I have read and understand the Vision Athletics Rules, regulations and agreements. I know that Vision Athletics is not responsible for any injuries while on premises. I understand that I should not bring my child if they have had a fever within 24 hours and have the option to makeup classes with a scheduled private lesson if I feel necessary. I agree to bring my athlete dressed properly and ready for class each week.

Participant Waiver, Release of Liability, and Program Policies

Participant Waiver and Release
Voluntary Participation
I voluntarily choose to participate, or authorize the minor named to participate, in athletic, recreational, educational, ministry, travel, and related activities offered or sponsored by Vision Athletics Ministry ("VAM").

These activities may include practices, competitions, clinics, conditioning, strength training, drills, community service, ministry activities, and the use of athletic facilities or equipment ("Activities").

I understand that participation is optional. I confirm that I have had an opportunity to ask questions about the Activities and this agreement before signing.

3. Acknowledgment of Risks
I understand that athletic and recreational activities involve inherent and other risks that cannot be completely eliminated, even when reasonable safety precautions are used. These risks may include:

Physical injury, including cuts, bruises, sprains, strains, fractures, joint or spinal injuries, dental injuries, concussions, heat illness, cardiac events, paralysis, and death.
Contact and environmental hazards, including collisions with people or objects, falls, uneven surfaces, weather, defective or improperly used equipment, and acts or omissions of other participants.
Communicable illnesses, including exposure through close contact, shared equipment, or group activities.
Limited emergency response, including delays in receiving emergency care or circumstances in which medical personnel are not immediately available.
Property loss or damage, including loss, theft, or damage involving clothing, equipment, electronics, or other personal belongings.
I understand that this list is not exhaustive and that unknown or unexpected risks may arise.

4. Assumption of Risk
To the fullest extent permitted by law, I knowingly and voluntarily accept and assume the inherent and ordinary risks associated with participation in the Activities, whether those risks are known or unknown, foreseeable or unforeseeable.

I understand that no coach, volunteer, employee, or representative of VAM can guarantee the participant's safety or prevent every injury or loss.

5. Health and Fitness Certification
I certify that the participant is physically and medically able to participate, except for conditions disclosed below. I agree to provide accurate information concerning allergies, medications, medical conditions, disabilities, dietary restrictions, and emergency needs.

I understand that VAM may require medical clearance before allowing participation. I agree that the participant will immediately report any injury, illness, concussion symptoms, or unsafe condition to a coach or authorized representative.


6. Emergency Medical Authorization
If I cannot be reached during an emergency, I authorize VAM and its representatives to:

Provide reasonable first aid;
Contact emergency medical services;
Arrange transportation to a medical facility; and
Share relevant medical and emergency-contact information with healthcare professionals.
I understand that VAM personnel may not be licensed healthcare providers. I accept financial responsibility for medical evaluation, ambulance transportation, treatment, medication, hospitalization, and related expenses, except where responsibility cannot legally be assigned to me.

This authorization does not require VAM to provide medical treatment or guarantee the availability of medical personnel.

7. Release and Waiver of Liability
To the fullest extent permitted by applicable law, I release and discharge Vision Athletics Ministry, together with its governing body, affiliated organizations, property owners, facility operators, sponsors, directors, officers, employees, coaches, trainers, contractors, volunteers, agents, and representatives (collectively, the "Released Parties"), from claims arising from the inherent and ordinary risks of the Activities, including claims for personal injury, illness, death, property damage, or property loss.

This release is intended to include claims based on the ordinary negligence of a Released Party only to the extent such claims may legally be released. It does not release conduct that applicable law prohibits from being waived, including gross negligence, reckless or intentional misconduct, or other nonwaivable liability.

8. Covenant Not to Sue
To the fullest extent permitted by law, I agree not to bring a legal claim against a Released Party for a matter validly covered by this agreement.

Nothing in this provision limits any right that cannot lawfully be waived or prevents the reporting of suspected abuse, criminal conduct, or a safety concern to law enforcement, child-protection authorities, a governing body, or another appropriate agency.

