Customer Consent
In exchange for being permitted to enter the premises of Kauai Dance House/Koloa Dance House (KDH), located at 2829 Ala Kalanikaumaka Street, Suite B119 & Suite B121, Koloa, Hawaii 96756, and 3-2600 Kaumualii Hwy, Suite A-2, Lihue, HI 96766, to attend classes in the nature of, but not limited to dance, fitness or other educational and/or recreational purposes, I agree to the following as described in this contract.
I give permission to myself and my child(ren) to participate in activities at KDH which include dance instruction. I understand that there are risks of physical injury associated with, arising out of participation in this program and inherent to the activity of dance.
I knowingly and voluntarily waive all rights and/or causes of action of any kind, including any and all claims of negligence arising as a result of such activity from which liability could accrue to the Instructor, any employee or substitute, and Koloa Dance House LLC (KDH). I hereby agree to release and hold the aforementioned harmless of all liability, and hereby acknowledge that I knowingly and voluntarily assume full responsibility for all risks of physical injury arising out of active participation on behalf of the participant. I further release the aforementioned of all liabilities associated with my child’s attendance.
I have signed this document voluntarily and of my own free will in exchange for the privilege of participation. I warrant the filled-in information on this form is complete and correct.
I give permission for the aforementioned to use my/my child(ren)’s image via photograph or video for promotional, grant, and/or research purposes.
Payments - Credits - Refunds
Payment will be made to Koloa Dance House via cash, check, an approved payment card, gift card, or by any other payment method determined by the Business. If a credit card is saved to your profile, you give us permission to charge this card for future agreed-upon activities. Participation in an activity at Koloa Dance House is secured by payment of an invoice issued by Koloa Dance House prior to the start of a class, workshop, camp, or activity. The customer agrees to pay invoice(s) by the due date(s) specified. Unpaid or overdue invoices may result in losing your spot in the activity. If an invoice is left unpaid for 3 months or longer, it may be turned over to a Collections Agency.
All sales are final. Tuition is non-refundable. In the unlikely event that we have to cancel classes for reasons out of our control (e.g., natural disaster, pandemic, etc.), we will hold your tuition as a credit for a future camp or class. If we cancel a class/activity due to low enrollment, we will refund you.
COVID-19 Disclaimer
I agree not to enter the Premises if I am experiencing symptoms of COVID-19 such as cough, shortness of breath, or fever, have a confirmed or suspected case of COVID-19, or have come in contact in the last 14 days with a person who has been confirmed or suspected of having COVID-19.
I am aware of the highly contagious nature of COVID-19 and the risk that I may be exposed to or contract COVID-19 by being on the Premises of Koloa Dance House and engaging in the Activity.
I acknowledge that I am voluntarily entering the Premises to engage in the Activity with knowledge of the danger involved. I hereby agree to accept and assume all risks of personal injury, illness, disability, or death related to COVID-19, arising from my being on the Premises or engaging in the Activity, whether caused by negligence of the Business or otherwise.
I hereby expressly waive and release any and all claims, now known or hereafter known, against the Business and its owners, employees, affiliates, and officers, on account of injury, illness, disability, or death arising out of or attributable to my being on the Premises or engaging in the Activity and being exposed to or contracting COVID-19, whether arising out of the negligence of the Business, its owners, employees, affiliates, officers, or otherwise.
