⚖️ Liability Waiver & Media Release
Assumption of Risk
I, the undersigned participant (or parent/legal guardian if the participant is a minor), acknowledge and fully understand that participation in dance, acrobatics, aerial arts, theater, music, visual arts, fitness activities, rehearsals, performances, competitions, camps, educational programming, field trips, special events, and all other programs, classes, or activities offered by Dehner Elite Arts and Dehner Elite Arts Academy (collectively referred to as "DEA") involves inherent risks.
These risks include, but are not limited to, slips, falls, collisions with participants or equipment, sprains, strains, fractures, concussions, paralysis, permanent disability, illness, emotional distress, property damage, and, in rare circumstances, death. I understand that these risks cannot be completely eliminated despite reasonable safety precautions.
I voluntarily choose to participate (or allow my child to participate) in these activities with full knowledge and acceptance of the inherent risks involved.
Release and Waiver of Liability
In consideration of being permitted to participate in any DEA program or activity, I, on behalf of myself, my child, my heirs, executors, administrators, personal representatives, successors, and assigns, hereby release, waive, discharge, and covenant not to sue Dehner Elite Arts, Dehner Elite Arts Academy, its owners, directors, officers, employees, instructors, independent contractors, volunteers, agents, affiliates, landlords, and representatives (collectively, the "Releasees") from any and all claims, demands, liabilities, causes of action, damages, losses, or expenses arising out of or related to any injury, illness, disability, death, or property damage sustained while participating in DEA activities or while on DEA property, whether caused by the negligence of the Releasees or otherwise, to the fullest extent permitted by applicable law.
Indemnification
I agree to indemnify, defend, and hold harmless the Releasees from and against any and all claims, demands, liabilities, damages, judgments, costs, expenses, and attorneys' fees arising from or relating to my (or my child's) participation in DEA activities, including claims brought by third parties, to the fullest extent permitted by law.
Medical Authorization
In the event of an emergency, I authorize DEA staff to obtain emergency medical treatment for me (or my child) if I cannot be reached immediately.
I understand and acknowledge that:
DEA does not provide medical, accident, or health insurance for participants.
I am solely responsible for any medical expenses incurred.
DEA staff may act in good faith to secure emergency care when necessary but assumes no responsibility for the outcome of such treatment.
Media Release
I grant Dehner Elite Arts and Dehner Elite Arts Academy the unrestricted, perpetual, irrevocable, royalty-free right to photograph, videotape, audio record, and otherwise capture my (or my child's) likeness during participation in DEA activities.
I authorize DEA to use these photographs, videos, and recordings for educational, promotional, advertising, marketing, fundraising, social media, websites, printed materials, television, digital publications, and any other lawful business purpose without compensation, notification, or further consent.
I understand that all photographs, videos, and recordings remain the sole property of Dehner Elite Arts.
Electronic Acceptance & Studio Pro Enrollment Agreement
By enrolling in classes, camps, workshops, private lessons, performances, competitions, educational programs, or any other activity offered by Dehner Elite Arts through the Studio Pro registration system, I acknowledge that I have been provided access to this Liability Waiver & Media Release.
I certify that I have read, understand, and voluntarily agree to all terms contained herein.
I understand that completing the online registration process and submitting my enrollment through Studio Pro constitutes my electronic signature, which carries the same legal force and effect as a handwritten signature under applicable federal and state law.
By submitting my registration, I affirm that:
I am at least eighteen (18) years of age, or
I am the parent or legal guardian of the participating minor and have the legal authority to enter into this agreement on behalf of my child.
I further acknowledge that enrollment through Studio Pro confirms my acceptance of all DEA policies, procedures, tuition policies, attendance policies, participation requirements, liability waivers, medical authorizations, media releases, and all other published policies governing participation in DEA programs.
Acknowledgment of Understanding
I certify that I have carefully read this Liability Waiver & Media Release in its entirety and fully understand its contents.
I acknowledge that participation in DEA activities involves inherent risks that cannot be completely eliminated and voluntarily assume all known and unknown risks associated with participation.
I understand that I am giving up substantial legal rights, including the right to file a lawsuit or recover damages from the Releasees for injuries, losses, or damages arising from participation, except where prohibited by applicable law.
I acknowledge that I have had the opportunity to ask questions regarding this agreement and that I enter into it freely, voluntarily, knowingly, and without coercion.
I intend this agreement to be a complete and unconditional release of liability to the fullest extent permitted by law. If any provision of this agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
