Student Waiver and Release of Liability

You are responsible for knowing what is contained in this waiver.

1. I have read the items in the current Moore Than Dance Handbook for Parents and Students and will take the responsibility to carefully follow the rules and policies therein.

2. I understand that Moore Than Dance does NOT give credit and/or refunds for class(es) missed due to holiday, vacation, illness, weather, etc.

4. I understand that registration and enrollment payments are considered final sale. Only approved refunds due to unforeseen emergencies, medical leave, illness will be issued by check to the account holder less administrative and processing fees not to exceed $100.

5. I am aware that I must have a credit card on file for auto tuition.

7. I understand that it is my responsibility to stay current on all payments and tuition. Failure to do so will result in the accrual of additional late fees of $20 per week and/or cancellation of enrollment and services.

8. If I decide to drop out of any of my classes, I will give written notice to Moore Than Dance at least 30 days before leaving, or I will lose my next month's tuition payment.

I further understand that there are specific risks of physical or property damages, losses, illness or injury that may result from my or my child's participation with Moore Than Dance, and I voluntarily assume the risks associated with such participation.

In consideration of being allowed to participate in dancing and performing art programs, the undersigned acknowledge, appreciate and agree that:

1. There is a risk of injury from dancing and engaging in performing arts which poses a significant risk of injury or illness including permanent paralysis and in some cases, even death. I am familiar with these activities.

2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation.

3. I willingly agree to comply with the terms and conditions of participation. If I observe any unusual or significant hazards during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately.

4. I, for myself and on my behalf of my heirs, assignees, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY AND HOLD HARMLESS Moore than Dance, LLC, its officers, officials, agents and/or employees, other participants, sponsors, advertisers, and, if applicable, owners and lessors of premises used to conduct the events I am engaged in, from any and all claims, demands, losses, and damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extend permitted by law.

5. I understand that Moore than Dance, LLC, is not obligated to provide me with the activities I wish to engage in. I am a willing participant therein and undertake them knowing the risks of injury, including paralysis and death.

If 18 years or older I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

FOR PARENTS/GUARDIANS OF PARTICIPANT OF MINOR AGE (UNDER 18 AT TIME OF REGISTRATION). This is to certify that I, as parent/guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above of all Releasees, and, for myself, my heirs, assigns, and next of kin. I release and agree to indemnify and hold harmless the Releasees from any and all liability to my minor child's involvement or participation in these programs as provided above. EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES, to the fullest extent permitted by law.


Electronic Signature Agreement. By selecting the "I Accept" checkbox, I am signing this agreement electronically. I agree this electronic signature is the legal equivalent of my manual signature on this agreement.
I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms.

Moore Than Dance Participation Waiver and Acknowledgment of Risk

I acknowledge that I am responsible for reading, understanding, and complying with all information provided in this waiver.

I understand that participation in activities at Moore Than Dance involves certain inherent risks, including, but not limited to, physical or property damage, illness, or injury. I voluntarily assume all risks associated with my participation or that of my child.

In consideration of being allowed to participate in Moore Than Dance classes and activities, I, the undersigned, acknowledge, appreciate, and agree to the following:

Risk of Injury: I recognize that participation in dance and performing arts entails the risk of injury, illness, permanent disability, or even death. I am familiar with the nature of these activities.

Assumption of Risk: I knowingly and freely assume all such risks, whether known or unknown, even those arising from the negligence of the Releasees or others, and I take full responsibility for my participation.

Compliance and Safety: I agree to comply with all terms and conditions of participation. If I observe any unusual or hazardous conditions, I will immediately remove myself from participation and report the issue to a Moore Than Dance staff member.

Release of Liability: I, on behalf of myself, my heirs, assigns, personal representatives, and next of kin, hereby release, indemnify, and hold harmless Moore Than Dance, LLC, its officers, agents, employees, volunteers, other participants, sponsors, advertisers, and, if applicable, the owners and lessors of premises used for the activities, from any and all claims for injury, loss, or damage, whether caused by negligence or otherwise, to the fullest extent permitted by law.

Voluntary Participation: I understand that Moore Than Dance, LLC is not obligated to provide access to these activities. I voluntarily choose to participate, understanding the risks involved. If I am 18 or older, I affirm that I have read this Release of Liability and Assumption of Risk Agreement, fully understand its contents, and sign it freely and voluntarily without inducement.

Handbook Acknowledgment: I have read the current Moore Than Dance Handbook for Parents and Students, available in the Parent Portal under "Files," and agree to follow all rules and policies outlined within.

Missed Classes: I understand that Moore Than Dance does not offer refunds or credits for missed classes due to holidays, vacations, illness, weather, or other absences.

Payment Policy: All registration and enrollment payments are final. Refunds are issued only in approved cases involving emergencies or medical leave, less administrative and processing fees not exceeding $100.

Auto-Pay Policy: I understand that I must keep a credit card on file for automatic tuition payments. If I decline auto-pay, I will provide check or cash payment covering two months’ tuition. If my card is declined, I agree to pay a $20 weekly late fee until payment is resolved.

Tuition Responsibility: I am responsible for keeping my tuition account current. Failure to do so may result in additional late fees of $20 per week and/or cancellation of enrollment and services.

Class Withdrawal: If I choose to withdraw from any class, I will provide written notice at least 30 days before my final class. Without such notice, I understand that I will forfeit the next month’s tuition.

Recital Opt-Out Policy: I will be charged for recital costumes and related fees on November 1 unless I complete the "opt-out" form prior to that date.

Event Fees: I understand that I am responsible for any fees associated with current and future events.

No Refunds for Costumes or Missed Classes: I understand that missed classes and costume purchases are non-refundable.

Credit Card Requirement: I acknowledge that a valid credit card is required for tuition installment payments.

Responsibility for Communication: I am responsible for reviewing all communication sent by Moore Than Dance regarding costumes, classes, recitals, performances, and other relevant matters. These updates will be delivered via email and posted in the Dance Studio Portal.

Media Release: I hereby grant Moore Than Dance permission to use my child’s likeness in photographs, videos, or other digital media (“photos”) in any and all of its publications, including web-based publications, without payment or other consideration.

I understand and agree that all photos will become the property of Moore Than Dance and will not be returned.

I irrevocably authorize Moore Than Dance to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose. I waive any right to inspect or approve the finished product in which my child’s likeness appears. Additionally, I waive any right to royalties or other compensation arising from or related to the use of these photos.

Summer Class Refund Policy: I understand that summer classes are non-refundable.

Performance Tickets: I understand that I am responsible for purchasing tickets for any performances in which my child participates.

For Parents/Guardians of Participants Under 18

As the parent or legal guardian of a minor participant, I consent to the above terms and release of liability on behalf of my child. I agree to indemnify and hold harmless all Releasees from any liability resulting from my child’s participation in Moore Than Dance activities, even if arising from their negligence, to the fullest extent allowed by law.

I hereby grant Moore Than Dance permission to use my childs likeness in a photograph, video, or other digital media (“photo”) in any and all of its publications, including web-based publications, without payment or other consideration.

I understand and agree that all photos will become the property of Moore Than Dance and will not be returned.
