By creating an account with Urzua Performing Arts, I acknowledge that I have read and agree to the studio's policies regarding registration, tuition, attendance, make-up classes, media release, and liability. I understand that registration does not guarantee placement until it has been reviewed and approved by the studio and all required payments have been received.

Agreement of Release and Waiver of Liability

1. I am (or my child ), or will be participating in the Classes, Health Programs or Workshops offered by Urzúa Performing arts during which I (or my child) will receive information and instruction about performing arts and health. These classes entail intensive physical activity and exertion by me. I recognize that such physical activity and exertion may be difficult and strenuous and may cause or aggravate a physical injury or medical condition. I am fully aware of and accept the risks and hazards involved.

2. I understand that it is my responsibility to consult with a physician prior to and regarding my participating in the classes, health programs, or workshops, and to receive prior approval to participate. I represent and warrant that I am (or my child is) physically fit and have no medical condition or injury which would prevent my full participation in the yoga and dance classes, health programs, or workshops.

3. In consideration of being permitted to participate in the classes, health programs, or workshops, I agree to assume all full responsibility for any risks, conditions, injuries, or damages, known or unknown which I (or my child) might incur or aggravate as a result of my participating in same.

4. In further consideration of being permitted to participate in the classes, health programs, or workshops (the “Programs”), I knowingly, voluntarily, and expressly waive any claim I may have or acquire against Urzúa Performing Arts the landlord or any premises at which it may operate, for any injury, condition or damages that I (or my child) may sustain as a result of entering or being on the premises or participating in the Programs.

5. I, my heirs or legal representatives, forever release, waive, discharge, and covenant not to sue Urzúa Performing arts, or the landlord of any premises at which it may operate, for any injury, condition or death, which arises, is caused by, or is aggravated by reason of my participation in the programs.

6. I understand that it is my continuing responsibility to inform the instructor(s) of Urzúa Performing arts of any previous medical conditions, injuries, or surgeries, prior to my first class and at such other times as I acquire information as to same.

7. I also understand that I have no claims against Urzúa Performing arts, or the landlord of the premises by reason of their refusal to allow me to participate in the programs.

I understand there is a definitive risk of injury associated with dancing and that such injuries include, but are not limited to bruises, dislocations, broken bones, torn or damaged muscles and ligaments, paralysis and even death. I understand that such injuries may be caused in whole or in part by the student (my child), or by the actions or inactions of other students or instructors.
1. In consideration of being accepted for dance instruction by Urzua Performing Arts, and in further consideration of the expertise and achievements of instructors at UPA and the limited number of students that may be accepted by UPA, my child and I agree to all of the following, which shall bind me and my child, and also my heirs, assigned executors and administrators:

a. I agree to instruct my child to immediately stop performing any activity if he or she feels any pain, dizziness, light-headedness, or any other symptoms, and to immediately report those symptoms to the instructor. I also agree to instruct my child to carefully follow the instructors’ directions, to ask for additional directions if he or she does not understand any particular activity, and to immediately stop any activity which he or she is not competent or confident enough to perform.

b. To the fullest extent permitted by law, I agree and represent that I and my child assume the risk and responsibility for any and all injuries to my child that he or she sustains while performing any dance activities, including any and all costs and damages that are a consequence of such injuries, and whether such injuries, costs and damages were caused in whole or in part by UPA, instructors, students or employees.

c. To the fullest extent permitted by law, I and my child agree to defend, indemnify and hold harmless UPA and their instructors, agents, employee, contractors, clients and students, from and against all claims, costs, damages, losses and expenses, including but not limited to attorney’s fees, arising out of or resulting from my child’s performance or other participation in any dance or aerial activities, regardless of whether or not such claim, cost, damage, loss or expense was caused in part by a party indemnified hereunder.

Limited Use Photographic Release
For and in consideration of my engagement as a student by the Urzúa Performing Arts on terms hereinafter stated, I hereby give the Photographer/Videographer and UPA, their legal representatives and assigns, those for whom the Photographer/Videographer and UPA are acting, and those acting with their permission, the right to copyright and/or use, reuse and/or publish, and republish the photographic pictures/film of me taken during the course of my study at UPA or at any School performances. I hereby waive any right to inspect or approve the finished photograph(s)/video(s) prior to publication. I hereby release, discharge and agree to save harmless the Photographer /Videographer and UPA, their representatives, assigns, or any other person or persons, corporation or corporations, for whom they might be acting, including any firm publishing and/or distributing the finished product, in whole or in part, from and against any liability as a result of its publication or distribution of the same. I certify that I am suffering under no legal disabilities and that I have read the foregoing release, authorization and agreement, before affixing my signature below, and warrant that I fully understand the contents thereof.

