Release
I release Brooklyn Dance Conservatory and their directors, owners, students, teachers, staff, employees, volunteers, associates (collectively referred to in this document as BKDC) from any liability or claim that I or my representatives may have against BKDC with respect to any bodily injury, personal injury, illness, death, or damage that may result from my/my child/the minor child for whom I am a legal guardian (collectively referred to in this document as Student)'s participation with BKDC. To the fullest extent permitted by the laws of the State of New York, I agree to indemnify, defend, and hold harmless BKDC from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or related to Student’s participation in classes, camps, intensives, workshops, performances, rehearsals, use of equipment or facilities, or any activities associated with BKDC.

Risks
I understand that there are risks of physical injury associated with, arising out of, and inherent to dancing. These risks include the potential for slips and falls, sprains, strains, dislocations, soft tissue injuries, musculoskeletal injuries, podiatric conditions, COVID, and other risks not specified here. Understanding these risks and the potential for others not listed, I agree to personally accept and assume all of the risks present in Student's participation at BKDC to the fullest extent permitted by law. Student's participation at BKDC is entirely voluntary, and I choose for Student to participate in spite of the risks. Dance education sometimes requires hands-on instruction as well as verbal instruction. Instructors may correct dancers by touching their arms, legs, feet, hips, back and head to move them in the correct position. I acknowledge that this is a common standard in dance instruction and understand that it is my/Student's responsibility to communicate clearly with the teacher and/or the director if any form of touch is unacceptable to Student.

Medical Treatment & Insurance
I understand that BKDC does not provide medical, health, or accident insurance coverage for participants. In the event of an emergency, I authorize BKDC to obtain necessary medical or dental treatment for Student, including first aid, emergency transport, and hospitalization. I agree to be financially responsible for any and all costs incurred as a result of such treatment. I release and discharge BKDC from any liability arising from the provision of, or failure to provide, such emergency care, to the fullest extent permitted by law.

Photo & Video Release
I hereby grant BKDC the absolute right and permission to photograph and/or record (in any medium) Student during participation in classes and other BKDC activities and to use, distribute, publish or otherwise display such images or recordings, including Student’s name, image, persona, photograph, picture, voice, statements, biographical information, performance and/or other likeness (the “Media”), in whole or in part, alone and/or accompanied by other material, throughout the world, in perpetuity, in any and all media now known or hereafter devised for promotional, educational, or any other lawful purpose.

I acknowledge and agree that all such Media created by or on behalf of the BKDC shall be the sole and exclusive property of BKDC, and I hereby waive any right of inspection or approval of the Media or any use thereof. I further release and discharge the BKDC, its owners, employees, agents, and authorized representatives from any and all claims, demands, or causes of action that I or the Student may have or may hereafter acquire arising out of or in connection with the creation, use, or publication of such Media, including but not limited to claims based on invasion of privacy, right of publicity, defamation, or copyright infringement. This release shall survive Student’s withdrawal or termination of enrollment with BKDC with respect to any Media captured during Student’s enrollment with BKDC.
If I do not consent to such use, I will promptly notify BKDC in writing. I understand that opting out may limit Student’s participation in certain activities or performances that are recorded or photographed.

Video Surveillance Notice
I understand that BKDC utilizes video surveillance in studio and common areas for purposes including safety, security, and operational support. Cameras record video only (no audio), and footage is accessed only when necessary. I acknowledge that Student may be recorded as part of normal studio operations.

Cancelation, Refund, Credit Policy
Tuition is paid to hold a student's place in class or classes, and is non-refundable regardless of the student's attendance throughout the session. No reductions or refunds are given for missed classes. Non-attendance does not mean you have dropped your classes and/or withdrawn from Brooklyn Dance Conservatory. Tuition for a class may not be transferred to another class without the express consent of Brooklyn Dance Conservatory.

Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of New York.

Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Policies & Conduct
I agree that Student will abide by all rules, policies, and codes of conduct established by BKDC. BKDC reserves the right to remove a Student from class or activities for unsafe or disruptive behavior. I agree to address any questions or concerns promptly and directly with the director.

Acknowledgment
I acknowledge that I have carefully read and fully understand this Agreement, and that I have the full right to enter into this Agreement and grant the rights set forth above on behalf of myself and the Student. I further represent and warrant that I am the parent or legal guardian of Student, and I am signing this Agreement freely and voluntarily on behalf of myself and Student.
