Release and Waiver Liability Agreement

In consideration of the Activities provided at Tylene Nichols LCC, d/b/a Centre Stage Dance, its agents, owners, officers, volunteers, participants, employees, and all other persons or entities in any capacity on its behalf (“CSD”), I, on behalf of myself and any minor children named below, hereby accept the terms of this Release and Waiver Liability Agreement (the “Agreement”) and agree to release, indemnify, and discharge CSD on behalf of myself, my spouse, my children, my parents, my heirs, assign, personal and statutory representative and estate as follows:

1. Assumption of Risk: I understand and acknowledge that participation in dance classes, rehearsals, workshops, choreography sessions, performances, and any other related activities (the "Activities") hosted or organized by CSD involves inherent risks. These risks include but are not limited to: physical injuries such as muscle strains, sprains, ligament tears, fractures, joint dislocations, and concussions; physical overexertion, dehydration, cardiovascular stress, and fatigue; injuries resulting from slips, trips, or falls on the dance floor, studio equipment, or common areas; exposure to and contraction of infectious diseases or illnesses. I knowingly, freely, and voluntarily assume all such risks, both known and unknown, associated with my (or my child's) participation in these Activities.

2. Personal Responsibility: I agree to abide by all safety guidelines, rules, and instructions included in this document and/or provided by CSD’s instructors and staff during dance classes and events. I understand that failure to comply with these guidelines may result in my removal from the premises and the forfeiture of any fees paid.

3. Release of Liability: IN CONSIDERATION FOR BEING PERMITTED TO PARTICIPATE IN THE ACTIVITIES AT CSD, I HEREBY RELEASE, WAIVE, AND FOREVER DISCHARGE CSD, ITS OWNERS, INSTRUCTORS, EMPLOYEES, AND AGENTS (THE “RELEASED PARTIES”) FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS, AND CAUSES OF ACTION WHATSOEVER, KNOWN AND UNKNOWN, ARISING OUT OF OR RELATED TO ANY LOSS, DAMAGE, OR INJURY, DEATH, USE OF THE PROPERTY, VIOLATIONS OF ANY GUIDELINES, RULES, AND INSTRUCTIONS OF CSD, WHETHER CAUSED BY CSD OR ANY OF THE RELEASED PARTIES, THAT MAY BE SUSTAINED BY ME, ANY MINOR CHILDREN, OR TO ANY OF MY BELONGINGS, WHILE BEING PRESENT AT CSD OR PARTICIPATING IN ANY OF THE ACTIVITIES AT CSD.

4. Covenant Not To Sue: In consideration of for being permitted to participate in the Activities at CSD, I hereby agree not sue CSD or any of the Released Parties, initiate any legal proceedings against them, including assisting any prosecution, for any claims, petitions, demands, or any other type of legal claim arising directly or indirectly out of my (or my child's) participation in the Activities, even if caused by the active or passive negligence of CSD or any of the Released Parties

5. Medical Authorization: I authorize CSD to seek medical treatment on my behalf in the event of an emergency or injury occurring during dance classes or events, if deemed necessary. I voluntarily consent to receive emergency medical care, including but not limited to first aid, CPR, administration of medication, and transportation to a medical facility, if deemed necessary by the staff or authorized personnel. I understand that every effort will be made to contact emergency contacts listed on file before initiating any medical treatment. I understand that I am responsible for any medical expenses incurred as a result of such treatment. I release and hold harmless CSD, its owners, instructors, employees, and agents from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any emergency medical treatment provided to me during my participation in any Activities at CSD.

6. Lost/Stolen Items: I understand and acknowledge that while participating in activities organized by CSD, there is a risk of loss or theft of personal belongings. I hereby release and hold harmless CSD, its owners, instructors, employees, and agents from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to the loss or theft of my personal belongings. I acknowledge that I am solely responsible for the security and safekeeping of my personal belongings while on the premises of CSD and that CSD cannot guarantee the safety of personal belongings. I understand that CSD is not liable for any lost or stolen items, including but not limited to electronic devices, wallets, jewelry, clothing, or other personal property.

7. Indemnification: In consideration of for being permitted to participate in the Activities at CSD, I hereby agree to indemnify and hold harmless CSD and any of the Released Parties, from any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to: (i) any injury, illness, or harm suffered by me or any third party during participation in me participant or any third party while on the premises of CSD, (iii) any breach of any representations, warranties, or obligations under the terms of this Agreement, (iv) any violation of laws, regulations, or policies during participation in the Activities organized by CSD, and (v) any act or omission that can cause harm, injury, or damage to others or to the property of others.

8. Medical Disclosure: I represent that I (or my minor child) am in good physical condition and have no known medical conditions, limitations, or impairments that would make participation in the Activities unsafe. I further release CSD and any of the Released Parties from any liability whatsoever arising from any physical condition, whether good or bad, known or unknown, and disclosed or not disclosed.

