Elev8 Dance Membership Agreement

This Agreement is entered into between the undersigned participant, or if a minor, their parent or legal guardian (the “Participant”), and Elev8 Dance Inc. (“Elev8 Dance”).

1. Membership Overview
Membership with Elev8 Dance provides access to scheduled classes, programs, and studio activities during the active membership term. Participation in classes is optional and at the discretion of the Participant. Membership is not based on attendance and does not guarantee participation in any specific class or session.

2. Membership Access & Participation
Membership provides the right to access classes and programming as offered by Elev8 Dance. Class schedules, instructors, and formats may change at any time. Attendance is not required for fulfillment of the membership. Services are considered rendered when access to programming is made available, regardless of whether the Participant attends.

3. Payment and Billing Terms
– Membership fees are billed automatically on the 1st of each month.
– All sales are final; refunds, credits, or transfers are not provided.
– Fees remain payable regardless of attendance or participation.
– Payments remain due if classes are delivered online or at an alternate location.
– A 5% administrative fee may be applied to overdue balances.
– Elev8 Dance reserves the right to pursue collection of unpaid or reversed charges.

4. Withdrawal Policy
– Withdrawal requests must be submitted in writing on or before the 15th of the month to prevent billing for the following month.
– Requests received after the 15th will take effect the following billing cycle.
– Failure to attend or communicate does not constitute withdrawal.

5. Assumption of Risk
Participation in dance activities involves inherent risks, including physical injury, illness, or property damage. The Participant voluntarily assumes all such risks, whether arising from participation, instruction, or use of facilities.

6. Studio Rules and Conduct
Participants agree to follow all studio rules, including but not limited to:
– Adhering to posted dress codes and uniform requirements
– Respecting staff, students, and property
– Observing studio safety guidelines
– Complying with posted schedules and procedures
Failure to comply may result in suspension or termination without refund.

7. Media Release
The Participant grants Elev8 Dance permission to photograph, record, and use images or recordings of the Participant for promotional, educational, or marketing purposes without compensation.

8. Policy Integration
Elev8 Dance operates under a posted-policy system. All current policies, including membership terms, billing practices, and studio rules, form part of this Agreement. Continued participation constitutes acceptance of all posted and updated policies.

9. Uniform Policy
Uniforms are required for participation in designated classes. Required items are not included in membership fees unless explicitly stated. If a required uniform item is not provided by the Participant, Elev8 Dance may supply the item and bill the associated cost to the account.

10. Release of Liability
The Participant releases and holds harmless Elev8 Dance, its owners, staff, and affiliates from all claims arising from participation in any activity, including injury, illness, or property loss.

11. Indemnification
The Participant agrees to indemnify and hold harmless Elev8 Dance from any claims, damages, or expenses arising from participation or breach of this Agreement.

12. Force Majeure
Elev8 Dance shall not be liable for failure or delay in performance caused by events beyond its reasonable control, including but not limited to natural disasters, government orders, or public health emergencies. Services may be modified or suspended without refund.

13. Governing Law
This Agreement shall be governed by the laws of the Province of Ontario. If any provision is deemed unenforceable, the remaining provisions shall remain in full effect.

Acknowledgment
By enrolling, the Participant confirms they have read, understood, and agreed to the terms of this Membership Agreement.
