Account Waiver & Consent
By creating an account with Kauai Dance House/Koloa Dance House LLC (“KDH”) and registering myself or my child(ren) for KDH classes, camps, workshops, rehearsals, performances, fitness classes, or other activities, I agree to the following terms.
Participation & Assumption of Risk
I understand that participation in dance, fitness, and other physical activities involves inherent risks, including but not limited to falls, collisions, muscle strains, sprains, fractures, and other injuries.
I voluntarily choose to participate, or allow my child(ren) to participate, in KDH activities and understand and accept the risks associated with participation.
To the fullest extent permitted by law, I release and hold harmless KDH, Koloa Dance House LLC, its owners, directors, instructors, employees, substitutes, volunteers, and representatives from claims arising from participation in KDH activities, including claims related to injury, illness, loss, or damage, except where such release is prohibited by law.
I understand that KDH instructors and staff are not medical professionals and that KDH does not provide medical diagnosis or treatment.
I agree to inform KDH of any medical condition, injury, allergy, limitation, or other circumstance that may affect my or my child’s ability to safely participate. KDH may ask a participant to refrain from or discontinue an activity when staff have a reasonable safety concern.
Emergency Medical Authorization
In the event of an emergency, I authorize KDH staff to seek appropriate emergency medical assistance for myself or my child when reasonably necessary, particularly if I cannot be reached.
I understand that I am responsible for any medical expenses resulting from an injury or emergency.
Photo & Video Consent
I give KDH permission to photograph and/or record myself or my child(ren) during KDH classes, rehearsals, performances, events, and activities.
I understand that these photographs and videos may be used by KDH for promotional, website, social media, educational, grant, research, and other business-related purposes.
Payments, Credits & Refunds
I agree to pay all tuition, fees, costumes, competition expenses, and other charges associated with my account by the stated due dates.
If I save a payment method to my account and authorize automatic or scheduled payments, I authorize KDH to charge that payment method for agreed-upon charges.
Tuition and registration payments are non-refundable. Missed classes do not result in refunds or prorated tuition. Makeup opportunities, when offered, are subject to KDH's current makeup policies, communication requirements, and class availability.
If KDH must cancel an activity due to circumstances outside of its control, including natural disasters, severe weather, or other emergencies, KDH may provide a makeup opportunity or account credit for a future eligible class, camp, or activity.
If KDH cancels an activity due to low enrollment, KDH will provide a refund or other appropriate resolution.
Unpaid or overdue balances may result in the loss of a participant's spot in an activity and/or restrictions on future registration. Accounts with unpaid balances may be referred to a collection agency when appropriate.
Account Agreement
By creating a KDH account and selecting the applicable consent/acceptance option, I confirm that I have read and agree to this Waiver & Consent.
If I am creating an account for a minor, I confirm that I am the participant's parent or legal guardian and have authority to provide this consent on their behalf.
This agreement applies to myself and/or the minor participant(s) registered under my account and remains in effect for participation in KDH activities unless superseded by an updated agreement or otherwise revoked where permitted by law.
