Elev8 Dance Membership Agreement

This Agreement is entered into between the participant, or if a minor, their parent or legal guardian (the “Participant”), and Elev8 Dance Inc. (“Elev8 Dance”).

1. Membership Overview
Membership with Elev8 Dance provides access to scheduled classes, programs, and studio activities during the active membership term. Membership is not based on attendance and does not guarantee participation in any specific class, event, or session.

2. Membership Access & Participation
Membership provides access to classes and programming as offered by Elev8 Dance. Class schedules, instructors, locations, and formats may reasonably change. Services are considered provided when access to scheduled programming is made available, regardless of attendance.

3. Payment & Billing
– Membership fees are billed automatically on the 1st of each month.
– Fees are non-refundable, non-transferable, and not eligible for credit except as required by law.
– Fees remain payable regardless of attendance or voluntary non-participation.
– A reasonable administrative fee may be applied to overdue balances.
– Elev8 Dance may suspend participation or pursue unpaid or reversed charges.

4. Withdrawal Policy
– Withdrawal requests must be submitted in writing.
– Requests received on or before the 15th will take effect at the end of the current month and prevent billing for the following month.
– Requests received after the 15th will take effect at the end of the following month, and the next scheduled monthly payment will remain due.
– Membership access continues through the effective withdrawal date.
– Failure to attend or communicate does not constitute withdrawal.
– Nothing in this policy limits cancellation rights provided by applicable law.

5. Assumption of Risk
Participation in dance, acrobatics, performance, and related activities involves inherent risks, including physical injury, illness, or property damage. The Participant voluntarily assumes the ordinary and inherent risks associated with participation.

6. Studio Rules & Conduct
Participants agree to follow studio rules, including but not limited to:
– Meeting posted class attire and uniform requirements
– Respecting staff, students, guests, and property
– Observing studio safety guidelines
– Complying with posted schedules and procedures
Failure to comply may result in suspension or termination of participation, subject to applicable law.

7. Media & Public Participation
Participants acknowledge that classes, exams, performances, competitions, class photos, and studio events may be photographed or recorded. Images and recordings may appear publicly, including online, on social media, or in print, and may be used by Elev8 Dance to document and promote its programs, performances, events, achievements, and studio activities.
Participants should not assume that their image or likeness will remain private as a result of participation.

8. Studio Policies
Current studio policies provided or made available at enrolment form part of this Agreement. Elev8 Dance may reasonably update operational policies from time to time. Material changes to fees, billing, withdrawal terms, or other contractual obligations will be made in accordance with applicable law.

9. Uniform & Class Attire
Participants must meet the posted uniform or class-attire requirements applicable to their classes. Required clothing, footwear, or equipment is not included in membership fees unless explicitly stated. Participation may be restricted where attire or equipment does not meet applicable class or safety requirements.

10. Achievement Exams & Level Certifications
– Programs include exams, certifications, and/or progress evaluations as part of the training system.
– Applicable fees are billed separately at the rates and dates disclosed for the applicable program.
– Participants may opt out of optional exams in writing by the disclosed deadline.
– Exams may be mandatory for designated programs, classes, or teams.

11. Release of Liability
To the fullest extent permitted by law, the Participant releases and holds harmless Elev8 Dance, its owners, staff, instructors, and affiliates from claims arising from the ordinary and inherent risks of participation in Elev8 Dance activities.
Nothing in this Agreement limits liability or legal rights that cannot lawfully be excluded or waived.

12. Indemnification
The Participant agrees to indemnify Elev8 Dance for reasonable losses, damages, or expenses arising from intentional misconduct, deliberate property damage, or material breach of this Agreement, except where prohibited by law.

13. Service Interruptions & Force Majeure
Elev8 Dance may reasonably modify, relocate, reschedule, deliver online, or temporarily suspend programming because of weather, facility closures, government orders, public-health events, emergencies, or other circumstances beyond its reasonable control.
Where programming or substantially equivalent access continues to be provided, regular payment obligations remain in effect. Nothing in this section limits rights provided by applicable law.

14. Governing Law
This Agreement is governed by the laws of the Province of Ontario and the applicable laws of Canada. If any provision is found unenforceable, the remaining provisions will remain in effect.

Acknowledgment
By enrolling and accepting this Agreement, the Participant confirms that they have read, understood, and agreed to its terms, the applicable enrolment and payment details, and the studio policies made available at enrolment.
