Dance Studio Policies, Procedures and Waiver Agreement For Utah Dance Artists
Utah Dance Artists is a dba of UDA Studios, LLC, (collectively referred to as UDA)

STUDIO COMMUNICATION
Email is UDA's primary source of communication and used to keep Students and their
parent(s)/guardian(s) informed and up to date on regular studio happenings. Please add customerservice@utahdanceartists.com to
Your list of contacts ASAP to ensure you receive important studio information that will be sent via email after registration is complete.
UDA Facebook and Instagram sites are also used to communicate important information to our Student families.

CREDIT CARD ON ACCOUNT
All Student accounts must maintain an active credit card on file. You authorize the credit card on file to
be charged automatically on the first business day of each month for account balances owed. Cards on file
will not be charged if the account balance is paid prior to the first day of the month via cash or check.

FEES DUE UPON REGISTRATION
-Student accounts will be charged the basic level annual membership fee of $45 per student, per year in
order to be enrolled at UDA. This membership fee will be due and automatically paid with Your credit
card on file, each May unless You complete and submit the opt out form by May 13th of each year. The opt
out form is available at: https://forms.gle/RRsPhQgZ9AEyfPPh8.
-First Tuition Payment: Covers the Student's first prorated month of lessons (usually the last half of
August) and the last two weeks of the dance season ending in June. The first tuition installment is
nonrefundable.
-Remaining Monthly Tuition Payments: After the First Tuition Payment is made, You will be responsible
for making monthly tuition payments by the first day of each month. To unenroll in UDA and not be
responsible for the next month's tuition payment You must notify UDA in writing by the 25th day of the
month prior. If notice is not received by UDA on or before the 25th day of the prior month, Your credit
card on file will automatically be charged for the next month's tuition payment. Monthly tuitions
payments are nonrefundable.

ADDITIONAL YEARLY FEES
-Recital /Starry Night Fee: $120 per family charged and due with October monthly tuition. Includes 2
admission tickets and HD files of all UDA end of year recital performances. No refunds given.
-Recital Costume Deposit(s): $45 per recital costume deposit is charged and due with December's
monthly tuition. No refunds given.
-Remaining Recital Costume Balance: After the costume(s) is ordered in December, the remaining
balance for each costume is due and charged with the February monthly tuition payment. No refunds
given.

NON-SUFFICIENT FUNDS (NSF)
Denied credit card payments or NSF returns on paper checks will immediately incur an $20 NSF fee and
shall be considered late.

LATE PAYMENTS
If for some reason payment is not received by the due date, you will receive an emailed notice and a
seven-day grace period prior to being charged a late fee. If the Student's account is not brought to a zero
balance within seven days from when the email was sent, a $20 late fee or 5% finance charge (whichever
is greater) will be assessed and the Student's access to the dance class(es) shall be discontinued until the
account balance is paid in full. Accounts that carry a balance 60 days past due will be inactivated and
sent to collections.

ADDITIONAL STUDIO POLICIES
-Studio Withdrawal: To withdraw a Student from a class or enrollment altogether, an email request must be
sent to customerservice@utahdanceartists.com by the 25th day of the month in order for monthly tuition
to not be charged the following month. Tuition refunds will not be given after tuition is paid. Students
may withdraw from classes or from UDA at any time during the dance year, but paid tuition and fees shall
not be refundable. Withdrawal from a performance or competition team may require additional fees as
detailed in the Program Parent/Dancer Contract.
-Late Pick-up Fee: If a Student is not picked up within 15 minutes from their last scheduled class time, a
$15 late pick up fee will be assessed followed by an additional $5 for every 5 minutes thereafter.
Privacy and Confidentiality: Each Student's account must list one parent or legal guardian over the age of
18 as the financial responsible party and primary contact for all student communication. UDA will not
release payment history, attendance records or other student information to a third party without
permission from the responsible party.
-Dress Code: In order to attend classes, the Student must be in compliance with the hair and dress code.
The hair and dress code can be found within the parent guide located on the website
Utahdanceartists.com.
-Rescheduling, Modifying and Canceling Classes: UDA reserves the right to reschedule, modify or cancel
dance classes and/or replace the teacher as UDA may deem necessary. UDA also reserves the right to
deliver dance classes through an online platform in the event they cannot be conducted live for any
reason, but not limited to: inclement weather, teacher absence, or state or federal regulations and/or
advisories.

