I acknowledge that this Accident Waiver and Release of Liability Form will be used by the event holders, sponsors, and organizers of the activity or event in which I/my dancer may participate, and that it will govern my actions and responsibilities at said activity or event. In consideration of my application and permitting me to participate in this event, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:
Waiver of Liability
As the parent or guardian of the participant I recognize and understand the risks of physical injury inherent to dance and dance training and I fully assume those risks. I hereby release Absolute Motion Performance & Dance, event sponsors, employees, contractors, and dance teachers from all liability for injuries sustained or illnesses contracted while attending or participating in any dance classes, rehearsals, workshops, or performances. I agree to indemnify, defend, and hold harmless Absolute Motion Performance & Dance, employees, contractors, and dance teachers for liabilities, costs and judgments arising from acts of omission committed by me or my child which result in injury or damage to any person or property.
I certify that I/my dancer is physically fit and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my/their participation in this activity or event.
I certify that I/my dancer is in good health and do not pose a health risk to the public.
I HEREBY WAIVE, RELEASE, AND DISCHARGE Absolute Motion Performance & Dance and all divisions thereof of any and all liability and responsibility for injuries, sickness, pandemics, accidents, natural disasters and/or acts of God incurred during participation in and/or instruction of classes, camps, private lessons, recitals, competitions or any activity I/my dancer may participate in.
I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN THIS ACTIVITY OR EVENT, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault.
I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me/my dancer including my traveling to and from this event, THE FOLLOWING ENTITIES OR PERSONS: Absolute Motion Performance & Dance and their employees, volunteers, or the activity or event holders, activity or event sponsors, activity or event volunteers.
I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this waiver, release and registration form from any and all liabilities or claims made as a result of participation in this activity or event, whether caused by the negligence of release or otherwise. The accident waiver and release of liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
Protection of Property
I understand and agree that it is my sole responsibility to safeguard my personal property while attending or participating in any classes, rehearsals, workshops, or performances. I hereby release Absolute Motion Performance & Dance, its affiliate dance studios, event sponsors, employees, contractors, and dance teachers from all liability for loss or damage to my personal property while attending or participating in classes, rehearsals, workshops, or performances. I also agree to abide by any rules, regulations and policies set forth by Absolute Motion Performance & Dance.
Medical Attention
In case of physical injury or medical emergency, I hereby authorize Absolute Motion Performance & Dance to make necessary arrangements to transport myself or my child to a medical treatment facility as necessary, including but not limited to calling 911, or requiring an ambulance. All such transportation and medical treatment will be at my sole cost and expense. In extreme emergencies, or if my child is under 18 years of age, I understand that Absolute Motion Performance & Dance will attempt to notify the person(s) I have named as my emergency contact(s) of my condition and how to reach me.
Photo & Video Release
Absolute Motion Performance & Dance reserves the right to use photographs and videos taken during classes, workshops, performances, or other affiliated events for the purposes of instruction, advertising and promoting Absolute Motion Performance & Dance and its programs both online, on social media, and in print. Students, or parents of students who are minors, who do not wish to comply with this policy must notify Absolute Motion Performance & Dance prior to participation in class.
Acknowledgement of Waiver
In signing this Release, I acknowledge and represent that I have fully informed myself of the content of the waiver and hold harmless agreement by reading it before I sign it, and I understand that I sign this document as my own free act and deed; no oral representations, statements, or inducements, apart from the written statement, have been made. I further state that I am at least eighteen (18) years of age and am fully competent to sign this agreement; and that I execute this release for full, adequate, and complete consideration fully intending to be bound by the same. I further state that there are no health-related reasons or problems which preclude or restrict my or my child’s participation in this activity, and that I will pay any medical costs that may be attendant as a result of injury to me or my child.
PARENT / GUARDIAN WAIVER FOR MINORS (Only if student is under 18 years old)
The undersigned parent and natural guardian does hereby represent that he/she is, in fact, acting in such capacity, has consented to his/her child or ward’s participation in the activity or event, and has agreed individually and on behalf of the child or ward, to the terms of the accident waiver and release of liability set forth above. The undersigned parent or guardian further agrees to save and hold harmless and indemnify each and all of the parties referred to above from all liability, loss, cost, claim, or damage whatsoever which may be imposed upon said parties because of any defect in or lack of such capacity to so act and release said parties on behalf of the minor, the parents, of the legal guardian.
I CERTIFY THAT I HAVE READ THIS DOCUMENT, AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.
