As a member of Impact Studio, LLC you are expected to conduct yourself in a manner befitting to an Impact Studio, LLC student. You, as a student not only represent yourself and your family, but also Impact Studio, LLC. - Athletes and Parents will show respect to other athletes, coaches and other parents. – Bullying will not be allowed or tolerated at Impact Studio, LLC. (Bullying is the use of force, threat or coercion to abuse, intimidate, or aggressively dominate others). – Racial bigotry, religious bigotry, and sexist comments are strictly prohibited by athletes, parents and coaches at Impact Studio, LLC. As well as at any event. – Activities at Impact Studio, LLC are co-ed. Most practices and performances will have both male and female athletes. Any lewd comments or actions are strictly prohibited. – Athletes are expected to be on time, follow facility rules, report injuries immediately, report any skin or eye issues BEFORE practice, refrain from vulgar and inappropriate language, and be. Positive role model for the younger athletes. Any violation of Impact Studio, LLC Code of Conduct may result in suspension or removal from our program. Final decisions will be made by the Impact Studio, LLC coaching staff and the board of directors

In consideration of my minor child (my child) being allowed to participate in this Summer Tumbling, Cheer, Acro, Dance, and Training Session and its related events and activities, I, the undersigned, acknowledge, appreciate, and agree that: 1. The risk of serious injury from tumbling, cheer, acro, dance and training is always present due to the nature of the sport., which presents risks that cannot be eliminated, regardless of the care taken to avoid injuries and illness. I understand that my/my child’s participation in Impact Studio, LLC practices, activities, camps, and use of the facilities is completely voluntary in all respects and I assume all risks of injury, illness and/or death to my child or others that may result from such use; and 2. I understand that the dangers and risks of practicing tumbling, cheer, acro, dance and training include, but are not limited to, transmittable disease – including Covid-19 and the transmittal thereof, disorders, death, serious neck and spinal injuries which may result in complete or partial paralysis, brain damage, blindness, serious injury virtually to all internal organs, serious injury to virtually all bones, joints, ligaments, muscles, tendons and other aspects of the muscular skeletal system, and serious injury or impairment to other aspects of my/my child’s body, general health and well-being. I understand that the dangers and risks of practicing tumbling, cheer, acro, dance and training may result not only in serious injury, but serious impairment of my/my child’s future abilities to earn a living, to engage in in other business, social or recreational activities and generally enjoy life. THUS FOR MYSELF, SPOUSE, AND CHILD, I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASES or others, and assume full responsibility for my child’s participation; and 3. I have fully informed myself of the most recent national, state and local government orders, warnings and instructions as they pertain to Covid-19, and I have fully informed myself of the risks associated with my child participating in Impact Studio, LLC practices, activities, camps, and use of facilities in light of said orders, warnings and instructions. Having been so informed, FOR MYSELF, SPOUSE, AND CHILD, I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown. EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASES or others, and assume full responsibility for my child’s participation; and 4. I acknowledge and agree that Impact Studio, LLC, its coaches, its agents, and employees are not health care practitioners and that they cannot be expected to diagnose and/or treat individual health problems and/or injuries. I further acknowledge that Impact Studio, LLC, practices, activities, and camps do not have health care practitioners to diagnose and/or treat individual health problems and/or injuries. I understand that the dangers and risks of allowing my child to participate in Impact Studio, LLC, practices, activities, and/or camps without the presence of a health care practitioner include, but are not limited to, failure to recognize a participant with a transmittable disease- including Covid 19, delay in emergency medical treatment, failure to recognize exacerbation of injury and death. THUS, FOR MYSELF, SPOUSE, CHILD, I KNOWINGLY AND FREELY ASSUME ALL RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASES or others, and assume full responsibility for my child’s participation; and 5. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, IDEMNIFY, AND HOLD HARMLESS Impact Studio, LLC limited liability company formed under the laws of the state of Utah, its affiliates, officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of the premises used for activity (“Releases), WITH RESPECT TO ANY AND ALL INJURY, ISABILITY, DEATH, OR LOSS OR DAMAGE TO PERSON OR PROPERTY, regarding my child and/or arising from his/her activities, including the transmission of Covid-19 to any individual, WHETHER ARISING FROM NEGLEGENCE OF THE RELEASES OR OTHERWISE, except for willful misconduct, or otherwise to the fullest extent of the law. This is a complete and irrevocable release and waiver of liability. Specifically and without limitation, I herby release the Released Parties from any liability, claim, or cause of action arising out of the Released Parties’ negligence. I covenant not to sue the Released Parties from any alleged liabilities, claims, or cause of action release hereunder I HAVE READ THE RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND THEIR TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT INDUCEMENT.

In the event that I/My child needs immediate medical attention for injuries received while participating in an Impact Studio, LLC program, I authorize Impact Studio, LLC staff to transport myself or my child to a health care facility for emergency services as needed. 2. If I or my child, requires use of an epi-pen, prescription and/or an over-the-counter medication, it is my responsibility to ensure that the epi-pen and/or medication are on me or my child or within our personal belongings every day of the classes. If Impact Studio, LLC is required to administer and use the epi-pen and/or medication, I agree to forever release and discharge Impact Studio, LLC and it’s coaches, directors, officers, and employees from any and all liability arising out of or resulting from use or administration of the epi-pen and/or medication.

The parents parental support and involvement in Impact Studio, LLC is essential. If your child chooses to commit themselves to Impact Studio, LLC, parental commitment is also necessary. If the student is to make a quality commitment to Impact Studio, the parents need to ensure that the child attends all functions, including practices, meetings, performances, and other events. There will be times when scheduling conflicts cannot be avoided. Impact Studio requires your communication, planning, and understanding so we can minimize conflicts. It is Impact Studio’s responsibility to present a schedule to allow time for your planning. When an athlete or their parents have an unavoidable scheduling conflict, Impact Studio expects timely communication to allow any adjustments needed. In the event, that you choose to drop any class from Impact Studio, LLC before the registered session is over, you will incur a drop fee of $100, per dropped class or the remaining tuition for the session, per dropped class, whichever is less. This applies to each child that is dropping during the session,

Impact Studio, LLC must be paid in full for each session. Tuition is due on the 1st of each month. Monthly tuition will be paid no later than the 15th of every month. If it is not received by this day, it will be automatically deducted from the Auto-Pay account on file, with an additional late fee of $10.00 per child that has a balance owed. Session agreement must be paid through entire length of the session your child is registered for. (You may be released from your agreement, without penalty, in case of a session ending injury or a family move.) You may also buy out of the agreement by paying the drop fee. (In the event, that you choose to drop any class from Impact Studio, LLC before the registered session is over, you will incur a drop fee of $100, per dropped class or the remaining tuition for the session, per dropped class, whichever is less. This applies to each child that is dropping during the session,)

I hereby release all pictures of myself or my child taken by Impact Studio, LLC for promotional purposes and programming materials including Impact Studio, LLC website and social media accounts.
