In consideration of being permitted to participate in any way in the classes, programs, rehearsals, performances and all other activities (dance events and activities) at or offered by Julie's School of Dance, LLC, its members, officers, agents, employees and, instructors ("Releasees") be it online and/or in person and/or being permitted to enter, for any purpose, the studio located at 07309 County Road F, Bryan, Ohio, the Participant and the parent(s) and/or legal guardian(s) of the minor Participant named below agree as follows:
1. I/WE fully understand and acknowledge that:
a) There are risks and dangers associated with participation in dance events and activities which could result in illness or disease, bodily injury, partial and/or total disability, paralysis and death.
b) The losses and/or damage, which could result from these risks and dangers described above, could be severe.
c) These risks and dangers may be caused by the action, inaction or negligence of the Participant or the action, inaction or negligence of others, including, but not limited to,
the Releasees.
d) There may be other risks not known to us or that are not reasonably foreseeable at this time.
2. I/WE accept and assume such risks and responsibility for the losses and/or damages following such illness or disease, injury, disability, paralysis or death, however caused.
3. I/WE represent that the Participant is not currently suffering from any physical or mental ailment that would put him/her at a heightened risk of danger and/or injury.
4. I/WE authorize Julie's School of Dance, LLC to record and photograph Participant's image and/or voice for use by Julie's School of Dance, LLC or its assignees in education or promotional programs. I understand that these images may be edited, duplicated and/or reformatted in any form and manner without payment of fees, in perpetuity.
5. I/WE do hereby waive, release, and forever discharge Julie's School of Dance, LLC, and its members, officers, agents, employees, instructors ("Releasees") from any and all responsibilities or liability for illness or disease, injury, or damages resulting from Participant's participation in any dance events and activities
6. I/WE agree to indemnify the Releasees from any loss, claim, damage, suit, costs, or expenses, including attorney's fees and court costs, resulting from or arising out of any injury to Participant and/or any person or damage to any property, caused by the participation of Participant in any dance events and activities.
7. I/WE expressly agree that this release, waiver and indemnity agreement is intended to be as broad and inclusive as permitted by the laws of the State of Ohio, and that if any portion of this agreement is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
8. I/WE hereby assume all the risks associated with the sport of dance, and I agree to release Julie's School of Dance, LLC and its employees or agents from all liability/responsibility which may arise in connection with my child's participation in classes and activities at Julie's School of Dance and/or through participation in online classes of any type, including but not limited to: Zoom classes, YouTube classes, Facebook videos, and Facetime.
9. In consideration of being permitted to participate in dance classes through Julie's School of Dance, I agree to assume full responsibility for any risks, illnesses or diseases, injuries or damages, known or unknown, which might incur as a result of participating in the studio classes and/or at home in online classes of any type including but not limited to: Zoom classes, YouTube classes, Facebook videos, Facetime, and other video contact.
10. I/WE further authorize Julie's School of Dance, LLC and its employees to seek medical attention for Participant, if in the judgment of Julie's School or Dance, LLC and/or its owner, member, employee or agent, it should be necessary. In the event Participant should require medical attention and/or treatment during the course of any Activities and, after a reasonable attempt, a parent or guardian cannot be contacted for the purpose of consenting to such treatment in a timely manner where Participant is a minor, I/WE hereby give permission to any hospital, physician, and/or appropriate health care provider selected by the staff members to undertake any form of medical treatment considered necessary or appropriate by such provider in such event.
11. I/WE acknowledge receipt of and represent that I/WE have read the Rules of Julie's School of Dance, LLC and understand and agree to comply and be bound to all terms contained therein and as may hereafter be amended or modified from time to time.
I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY.
If enrolling a minor child, I warrant that I have the requisite authority to enroll the minor child(ren) in classes or other activities with Julie's School of Dance, LLC. If another parent has not signed below, I hereby agree to indemnify Julie's School of Dance, LLC as well as all owners, agents and employees from any loss, claim, damage, suit, costs, or expenses, including attorney's fees and court costs, resulting from or arising out of any injury to the minor child(ren), caused by the participation in any dance events and activities which may be brought by the parent who has not executed this Release and Waiver.