9. Financial Responsibility and Indemnification
To the fullest extent permitted by applicable law, I accept responsibility for loss, damage, or injury caused by my own intentional misconduct or violation of VAM's written safety rules.

I agree to indemnify and hold the Released Parties harmless from third-party claims resulting directly from my intentional misconduct or unlawful acts. This provision does not require me to indemnify a Released Party for that party's gross negligence, reckless conduct, intentional misconduct, or other liability that cannot legally be shifted.

For a minor participant, this provision applies only to the extent parental indemnification is enforceable under applicable law.


11. Photo, Video, and Media Permission

I grant permission for VAM to photograph, record, and use the participant's image, voice, first name, team affiliation, and athletic accomplishments for nonprofit ministry communications, program promotion, social media, websites, printed materials, fundraising, and historical records without compensation.
I grant limited permission for internal team or family communications only.

VAM will not intentionally publish sensitive medical information, a minor's home address, personal phone number, or other confidential identifying information. Declining promotional media permission will not affect eligibility to participate.

12. Personal Property
I understand that VAM is not responsible for personal belongings that are lost, stolen, left unattended, or damaged, except to the extent liability cannot legally be disclaimed. Participants should label equipment and avoid bringing unnecessary valuables.

13. Compliance With Program Policies
I have received or had access to the policies below. I agree that the participant and responsible parent or guardian will comply with them.

I understand that serious or repeated violations may result in restricted participation, suspension, dismissal, or referral to appropriate authorities. A participant may be removed immediately when reasonably necessary to protect safety or welfare.

14. Governing Law, Severability, and Entire Agreement
This agreement will be governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.

If a provision is found invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law. This document, together with any incorporated registration and medical forms, constitutes the agreement concerning the subjects it addresses. Any amendment must be in writing.

15. Acknowledgment
By signing, I confirm that:

I have read and understood this agreement and the attached policies.
I understand its legal effect, including that I may be giving up certain legal rights.
I have provided accurate information and had an opportunity to ask questions.
I am signing voluntarily and without improper pressure.
I am the participant or have legal authority to sign for the minor participant.
Vision Athletics Ministry Program Policies
16. Mission and Christian Character
Vision Athletics Ministry uses athletics to support physical development, teamwork, discipline, leadership, service, and Christian discipleship. Activities may include prayer, Bible teaching, worship, testimony, and faith-based discussion.

Participants must treat people of every background with dignity. Participation in religious discussion should not involve coercion, humiliation, or retaliation. Any participation requirements connected to the ministry's religious identity should be clearly disclosed during registration and applied consistently with applicable law.

17. Code of Conduct
Participants, parents, guardians, spectators, coaches, staff, and volunteers must:

Demonstrate sportsmanship toward teammates, opponents, officials, coaches, and spectators.
Follow reasonable instructions from coaches and authorized leaders.
Use respectful language and avoid threatening, degrading, obscene, or discriminatory conduct.
Compete honestly without cheating, fighting, deliberate injury, or retaliation.
Respect facilities and property belonging to VAM, host organizations, and other people.
Resolve conflict constructively and report serious concerns to an authorized leader.
Avoid disruptive sideline conduct, including abusive comments toward officials or athletes.
Maintain appropriate boundaries in person and through electronic communication.
18. Prohibited Conduct
The following conduct is prohibited at VAM activities:

Bullying, hazing, harassment, stalking, abuse, or retaliation in person or online.
Sexual misconduct, sexual harassment, grooming behavior, or inappropriate contact.
Possession or use of alcohol, illegal drugs, unauthorized controlled substances, tobacco, vaping products, or performance-enhancing drugs.
Weapons, except where expressly authorized by law and a written VAM safety policy.
Fighting, threats, deliberate dangerous conduct, theft, vandalism, or criminal activity.
Discrimination or targeted harassment based on a legally protected characteristic.
Recording in private areas, including restrooms, sleeping areas, or medical-treatment spaces.
Unauthorized sharing of private information, images, or recordings involving another participant.
Suspected abuse or criminal conduct may be reported to law enforcement or child-protection authorities as required or permitted by law.

