PLATINUM DANCE POLICIES
RELEASE OF LIABILITY
In consideration of my child's participation with PDC, with full understanding of the risks involved, I hereby release, waive, discharge, covenant not to sue, and agree to indemnify, save and hold harmless PDC and all of its owners, directors, officers, employees, agents, instructors, contractors, representatives, volunteers and executors (hereinafter collectively referred to as "PDC Representatives"), from any and all liabilities, claims, demands, losses, attorney's fees, damages, action and causes of action whatsoever arising out of or related to any loss, damage, or injury including death, that may be sustained by my child , whether caused by the negligence of PDC Representatives or otherwise while participating with PDC, on behalf of PDC, or upon other premises where PDC activities are being conducted. I agree to take no legal action against PDC or PDC Representatives because of any accident or mishap involving the athletic participation of my child, and I authorize emergency medical treatment for my child should the need arise. This release applies to, including by not limited to, any act or occurrence that is caused by, or alleged to be caused by, by the negligence of PDC including rescue or medical procedures. I further agree that if, despite this release, I, my child, or anyone on my child's behalf makes a claim against PDC, I will indemnify, save, and hold harmless PDC from any litigation expenses, attorney fees, loss, liability, judgment, damage, or any cost that may occur as the result of any such claim. I specifically acknowledge that there are known health risks associated with group gatherings, including the exposure to COVID-19. I understand that by my child being present on-site at PDC, there is always a risk of exposure in any setting, and I specifically release, forever discharge, and promise to indemnify PDC from any claim that my child or anyone associated with my child was infected with COVID-19 as a result of being at PDC.
PAYMENT POLICIES
School Year Tuition & Fees (September - May): A one-time Annual Registration Fee of $35 per dancer will be processed at the time of enrollment. Tuition is based on the total hours of class taken per week, calculated by the year and divided into 9 equal payments (September-May). The 9 installments are not based on a specific month or the number of classes per month. The tuition listed on our website and in your parent portal for your dancer's class is the monthly tuition installment amount. By registering for class, you are Automatically signing up for Automatic payments to be deducted on the 1st of every month using the credit card or checking account information provided above. There will be no refunds for missed classes or dropping during the session. Please note, Tuition and Registration Fees are non-refundable and non-transferable. A $35 late fee will be added to your account if it is not up-to-date by the 5th of the month. PDC has the right to suspend a student if consistent delinquent payments on accounts are received. PDC also has the right to prohibit a student from participating in the annual recital if the account is past due. Any account more than 30-days past due will automatically be processed for the full amount. PDC does not accept AMEX credit cards.
Summer Tuition & Fees: Summer Tuition is billed by class or camp and varies by program. Summer Recreational Classes & Camps require a 100% deposit at the time of enrollment. Our Summer Competition Team & Summer Performance Team camps & classes require full payment on the first day of class.
DROP POLICY:
School Year (September - May): Fees (including Registration Fees) are non-refundable and non-transferrable. If your dancer needs to be removed from a class and you want your tuition payments stopped, a Drop Form must be submitted. You are responsible for tuition during the month you drop. There is no pro-rating of monthly installments for drops. Therefore, if you can only attend one class in the month you drop, you are still responsible for the full month's installment. If a dancer drops after a costume is ordered, you are responsible for the full payment of the costume. A registration fee is charged each time a dancer re-enrolls.
Change in delivery of classes: If any state, federal or local order prohibits or restricts the manner in which PDC delivers it classes, or, if in the best judgment of PDC a different delivery of classes is deemed prudent, PDC reserves the right to deliver classes in the manner it feels is the safest and most effective. This includes, but is not limited to, transferring to virtual or online classes.
Summer Classes & Camps: We have a 30-day cancellation policy. If you cancel 30-days prior the full amount will be credited to your account in the form of an account credit. If you cancel 29-days or less prior to the start of the camp, a 50% account credit will be provided. If a dancer moves programs (transfers classes) and not drops, the full amount will be credited.
