Liability Release: By signing the Enrollment form you agree to release and forever discharge, Courtney’s School of Dance and its staff members from any liabilities growing out of or related to any activities in which I or my child/ren participates in. I understand that this is a full and complete release of all injuries or damages which I or my children may sustain as a result of my/his/her participation in any activities, regardless of the specific cause thereof.

Release and Waiver of Liability and Indemnity Agreement
(Read Carefully Before Signing)
In consideration of being permitted to participate in any way in the Dance Program indicated below and/or being permitted to enter for any purpose any restricted area (here in defined as any area where in admittance to the general public is prohibited), the parent(s) and/or legal guardian(s) of the minor participant named below agree:
1. The parent(s) and/or legal guardian(s) will instruct the minor participant that prior to participating in the below dance activity or event, he or she should inspect the facilities and equipment to be used, and if he or she believes anything is unsafe, the participant should immediately advise the officials of such condition and refuse to participate. I understand and agreed that, if at any time, I feel anything to be UNSAFE, I will immediately take all precautions to avoid the unsafe area and REFUSE TO PARTICIPATE further.
2. I/WE fully understand and acknowledge that:
a. There are risks and dangers associated with participation in Dance events and activities which could result in bodily injury partial and/or total disability, paralysis and death
b. The social and economic losses and/or damages, which could result from these risks and dangers described above, could be severe.
c. These risks and dangers may be caused by the action, inaction or negligence of the participant or the action, inaction or negligence of others, including, but not limited to, the Releasees named below.
d. There may be other risks not known to us or are not reasonably foreseeable at this time.
3. I/WE accept and assume such risks are responsibility for the losses and/or damages following such injury, disability, paralysis or death, however caused and whether caused in whole or in part by the negligence or the Releasees named below.
4. I/WE HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE the dance facility used by the participant, including its owners, managers, promoters, lessees of premises used to conduct the dance event or program, premises and event inspectors, underwriters, consultants, and others who give recommendations, directions, or instructions to engage in risk evaluation or loss control activities regarding the dance facility or events held at such facility and each of them, their directors, officers, agents, employees, all for the purposes herein referred to as “Releasee”…FROM ALL LIABILITY TO THE UNDERSIGNED, my/our personal representatives, assigns, executors, heirs, and next of kin FOR ANY AND ALL CLAIMS, DEMANDS, LOSSES OR DAMANGES AND ANY CLAIMS OR DEMANDS THEREFORE ON ACCOUNT OF ANY INJURY, INCLUDING BUT NOT LIMITED TO THE DEATH OF THE PARTICIPANT OR DAMAGE TO PROPERTY, ARISING OUR OF OR RELATING OT THE EVENT(S) CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE RELEASEE OR OTHERWISE.
5. I/WE HEREBY acknowledge that THE ACTIVITIES OF THE EVENT(S) involve the risk of serious injury and/or death and/or property damage. Each of THE UNDERSIGNED also expressly acknowledges that INJURIES RECEIVED MAY BE COMPOUNDED OR INCREASED BY NEGLIGENT RESCUE OPERATIONS OR PRECEDURES OF THE RELEASEES.
6. EACH OF THE UNDERSIGNED further expressly agrees that the foregoing release, waiver, and indemnity agreement is intended to be as broad and inclusive as is permitted by the law of the Province or State in which the event is conducted and that if any portion is held invalid, it is agreed that the balance shall, notwithstanding continue in full legal force and effect.
7. On behalf of the participant and individually, the undersigned partner(s) and/or legal guardian(s) for the minor participant executes this Waiver and Release. If, despite this release, the participant makes a claim against any of the Releasees, the parent(s) and/or legal guardian(s) will reimburse the Releasee for any money which they have paid to the participant, or on his behalf, and hold them harmless.
I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.


Media Release Form
I hereby irrevocably consent to and authorize the reproduction, publication, and/any other use by Courtney’s School of Dance and grant permission to the rights of my child(s) image willingly. I authorize that said photograph is to be used for legitimate lawful purpose, including illustration, promotion, advertising, web content and television.
Having noted the terms so stated, and for consideration received, I being of legal age of acting as legal guardian do hereby agree to allow Courtney’s School of Dance to use, publish, sell, give title to name, or copyright those still photography, moving pictures or videotape pictures, with or without sound, in which participated, in perpetuity.
By signing this release I understand that this permission signifies that photographic or video recording of me/my child(re) may be electronically displayed via the internet or in public setting.
This release applies to photographic, audio, or video recording collected as art of my classes, rehearsals, or performances for Courtney’s School of Dance.
By signing this form I acknowledge that I have completely read and fully understand the above release. I hereby release any and all claims against any person or organization utilizing this material for educational purposes.



By signing this contract I agree to and understand that if I choose not to abide by any of the above listed guide lines I choose to forfeit my enrollment.