NOTE: ANY PAYMENTS TO URZUA PERFORMING ARTS ARE NOT REFUNDABLE, NO CREDIT WILL BE GIVEN FORWARD LOST CLASSES.

URZUA PERFORMING ARTS PARTICIPATION WAIVER, RELEASE OF LIABILITY & POLICIES

By registering myself and/or my child(ren) with Urzua Performing Arts, I acknowledge that I have carefully read, understood, and voluntarily agree to the following terms and conditions.

1. Assumption of Risk

I understand that participation in dance, ballet, jazz, tap, hip hop, lyrical, contemporary, ballroom, musical theatre, acting, singing, piano, aerial arts, circus arts, acrobatics, tumbling, hand balancing, conditioning, Pilates, yoga, strength training, rehearsals, performances, competitions, camps, workshops, private lessons, demonstrations, and all other physical activities offered by Urzua Performing Arts involves inherent risks.

These risks include, but are not limited to:

Falls from apparatus or equipment
Slips, trips, and falls
Sprains, strains, fractures, dislocations
Concussions
Muscle injuries
Head, neck, spinal, or back injuries
Equipment failure
Collisions with instructors or other participants
Permanent disability
Death

I understand that no amount of instruction, supervision, spotting, padding, or safety equipment can eliminate all risks.

I voluntarily assume all risks associated with participation.

2. Release of Liability

To the fullest extent permitted by New York law, I release, waive, discharge, and covenant not to sue:

Assistant instructors
Employees
Independent contractors
Volunteers
Guest teachers
Choreographers
Event staff
Brian Costello
Margaret Costello
The owners of the premises
The landlord
Property managers
Building management
Successors
Assigns
Representatives
Agents

from any and all claims, demands, causes of action, damages, losses, expenses, attorney's fees, or liabilities arising from participation in any Urzua Performing Arts activity, whether caused by negligence or otherwise, except where prohibited by applicable law.

3. Facility

This waiver applies to all activities conducted by Urzua Performing Arts, including activities taking place at:

Long Island City, NY 11101

and any additional rehearsal spaces, theaters, competition venues, schools, parks, rented facilities, outdoor locations, or any location where Urzua Performing Arts conducts classes, rehearsals, camps, workshops, performances, competitions, or events.

4. Medical Authorization

I certify that I (or my child) am physically able to participate.

I agree to immediately notify Urzua Performing Arts of any:

injuries
illnesses
allergies
medical conditions
physical limitations

In the event of an emergency, I authorize Urzua Performing Arts to obtain emergency medical treatment if I cannot be reached.

I understand that I am solely responsible for all medical expenses.

5. Parent Responsibility

Parents agree to:

Provide accurate emergency contact information.
Keep all medical information current.
Pick up students promptly.
Ensure students arrive appropriately dressed.
Follow all studio safety policies.

6. Attendance & Make-Up Classes

Regular attendance is important for student progress.

Missed classes are not refundable.

When available, make-up classes may be offered according to current studio policy.

7. Tuition & Registration

Registration reserves a student's placement.

Enrollment is not considered financially complete until payment has been received.

Tuition, registration fees, costume fees, competition fees, camp fees, workshops, and other program fees are non-refundable.

Credits may be issued only at the sole discretion of Urzua Performing Arts.

8. Photography & Video Release

I grant permission for Urzua Performing Arts to photograph and record myself and/or my child during classes, rehearsals, performances, camps, competitions, workshops, and studio events.

These images and recordings may be used for:

advertising
promotional materials
social media
website
brochures
newsletters
educational purposes

without compensation.

If I do not wish to grant permission, I will notify the studio in writing before participation.

9. Personal Property

Urzua Performing Arts is not responsible for lost, stolen, or damaged personal belongings.

Students are encouraged to label all personal items.

10. Student Conduct

Students are expected to:

Follow instructor directions.
Respect fellow students, staff, and property.
Use equipment safely.
Behave respectfully at all times.

Failure to comply with studio policies may result in suspension or dismissal without refund.

11. Governing Law

This Agreement shall be governed by the laws of the State of New York.

Any legal action shall be brought in a court of competent jurisdiction located within the State of New York.

12. Severability

If any portion of this Agreement is found unenforceable, all remaining provisions shall remain in full force and effect.

13. Electronic Agreement

By checking the acceptance box during registration, I acknowledge that I have read this Waiver, Release of Liability, and Studio Policies in their entirety.

I understand its contents.

I voluntarily agree to all terms.

I understand that this electronic acknowledgment carries the same legal effect as my handwritten signature.