ACCIDENT AND LIABILITY RELEASE
You understand that there are inherent risks in dancing, gymnastics, stretching and related physical
activities, including the risk of serious physical injury. You further understand that these risks may result
from the Student's participation with UDA and You voluntarily assume the risks associated with such
participation. You are fully aware of these risks, and in consideration of Your Student's participation in
UDA classes and activities, You, on behalf of yourself, your heirs, assigns, executor, administrator, and
representatives, hereby release and hold harmless UDA and its owners, managers, employees, instructors
and agents, from any and all liability, loss, damage, costs, claims and/or causes of action arising out of or
relating to Your Student's participation in the UDA classes and activities.
You certify that (i) You are the parent or legal guardian of the Student named below, (ii) there are no
health-related reasons or problems which preclude the Student's participation in the classes/activities, and
(iii) You have not been advised by a qualified medical professional that Your Student should not
participate in the classes/activities. This agreement is governed by the laws of the state of Utah and shall
be construed broadly to provide a release and waiver to the maximum extent permissible under applicable
law. If any provision of this agreement is found to be unenforceable, the remaining terms shall be
enforceable.

MEDICAL RELEASE
You hereby give permission for Your Student to receive medical attention at the UDA facility under the
direction of professional medical personnel, or at any emergency facility, in the event that an accident,
sickness or injury may occur at UDA, until the time You may be contacted and provide further instruction
to the medical representative. Furthermore, You agree to carry Your own medical/accident insurance for
the enrolled Student and fully accept responsibility of payment for any or all medical services provided.

MEDIA AND TEXT RELEASE
You hereby grant permission to UDA and its agents to record Your Student's likeness and voice on video,
audio, photographic, digital, electronic, online format, or other media platforms for the use of UDA
advertising or marketing. You understand that neither You nor Your Student will be compensated for
UDA's use of Your Student's likeness.

By submitting this agreement, You authorize UDA, and its representatives to call or send SMS texts to the
number You provide to UDA regarding studio information, class cancellations, and UDA advertising and
promotional communications.

You certify that You are the parent or legal guardian of the Student named below. By printing Your name
below and submitting this agreement, You certify that You have read this binding agreement, fully
understand its contents, and hereby agree to all its terms, conditions and policies as provided for above.

You agree to all the above terms, conditions and policies provided for above.

-THIS ONLY APPLIES TO UDA CREATIVE ARTS PRESCHOOL STUDENTS-

All accounts must submit a valid credit card at registration. Account holders are responsible for providing up to date credit card information prior to all payment due dates (i.e. expiration dates, account changes, etc).

Upon completing your registration, it is understood that you will complete the nine month 2025-2026 Preschool year. If you choose to withdraw at any time, you will need to email the office by the 20th of any given month. At that time your child will be removed from class. If you withdraw your child after registering, the withdrawal fee will be $200. Your account will be charged the withdrawal fee on the day you withdraw.

Registration Fee of $50 and half of the material fees are due at registration. These two fees will hold your spot and they are NON-REFUNDABLE. The remaining balance of your Material Fees is due on August 1, 2025. We will charge your credit card on file for this fee on August 1st. If you would like to pay with cash/check this will need to be turned into the office before July 31, 2025.

I understand I will pay a LATE FEE the following month if I do not provide updated credit card information prior to the due date, or if I do not notify UDA of a lost or stolen card prior to the due date.

A late fee of $15 or 5% (whichever is greater) will be assessed on overdue balances. Accounts with an overdue balance 2 consecutive months will be moved to a prepay status and required to pay all fees 60 days in advance for the remainder of the session.

Credit cards will be processed for monthly tuition on the 1st working day of each month.

In addition to my Monthly Tuition, I understand I will be billed the first week in August for the remaining balance of my Material Fees and August tuition. I understand that registering for after preschool classes will add additional charges to my account.