19. Participant Safety
Participants must:

Use required protective equipment and wear suitable clothing and footwear.
Follow facility rules, weather precautions, and equipment instructions.
Avoid participating while impaired or when an injury or illness makes participation unsafe.
Report injuries, concussion symptoms, damaged equipment, threats, and unsafe conditions promptly.
Remain within authorized areas and follow supervision, check-in, and release procedures.
Refrain from sharing prescription medication or using medication contrary to medical instructions.
VAM may modify or cancel an activity because of severe weather, unsafe conditions, facility problems, illness outbreaks, or other circumstances affecting safety.

20. Concussion and Return-to-Play Policy
A participant suspected of sustaining a concussion must be removed from athletic activity and may not return the same day unless applicable law and a qualified healthcare professional expressly permit it.

Possible signs or symptoms include headache, dizziness, confusion, balance problems, nausea, unusual behavior, memory difficulty, vision changes, or loss of consciousness.

Return to play may require written clearance from an appropriately licensed healthcare professional and must follow applicable state law and league rules. When in doubt, the participant should not return to play.

21. Illness and Communicable Disease
A participant should not attend when experiencing symptoms that could create a significant risk to others, including fever, repeated vomiting, uncontrolled diarrhea, or a diagnosed contagious condition requiring exclusion.

VAM may require a participant to leave, follow public-health guidance, or provide medical clearance before returning. Health information will be shared only as reasonably necessary for safety, treatment, administration, or legal compliance.

22. Child Protection and Adult-Minor Boundaries
VAM will use reasonable child-safety practices and comply with applicable background-check and mandatory-reporting laws.

Adults working with minors must:

Avoid isolated one-on-one situations when reasonable alternatives are available.
Use observable and interruptible settings for meetings and instruction.
Use approved communication channels and include a parent, guardian, or another authorized adult when required.
Avoid secret communications, favoritism, grooming behavior, or inappropriate gifts.
Refrain from sexual, romantic, degrading, or exploitative communication or conduct.
Respect privacy in locker rooms, restrooms, changing areas, and overnight accommodations.
Report suspected abuse or policy violations promptly through VAM's reporting process and to authorities when legally required.
A ministry representative must never promise confidentiality when a report may involve abuse, danger, or a legal reporting obligation.

23. Digital Communication and Social Media
Program-related electronic communication should be professional, transparent, and limited to legitimate ministry or team purposes.

Participants and adults must not:

Cyberbully, threaten, harass, or impersonate another person.
Post humiliating or private material involving a participant.
Share locker-room, restroom, medical, or changing-area content.
Use disappearing or secret messaging to evade safeguarding requirements.
Publish confidential rosters, addresses, medical details, or travel information without authorization.
VAM may preserve relevant communications when reviewing a safety or misconduct report.

24. Attendance, Supervision, and Release
Participants should arrive on time and be picked up promptly. A parent or guardian must inform VAM of absences, transportation changes, or changes to authorized pickup persons.

Minor participants will be released only under the applicable pickup procedure. VAM may charge a reasonable late-pickup fee if disclosed in advance, but no child will be left unsupervised because of an unpaid fee.

25. Discipline
Responses to misconduct may include:

Verbal redirection or a safety warning;
Parent or guardian notification;
Temporary restriction from a drill, practice, competition, or event;
A behavior or safety plan;
Suspension or dismissal from the program; or
Referral to facility management, a governing organization, child-protection authorities, or law enforcement.
VAM may bypass progressive steps when conduct creates an immediate danger, involves suspected abuse, or seriously disrupts the program. Discipline should be documented, proportionate, and applied consistently.

26. Complaints and Incident Reporting
Safety concerns, suspected misconduct, injuries, bullying, harassment, financial concerns, or policy violations should be reported promptly to Mrs.Jenny.
Reports may be made by a participant, parent, guardian, staff member, volunteer, or witness. VAM prohibits retaliation against a person who makes a good-faith report or participates in an investigation.

