Diamond Dance Studio Waiver, Release of Liability & Studio Policies
By registering my child(ren) for classes, camps, clinics, competitions, performances, or any other activities offered by Diamond Dance Studio, I acknowledge that I have read, understand, and agree to the following policies and terms.
Payment Policies
I understand that tuition is posted and due on the **1st of each month**, and the payment method on file will be automatically processed on the **15th of the month**.
I may pay my balance before the 15th by cash, check, or the payment method on file.
If my payment is declined, a **$40 late fee** will be added to my account. If my account remains unpaid **7 days after the due date**, Diamond Dance Studio is authorized to charge the payment method on file. If payment continues to be unsuccessful, the studio may continue attempting payment on a weekly basis until the balance is paid in full.
Tuition reserves my child's place in class and is **not based on attendance**. Tuition is not transferable to another month or another student, and refunds or credits will not be issued for missed classes.
I understand that tuition covers much more than instructional time. Tuition supports instructor preparation, lesson planning, choreography, music editing, curriculum development, administrative work, facility expenses, and other operational costs necessary to provide high-quality dance instruction.
Monthly tuition remains the same regardless of the number of classes scheduled in a particular month. Months with fewer than four classes due to the calendar do not receive prorated tuition.
Diamond Dance Studio reserves the right to cancel classes due to weather, facility issues, instructor illness, or other unforeseen circumstances. Makeup classes may be offered at the studio's discretion but are not guaranteed. Tuition will not be refunded or credited for these closures.
I authorize Diamond Dance Studio to charge my payment method on file for tuition, registration fees, recital fees, competition fees, costumes, merchandise, late fees, and any other studio-related charges authorized under my account or incurred through my purchases.
If an account becomes seriously delinquent, Diamond Dance Studio reserves the right to suspend participation, withhold costumes, competition entries, recital participation, awards, or other studio services until the account is brought current. Unpaid accounts may be referred for collections, and the account holder agrees to be responsible for any collection costs, court costs, or attorney fees permitted by law.
Any returned checks will be subject to a returned check fee.
Withdrawal Policy
Withdrawal from classes must be submitted in writing before the first day of the month in order to stop future tuition charges. Failure to attend class does not constitute withdrawal. Tuition is not prorated for partial months.
Attendance
Regular attendance is important to each student's progress. Tuition will not be refunded or credited for missed classes. Makeup classes may be offered when appropriate at the studio's discretion but are not guaranteed.
Dress Code & Behavior
Students are expected to follow the Diamond Dance Studio dress code and wear appropriate dance attire and footwear. Students not dressed appropriately may be asked to observe class rather than participate if safety is a concern.
Diamond Dance Studio reserves the right to dismiss any student or family whose behavior is disruptive, abusive, threatening, or repeatedly violates studio policies. No refunds will be issued in these situations.
Illness
Students who are ill or experiencing fever, vomiting, diarrhea, or other contagious symptoms should remain home until they are symptom-free according to current public health recommendations.
Personal Property
Diamond Dance Studio is not responsible for lost, stolen, or damaged personal property brought to the studio or any off-site event.
Photo & Video Release
I grant Diamond Dance Studio permission to photograph or record my child during classes, rehearsals, performances, competitions, camps, clinics, and other studio activities. I understand these images or videos may be used in advertising, promotional materials, printed publications, the studio website, social media, or other marketing materials without compensation.
Communication
I consent to receiving studio communications through email, text message, Studio Pro, Band, or any other communication platform used by Diamond Dance Studio.
Assumption of Risk & Release of Liability
I understand that participation in dance, tumbling, acrobatics, conditioning, performances, competitions, camps, clinics, and other related activities involves inherent risks. These risks include, but are not limited to, falls, slips, collisions, overuse injuries, equipment-related injuries, strains, sprains, fractures, head injuries, permanent disability, illness, or death.
I understand these risks may arise from my child's own actions, the actions of others, the condition of the facilities or equipment, or the negligence of Diamond Dance Studio, its owners, employees, instructors, volunteers, independent contractors, or participants.
I knowingly and voluntarily assume all risks associated with participation.
To the fullest extent permitted by law, I release, waive, discharge, and hold harmless Diamond Dance Studio, its owners, employees, instructors, volunteers, independent contractors, and agents from any and all claims, demands, damages, actions, causes of action, liabilities, or expenses arising out of or related to participation in any Diamond Dance Studio activity, including those resulting from ordinary negligence.
This release applies to all activities held at the studio or any off-site location, including competitions, performances, conventions, workshops, camps, clinics, community events, and travel associated with studio activities.
Medical Authorization
I certify that my child is physically able to safely participate in dance activities. I agree to inform Diamond Dance Studio of any medical conditions, allergies, injuries, medications, or other health concerns that may affect participation.
In the event of an emergency, I authorize Diamond Dance Studio staff to obtain emergency medical treatment for my child if I cannot be reached. This authorization includes first aid, CPR, AED use, emergency transportation, and the sharing of necessary medical information with emergency medical personnel. I understand that I am solely responsible for all medical expenses incurred.
General Release
If my child is a minor, I certify that I am the child's parent or legal guardian and have the legal authority to execute this agreement on their behalf.
I understand that this agreement is intended to be as broad and inclusive as permitted by the laws of the State of Minnesota. If any portion of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Diamond Dance Studio reserves the right to modify policies, tuition, fees, schedules, and procedures as necessary. Updated policies will be communicated to enrolled families.
Diamond Dance Studio shall not be responsible for interruptions or cancellations resulting from circumstances beyond its reasonable control, including but not limited to severe weather, natural disasters, public health emergencies, utility failures, government orders, or other unforeseen events.
I certify that I have carefully read this Waiver, Release of Liability, and Studio Policies, fully understand its contents, and voluntarily agree to all terms and conditions contained herein.