ELECTRONIC SIGNATURE:
By checking here, you are consenting to the use of your electronic signature in lieu of an original signature on paper. You have the right to request that you sign a paper copy instead. By checking here, you are waiving that right. After consent, you may, upon written request to us, obtain a paper copy of an electronic record. No fee will be charged for such copy and no special hardware or software is required to view it. Your agreement to use an electronic signature with us for any documents will continue until such time as you notify us in writing that you no longer wish to use an electronic signature. There is no penalty for withdrawing your consent. You should always make sure that we have a current email address in order to contact you regarding any changes, if necessary.
PHOTO & VIDEO RELEASE:
Platinum Dance Center reserves the right to use any images of your child, including but not limited to photos and videos, for promotional, marketing and advertising materials (this includes posting on Platinum Dance Center's website, in studio and other social media pages).
ASSUMPTION OF RISK:
I, by checking the box below, represent that I am the minor child's (hereinafter "child") parent or legal guardian. I also represent that I am authorized to sign this waiver. I authorize my child's participating and training in dance and gymnastics at Platinum Dance Center, LLC, Platinum Dance West, hereinafter collectively referred to as "Platinum Dance Center" or"PDC", including the use of its facilities, equipment and machinery. I understand and acknowledge the nature of the activities my child will be involved in at PDC. I understand and acknowledge that participation in dance and gymnastics involves a great than normal risk of injury and I agree as my child's parent or guardian to assume all risks in connection with my child's participation in dance or gymnastics classes, programs, lessons, meets or competitions. I further understand that participation in dance and gymnastics is potentially dangerous and involves risk of serious injury, even death. Due to the dangers of this activity, I understand the importance of my child's following the teacher's instructions regarding techniques, training, and other rules and agree my child will obey these instructions. I also understand that PDC regularly clean facilities and equipment, but even with best efforts-an organization cannot prevent any illness or infection, including but not limited to COVID-19, from being exposed. In consideration of allowing my child to participate, I assume all the risks associated with the sport of dance. I choose to accept such risks, and I voluntary accept any and all responsibility for my child's safety and welfare while participating in PDC. I understand my child's experience, physical health and capabilities. By checking below, I agree that my child is qualified, in good health, and in proper physical condition to participate in such activities, and I acknowledge and understand that there may be exposures to illnesses that cannot be prevented with reasonable diligence.
TEXT MESSAGING POLICY
By participating, you consent to receive text messages sent by an automatic telephone dialing system. Consent to these terms is not a condition of purchase. Messages and data rates may apply. You may receive up to 10 msgs/month. You may update your Parent Portal at anytime to change your opt-in settings. If you opt-out of text messaging, you may miss important reminders from Platinum Dance Center.
MEDICAL EMERGENCIES
In any event of an accident or emergency, I authorize PDC and/or any appropriate medical facility to take whatever emergency measures (first aid, disaster evaluations, etc.) as judged necessary for the care and protection of my child under the supervision of PDC. In the case of a medical emergency, I understand that my child will be transported to an appropriate medical facility by the local emergency unit for treatment if the local emergency resources (police, rescue squad, first responder, ambulance, etc.) deem it necessary. I understand the child will be transported at my expense. I understand that in some situations, the staff will need to contact the local emergency resource before the parent, child's physician and/or other adult acting on the parent's behalf. I understand and agree that I am responsible for all medical expenses incurred to treat my child's injuries. I further authorize and consent to the use or disclosure of my child's individually identifiable health information should treatment for illness or injury become necessary. Should my child to be transported to a hospital for medical treatment, I hold Platinum Dance Center and it's representatives harmless for any such expenses. Additionally, I hereby agree to individually provide for all medical expenses which may be incurred by me or my child(ren) as a result of any injury sustained while participating at or for Platinum Dance Center.