This internal process does not replace emergency services, law enforcement, child-protection agencies, medical care, or any legally required report.

27. Registration Fees, Cancellations, and Refunds
Registration fees support staffing, equipment, uniforms, facilities, insurance, expenses, and administration.

Unless a program-specific written policy states otherwise:

Before the published registration deadline: Refunds may be issued less nonrefundable processing fees and documented costs already incurred.
After the program begins: Refunds may be prorated only when withdrawal results from a documented medical condition, relocation, or another circumstance approved by VAM.
Dismissal for misconduct: Fees are generally nonrefundable, except where applicable law requires otherwise.
VAM cancellation: If VAM permanently cancels a program, participants will receive a refund or credit for the unprovided portion, less nonrecoverable costs when permitted by law.
Weather or schedule changes: Ordinary postponements, venue changes, or rescheduled events do not automatically create a right to a refund.
The final refund terms, deadlines, nonrefundable amounts, and request process should be published before payment is collected.

28. Privacy and Records
VAM may collect registration, contact, payment, attendance, medical-alert, incident, and consent information for legitimate program administration and safety purposes.

Records will be shared only with people who reasonably need them, service providers operating under appropriate restrictions, or authorities when required or permitted by law. Records should be stored securely and retained according to VAM's record-retention policy and applicable legal requirements.

29. Policy Changes
VAM may make reasonable policy changes to address safety, legal requirements, league rules, facility requirements, or program operations. Material changes will be communicated to participants or parents and guardians. A new signature should be obtained when a change materially affects consent, legal rights, medical authorization, or media permission.

I hereby grant the Vision Athletics Ministry permission to use my photograph, video, or other digital media (“photo”) in any and all of its publications, including web-based publications, without payment or other consideration.

I understand and agree that all photos will become the property of the Vision Athletics Ministry and will not be returned.

I hereby irrevocably authorize the Vision Athletics to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose. In addition, I waive any right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photo.

I hereby hold harmless, release, and forever discharge the Vision Athletics Ministries from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.

I HAVE READ AND UNDERSTAND THE ABOVE PHOTO RELEASE. I AFFIRM THAT I AM AT LEAST 18 YEARS OF AGE, OR, IF I AM UNDER 18 YEARS OF AGE, I HAVE OBTAINED THE REQUIRED CONSENT OF MY PARENTS/GUARDIANS AS EVIDENCED BY CHECKING BELOW I ACCEPT:

There is a $40 non-refundable registration fee per student, due upon enrollment for the School Year. There is no registration fee for and summer session/workshops. Tuition is due on the 1st of each month and is non-refundable and non-transferable. Dance shoes are available for purchase in the lobby from StarStruck. There will be a recital fee of $40 per family due in February for athletes participating in the End-of-Year Recital. An additional costume fee of $80 will be added for dance classes and $100 uniform fee and $60 shoe fee for cheerleaders participating in the recital in November. Payments should primarily be made on the DANCE STUDIO PRO parent portal. You can also pay by check or cash. If paying with check or cash, be sure to get a receipt. Make checks payable to Vision Dance, and be sure to write your child's name in the memo line. There is a $30 fee for returned checks. Tuition that is not paid by the 10th of the month will be subject to a $25 late fee per athlete. All other fees need to be paid as soon as possible. Any additional fees not paid after 30 days will be subject to a $40 late fee.

I understand and agree that in participating in any dance class, workshop, rehearsal or performance, there is a possibility of physical injury and, in rare circumstances, death. I agree to release and hold harmless Vision Dance and Cheer Ministries of NC INC. including its teachers, dancers, staff members, and facilities from any cause of action, claims, or demands now and in the future. I will not hold Vision Dance and Cheer liable for any personal injury or any personal property damage which may occur on the premises before, during or after classes. Furthermore, I understand that I should be aware of my, and/or my child's physical limitations and agree not to exceed them. If I am signing this waiver for my child, I certify that I am the parent or legal guardian and have the right to waive these rights.
