DEHNER ELITE ARTS LLC STUDIO AGREEMENT

This Agreement (“Agreement”) is entered into between the undersigned (the “Participant” or “Parent/Guardian” if Participant is a minor) and Dehner Elite Arts LLC (the “Studio”) for participation in classes, programs, and events offered by Dehner Elite Arts LLC.

1. Liability Release and Assumption of Risk

By signing this Agreement, I, the undersigned, acknowledge and agree to the following:

a. I fully understand that participation in classes, events, or activities at Dehner Elite Arts LLC, including but not limited to dance, musical theatre, and any other activities provided by the Studio, may involve physical activity and/or the use of equipment. I acknowledge that there are inherent risks involved in such activities, which may result in injury, including but not limited to sprains, strains, fractures, or more serious injuries.

b. I voluntarily assume all risks associated with my or my child’s participation in the Studio’s programs and activities.

c. I hereby release, waive, discharge, and hold harmless Dehner Elite Arts LLC, its officers, employees, agents, instructors, and representatives from any and all liability for any injury, illness, damage, loss, or other harm arising from or in connection with my or my child’s participation in any class, event, or activity at the Studio, whether caused by negligence or otherwise.

d. I further agree that in the event of any emergency, Dehner Elite Arts LLC has permission to seek emergency medical care for me or my child, and I accept full responsibility for any related expenses.

2. Payment Terms

a. Monthly Payment: I agree to pay the monthly tuition for the classes, events, or programs I or my child are participating in at Dehner Elite Arts LLC. The fee is due on the 8th of each month for the upcoming month of classes.

b. Late Payment: I understand that if payment is not received by the 8th of the month, a late fee of $15 will be automatically charged to my account. If payment is not received by the 15th of the month, my or my child’s participation in classes may be suspended until payment is received.

c. Non-Refundable Payments: All payments made to Dehner Elite Arts LLC, including tuition, registration fees, and any other charges, are non-refundable. No exceptions will be made for missed classes, withdrawal, or any other reason.

3. Class Attendance and Commitment

a. I understand that the Studio’s classes are designed for students to participate on a weekly basis. Regular attendance is essential to ensure the proper development of skills and to prepare for performances and recitals. I agree that I or my child will attend classes regularly.

b. If I or my child cannot attend a class, I will notify the Studio in advance and understand that makeup classes may not always be available. I also understand that missed classes do not reduce the monthly tuition payment.

4. Media Release

I grant Dehner Elite Arts LLC permission to take photographs, videos, or other media during classes, events, or performances involving myself or my child. I understand that these media may be used for promotional or educational purposes, including but not limited to the Studio’s website, social media, or marketing materials.

5. Code of Conduct

I agree to adhere to all rules and policies established by Dehner Elite Arts LLC, including the Studio’s code of conduct, which promotes a safe and respectful environment for all students and staff. I understand that disruptive behavior, including but not limited to bullying, inappropriate language, or failure to follow safety guidelines, may result in dismissal from classes or the Studio.

6. Cancellation and Withdrawal

a. I understand that if I wish to withdraw from classes, I must notify the Studio in writing at least 14 days prior to the beginning of the next month to avoid being charged for the upcoming month.

b. Withdrawal from the Studio’s programs does not relieve me of my obligation to pay for any remaining balance or tuition fees owed for the current month.

7. Termination of Agreement

Dehner Elite Arts LLC reserves the right to terminate this Agreement at any time if the Participant or their guardian fails to adhere to the terms of this Agreement, including but not limited to non-payment, disruptive behavior, or failure to comply with Studio policies.

8. Governing Law

This Agreement will be governed by and construed in accordance with the laws of the state of [State], without regard to its conflict of laws provisions.

9. Severability

If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the remainder of the Agreement will remain in full force and effect, and the invalid or unenforceable provision will be construed in a manner that reflects the original intent of the parties.

10. Entire Agreement

This Agreement constitutes the entire understanding between the Participant (or Parent/Guardian) and Dehner Elite Arts LLC with respect to the subject matter hereof, and supersedes any prior agreements or understandings, written or oral, relating to such subject matter.

By registering my student for activities, I hereby acknowledge and agree to the following:

1. Liability Release

I understand that participation in these activities involves certain risks, including but not limited to physical injury or property damage. By registering my student, I release all organizers, staff, agents, volunteers, and affiliates from any and all liability for any injuries, damages, or losses that may occur as a result of their participation in these activities.

2. Photography/Video Consent

I grant permission for my student to be photographed and/or recorded on video during participation in these activities. I understand that these images and videos may be used for promotional, educational, or publicity purposes, including but not limited to social media, websites, and printed materials. I consent to the use of these materials without compensation or further approval.

3. Assumption of Risk

I acknowledge that by registering my student for these activities, I am assuming all associated risks and agree to adhere to all safety guidelines provided. I understand that it is my responsibility to ensure my student follows all instructions and uses any equipment or facilities provided in a safe manner.

I/we realize that participation in dance classes or any other activities at Dehner Elite Arts could result in some possible personal injury. Despite precautions being taken by the studio, accidents and injuries may occur. By signing this release form, I/we (the dancer and parent/guardian) assume all risks related to the use of any and all spaces used by Dehner Elite Arts.
I/we agree to release from responsibility the Dehner Elite Arts, including all teachers, dancers, staff members, and facilities used by all entities from any cause of action, claims, or demands now and in the future. I/we will not hold Dehner Elite Arts liable for any personal injury including: scrapes, bruises, cuts, sprains, fractures, broken bones, concussions or death or any personal property damage/loss, which may occur on the premises before, during or after classes.

Furthermore, I/we agree to obey the class and facility rules and take full responsibility for my/our behavior in addition to any damage I/we may cause to the facilities utilized by Dehner Elite Arts.

I understand that Dehner Elite Arts is a licensed, accredited and insured organization. In the event that I/we should observe any unsafe conduct or conditions before, during or after my/our classes, I/we agree to report the unsafe conduct or conditions to Annaliese Dehner, owner, the administrator, instructors or staff members as soon as possible.
PHOTOGRAPHY/ VIDEO – I give permission for my son/daughter’s photographs/videos to be used for publicity and advertising in the studio, on the DEA website, and in the community.

DEA’s tuition is a 10 month installment plan program that consists of 36 weekly class sessions that begin August 1st and run through the end of May. Tuition is the same fixed amount every month based on the program you register for. Summer classes (June and July) are separate and not included in the 10 month agreement unless you are in the engineers competitive program. Tuition is always due on the first of every month. After the 8th of each month, there will be a $15 late fee. The late fee should be added on to your tuition when making your payment. If your child comes to class and tuition has not been paid, they must sit out for the class until tuition is paid.

DEA is not responsible for holding makeup classes for missed time because of unforeseen circumstances, but we will try our best to make up for that time.
