Release and Waiver of Liability, Assumption of Risk, and Indemnity Agreement
Participation Agreement and Release or a minor and Release of Medical Expenses and Assumption of financial responsibility by Parent/Guardian.

I, the undersigned, as the parent/legal guardian of the minor child,
Voluntarily agree and consent to the participation of the minor child in all programs and activities at Fever Dance and Tumble and Fury Elite All stars. I recognize that the child’s participation in these programs and activities includes but is not not limited to dance, tumbling, trampoline, and cheerleading and that the nature of such sports or activities involving height or motion entail both known and unanticipated risks. These risk could result in injuries to my child which include but are not limited to physical or emotional injury, paralysis, death or damage to participants to property or to third parties.

Being fully aware of these dangers, I, on my own behalf, on behalf of my spouse, if any and on behalf of the child listed above, voluntarily consent to the child(athlete) participating in all the programs and activities at Fever Dance and Tumble and Fury Elite All Stars and accept all risks and all responsibilities for losses, cost and damages associated with that participation.

In consideration for allowing the child to use the facilities, I agree on my behalf of myself and on behalf of the child/athlete, my spouse, our respective heirs, administrators , executors, to hereby release, discharge indemnify, hold harmless, and covenant not to sue Katelyn Byrd, Coaches, Administrators, Fever Dance and Tumble and Fury elite All Stars. Employees and Instructors which are connected with these programs including claims of negligence by Fever Dance and Tumble and Fury Elite All Stars.

In the event of an emergency, I would like the above-mentioned child to be taken to a hospital or appropriate medical emergency clinic for medical treatment and I hold Fever Dance and Tumble/ Fury Elite All Stars and its representatives harmless in their execution of this action.

Additionally, I hereby agree to individually assume all financial responsibility for injuries, damages or property damages associated with the risks of the child's participation at Fever Dance and Tumble/Fury Elite All Stars which result from the child’s participation in the activities of Fever Dance and Tumble/Fury Elite All Stars.

I assume financial responsibility for (1) any injury to my child including medical costs and expenses incurred for treatment of the child resulting from participation in the activities at Fever Dance and Tumble/Fury Elite All Stars and I assume financial responsibility for (2) damage to property and injuries to others incurred by, caused by or resulting from the child’s participation in the activities at Fever Dance and Tumble /Fury Elite All Stars. I acknowledge that this agreement shall be governed by and construed in accordance with the laws of the state of North Carolina. If any suit or action is filed by any party to enforce this agreement or otherwise with respect to the subject matter of this agreement, the venue shall be in the state of North Carolina. If any provision of this agreement is found by court of law to be invalid or unenforceable in any respect for any reason, the validity and enforce-ability of the remaining provisions of this agreement shall not be impaired.

Finally, all fees paid to Fever Dance & Tumblr (tuition, costume fees, competition fees, etc) are non refundable

I HAVE READ AND UNDERSTAND THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT. MY SIGNATURE BELOW ACKNOWLEDGES THAT I AGREE TO BE BOUND BY ALL TERMS CONTAINED HEREIN.