RELEASE OF LIABILITY
By clicking the button below, the individual (“Student”) (or if the Student is a minor, the individual identified as the legal guardian or parent of the Student who is over the age of eighteen (18) (“Parent”)), in each case as identified on the registration form submitted to Utah Dance Artists (the “Company”), hereby accepts and agrees to the terms of this release (“Release”). The Student desires to participate in dance lessons, classes, competitions, other dance activities and any other activities (collectively, the “Activity”) provided by the Company or conducted at the Company’s premises. In consideration of being permitted by the Company to participate in the Activity, the Student and the Parent, if any, on behalf of themselves and the Student (collectively, herein referred to as “I”) voluntarily and freely agrees to all the terms and conditions in this Release.
I hereby consent to receive medical or first-aid treatment deemed necessary if I am injured or require medical attention during or in connection with participation in the Activity. I understand and agree that I am solely responsible for all costs related to such medical treatment. I hereby release, forever discharge, and hold harmless the Company from any claim based on such treatment or medical services.
I am aware and understand the contagious nature of Coronavirus/COVID-19 and that many other public health authorities recommend practicing social distancing. While the Company may use preventative measures to reduce the spread of Coronavirus/COVID-19, the Company cannot guarantee that I will not become infected with Coronavirus/COVID-19 during or in connection with my participation in the Activity. Additionally, I am aware and understand that the risk of becoming exposed to and/or infected by Coronavirus/COVID-19 may result from the actions, omissions or negligence of myself and others, including but not limited, to the Company and its employees.
I AM AWARE AND UNDERSTAND THAT THE ACTIVITY, IS A PHYSICAL ACTIVITY THAT IS POTENTIALLY DANGEROUS AND INVOLVES THE RISK OF PERSONAL, BODILY OR PSYCHOLOGICAL INJURY, ILLNESS, PAIN, SUFFERING, TEMPORARY OR PERMANENT DISABILITY, DEATH, PROPERTY DAMAGE, AND/OR FINANCIAL LOSS. I ACKNOWLEDGE THAT ANY SUCH INJURIES THAT I SUSTAIN MAY RESULT FROM OR BE COMPOUNDED BY THE ACTIONS, OMISSIONS, OR NEGLIGENCE OF THE COMPANY, INCLUDING NEGLIGENT EMERGENCY RESPONSE OR RESCUE OPERATIONS OF THE COMPANY. NOTWITHSTANDING THE RISK, I ACKNOWLEDGE THAT I AM KNOWINGLY AND VOLUNTARILY PARTICIPATING IN THE ACTIVITY WITH AN EXPRESS UNDERSTANDING OF THE DANGER INVOLVED AND HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF PERSONAL, BODILY OR PSYCHOLOGICAL INJURY, ILLNESS, DISABILITY, DEATH, PROPERTY DAMAGE AND/OR FINANCIAL LOSS ARISING FROM MY PARTICIPATION IN THE ACTIVITY, WHETHER CAUSED BY THE ORDINARY NEGLIGENCE OF THE COMPANY OR OTHERWISE.
I hereby expressly waive and release any and all claims, now known or hereafter known, against the Company, and its officers, directors, managers, employees, agents, affiliates, successors and assigns (collectively, “Releasees”), arising out of or attributable to my participation in the Activity, whether arising out of the ordinary negligence of the Company or any Releasees or otherwise. I will not make or bring any such claim against the Company or any other Releasee, and forever release and discharge the Company and all other Releasees from liability under such claims. I will defend, indemnify, and hold harmless the Releasees against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind (including but not limited to, costs associated with reasonable attorney fees, enforcing any right to indemnification under this Release, and pursuing any insurance providers) related to my participation in the Activity, including any claim related to my own negligence or the ordinary negligence of the Releasees.
This Release constitutes the sole and entire agreement between myself and the Company with respect to the subject matter contained herein and supersedes all prior and contemporaneous agreements. If any term or provision of this Release is found to be invalid, illegal, or unenforceable, such invalidity, illegality, or unenforceability will not affect any other term or provision of this Release. This Release is binding on and will inure to the benefit of all parties and each party’s respective heirs, successors, and assigns. All matters arising out of or relating to this Release will be governed by the laws of the State of Delaware. Any claim or cause of action arising under this Release may be brought only in the federal and state courts located in Wilmington, Delaware and I hereby consent to the exclusive jurisdiction of such courts.


☐ BY CLICKING HERE, I ACKNOWLEDGE THAT EITHER (A) I AM A STUDENT WHO IS THE AGE OF EIGHTEEN (18) OR OLDER, AND (I) I HAVE THE LEGAL RIGHT TO CONSENT TO THE TERMS AND CONDITIONS OF THIS RELEASE ON BEHALF OF MYSELF, (II) I HAVE READ AND UNDERSTOOD ALL OF THE TERMS OF THIS RELEASE AND (III) I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE COMPANY OR (B) I AM THE PARENT OR LEGAL GUARDIAN OF THE APPLICABLE STUDENT WHO IS UNDER THE AGE OF EIGHTEEN (18), AND (I) I HAVE THE LEGAL RIGHT TO CONSENT TO THE TERMS AND CONDITIONS OF THIS RELEASE ON BEHALF OF MYSELF AND THE STUDENT, (II) I HAVE READ AND UNDERSTOOD ALL OF THE TERMS OF THIS RELEASE AND (III) I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE COMPANY ON BEHALF OF MYSELF AND THE STUDENT.
