laws of the State in which Releasees operate, without regard to conflict‑of‑law principles.