9. No representations, AS IS: I acknowledge that CSD and the Released Parties make no representation about the condition of the premises and the equipment used during the Activities, which are accepted "AS-IS”, CSD and the Released Parties shall not be liable for any damages, injuries, losses, or delays resulting from any condition of the premises, whether known or unknown, of from any defects, malfunctions, or failure of the equipment during the Activities.

10. Responsibility for CSD Property: I agree that I am responsible for the proper use of CSD’s premises or of any equipment or property belonging to CSD and that I will be liable for the replacement cost of any property of CSD that may result damages, destroyed, or lost due to my actions or negligence. I recognize that cost of the replacement is determined by CSD in its own discretion.

11. Photos and Videos: I grant CSD permission to photograph, videotape, and/or record my likeness and/or voice during dance classes, performances, or events for promotional and educational purposes. I understand that these materials may be used in print, online, and social media platforms, and I waive any right to compensation for such use.

12. Tuition: Tuition is per month and is not dependent on the number of classes in the month. Some months there will be fewer classes due to holidays, etc. Tuition is charged to the card on file the first of each month. All lessons must be paid for whether the student is in class or not. If a student registers late in the season, the all-inclusive fees will be added to the monthly tuition to ensure full payment for costumes, recital and registration fees, etc. There is a $25 late fee for tuition paid after the 1st of each month, even if your child has been absent.

13. Emails: Monthly email newsletters are sent out to parents. Please ensure that we have your correct email address. Important information is sent out and it is YOUR responsibility to read these emails and know what is going on. All important information will be sent via email.

14. Absences and Make-up lessons: In case of absence for any reason, please notify the director to set up a make-up class. Make-ups are only available for some classes so please make sure to be in class as much as possible. All dancers are expected to participate in the showcase and recital as it is part of the full program. In the event a dancer drops classes/is unable to attend performances, notice must be given 30 days in advance. If notice is given less than 30 days prior, a $100 re-blocking fee will be charged to the dancer's account.

15. Refunds/Returns: CSD does not issue refunds for any reason. CSD is a professional program for dedicated dancers. In order to drop all classes and be removed from Auto Pay, a 30-day notice must be given to the studio. Auto Pay tuition will still be run on the 1st of each month unless a request to drop has been processed 30 days prior to the 1st of the following month. Notice can be given by contacting the studio directly with a written notice to drop classes. This written notice must be submitted by email to info@centrestageov.com

16. Autopay: I agree to have my card on file charged according to the tuition, private lessons (if applicable) and charge schedule for which my child is enrolled. I recognize and agree to no refunds. I will make sure that my credit card on file is up to date. There will be a $25 late fee on all charges that are not paid by the first of each month.

17. CSDS’s Protocol for Students/Parents:
-Parents should not leave until their child has been admitted into the building.
-Parents are to wait outside during class times to reduce distractions in the studio.
-Students/Parents will exhibit appropriate behavior in and out of the studio and towards CSD staff and other students
-Students/Parents must do their best to be on time and perpetually tardy students will not be allowed to continue.
-Students that show symptoms or have a fever over 100 will not be admitted.
-At all times, please do not send your child to class if she or someone in your household is sick or has been sick in the last 14 days. Please take advantage of our virtual options when someone in the house is sick.

18. Voluntary Agreement: I hereby represent and warrant that I have entered into this Agreement freely, knowingly, and voluntarily, without any duress, coercion, pressure, or undue influence from CSD, its agents, or any third party. I also acknowledge that I fully understand all the terms, conditions, and legal consequences of this Agreement. I further agree that all provisions, including any limitations of liability, waivers, and releases contained herein, are fair, reasonable, and mutually agreed upon.

19. Survival: Any provision of this Agreement that, by its nature, is intended to survive the expiration or termination of this Agreement shall remain in full force and effect after such expiration or termination. This includes, without limitation, provisions regarding liability, indemnification, waivers, releases, confidentiality, governing law, dispute resolution, and any outstanding payment obligations.

20. Entire Agreement: This Agreement, including any exhibits, schedules, and addenda attached hereto, constitutes the entire agreement between the Parties regarding the subject matter hereof and supersedes all prior or contemporaneous oral or written agreements, understandings, negotiations, representations, or discussions between the Parties. Each Party acknowledges that, in entering into this Agreement, it has not relied upon any promise, representation, warranty, or statement not expressly set forth in this Agreement. No amendment, modification, or waiver of any provision of this Agreement shall be binding unless executed in writing by both Parties.

By signing this waiver, I acknowledge that I have read, understood, and voluntarily agree to all terms and conditions outlined herein. I understand that this waiver is legally binding and remains in effect for all present and future dance activities at CSD.