Assumption of Risk, Release and Waiver of Liability

On behalf of myself/ and/ or my children, I understand the following:
Section 1-______________
1. I understand Novel Coronavirus (‘‘COVID-19”) infections have been confirmed throughout the United States, including multiple cases in my area.

2. I understand COVID-19 is an extremely contagious virus that spreads easily, including through person-to-person contact.

3. I understand, as with any social activity, use of Courtney’sSchool of Dance(CSD to be known hence forth) facilities or services, or participation in CSD programs, may present the risk of contracting COVID-19. I further understand CSD takes safety and preventative precautions, and that CSD can in no way warrant that COVID-19 infection will not occur through use of such facilities or services or participation in CSD activities, in-person dance classes and or programs.

4. I understand the known and potential dangers of participating in the programs and/or utilizing the facilities and services of CSD and acknowledge that my use thereof, and/or use by my participating children may, despite CSD’s prudent and reasonable efforts to mitigate such dangers, result in exposure to COVID-19, which could result in quarantine requirements, serious illness, disability, and/or death.

5. I understand that due to the nature of the facilities, services, and programs offered by CSD, social distancing of 6 feet per person among children and or others, and compliance with guidance and recommendations of public health agencies, may not always be possible.

6. I understand that CSD has taken steps to implement certain guidance and recommendations issued by public health agencies for hindering the transmission of COVID-19, including, without limitation, the access/use restrictions set forth throughout the “CSD Assumption of Risk Waiver for In-Person Activities” form.

7. I understand that CSD may revise its procedures at any time based on updated recommended guidance and recommendations issued by public health agencies and that I and my participating children must comply with all CSD procedures prior to participating in, visiting, or utilizing the facilities, services, and/or the programs and/or attending in-person dance classes or in-person CSD events/performances.



Section 2_____________

On behalf of myself and/or my children, I agree to the following:

1. I agree to ensure that I and my participating children will comply with the most recent guidance and recommendations issued by the World Health Organization (WHO), the Centers for Disease Control and Prevention (CDC), state agency and local municipalities for slowing the transmission of COVID-19.

2. I agree that neither I nor my participating children shall visit or utilize the facilities, services, and/or programs of CSD or attend in-person CSD Events and or performances within 14 days after (i) returning from highly-impacted areas subject to a CDC Level 3 Travel Health Notice, (ii) exposure to any person returning from areas subject to a CDC Level 3 Travel Health Notice, (iii) exposure to any person who has a suspected or confirmed case of COVID-19, or (iv) exposure to any other risk identified by the most recent guidelines or recommendations or guidelines situation delineated by WHO, the CDC or my state public health agency or municipality.

3. I agree that neither I nor my participating children shall participate in, visit, or utilize the facilities, services, and/or programs of CSD if I, he, or she (i) experience(s) symptoms of COVID-19, including, without limitation, fever, cough, loss of sense of taste or smell, or shortness of breath, or (ii) has a suspected or diagnosed/confirmed case of COVID-19.

4. I agree to notify CSD immediately if I believe that any of the foregoing access/use restrictions may apply.


Section 3_____________

On behalf of myself and/or my children, I covenant the following:

1. I covenant I, my heirs, assignees, distributees, guardians, next of kin, spouse and legal representatives will not make a claim against, sue, or attach any property of any releasee in connection with any matters covered by this release.

2. I covenant “not to sue” is intended to be as broad and inclusive as is permitted by law, and that if any portion thereof is held invalid, the balance shall, notwithstanding, continue in full legal force and effect.

3. I covenant, to the maximum extent permitted by applicable law, not to elect a trial by jury with respect to any matters covered by this release that may be triable of right by a jury, and (b) waive any right to trial by jury with respect to such matters to the extent that any such right exists now or in the future. This waiver of right to trial by jury is given knowingly and voluntarily. If governing law does not allow the waiver included in this paragraph, then I agree that this paragraph shall be severable from this Agreement.


Section 4_____________


On behalf of myself and/or my children, I hereby irrevocably and unconditionally release, waive, and discharge the following:
Courtney’s School of Dance and any of its affiliates, Courtney Mattheis and any of its affiliates, any other Courtney’s School of Dance, and any of their respective directors, officers, employees, volunteers, and agents (collectively, the “Releasees”), from any and all actions, claims and demands that I, my assignees, heirs, distributees, guardians, next of kin, spouse and/or legal representatives now have or may have in the future, whether known or unknown, foreseen or unforeseen, for injury, death or property damage and expenses of any nature whatsoever, related to (i) my participation or my children’s participation in the programs or travel related thereto, (ii) the negligence or other acts, whether directly connected to these activities or not, and however caused, by any Releasee, or (iii) the condition of the premises.
