The undersigned, heirs, executors and administrations waive and release any and all claims against Tribe Body, its agents, servants, and employees, for any personal injury sustained out of participations in any classes, rehearsals, and performances, or on the premises of Tribe Body.

I certify that my child is in good health and I understand that participation in classes involves physical movement and execution. I agree to provide medical insurance for my child and family. If my emergency contact cannot be reached, I give permission to the staff at Tribe Body to render or to act in my behalf to obtain emergency medical treatment for this student for any illness or injury that may occur while attending classes, rehearsals, performances, or on the premises of Tribe Body or performance venue.

I understand that I must pay for all classes that I register for here at Tribe Body. I understand that payment should reach Tribe Body on the time payment is due. In addition, I understand I am registering for the entire season (September-May), and if I choose to drop a class, there will be no refund due to me and I agree to pay for the entire season as my registration holds a secure spot in class. However, I may drop a class and receive a prorated refund prior to October 15th. If I choose this option and drop a class, I will notify the office of the withdrawal in writing via email or mail. After October 15th, there are NO refunds or credits given. Late registrations have up to 2 weeks to drop a class from the day of registration to drop for a prorated refund.

I understand that tuition is due in full or in 9 payments, I understand that I will pay a 3% surcharge if I opt to use a credit card of any kind. I understand that all registration fees are nonrefundable including the tuition payment collected upfront that is then allocated to the final payment of the year in May. I understand that failure to pay tuition, late fees, or miscellaneous charges may result in termination of my child(ren)'s participation in their class(es) until such a point that my account is made current.

I understand that Tribe Body does NOT issue refunds for any reason, included missed classes due to illness, vacation, religious observances, or withdrawal.

Tribe Body Waiver for All Classes Offered
The undersigned will be present at and participate in activities at Tribe Body.

Such activities may include, but are not limited to, classes, summer camp(s), open workout sessions, instruction, training, exhibitions, and a range of athletic, social and recreational activities (“Activities”)

Tribe Body Activities occur in facilities managed by Tribe Body or third party facility owners or other facilities and locations as may be designated. Various activities may be organized, provided, or conducted by affiliated persons or entities (“Service Providers”).

In consideration of the opportunity to be present at and participate in Tribe Body Activities, the undersigned, individually, and on behalf of his/her heirs, personal representatives, administrators, successors and assigns (collectively referred to as “Participant”) AGREES TO ASSUME THE RISK AND RESPONSIBILITY AND TO WAIVE, RELEASE AND TO INDEMNIFY Tribe Body, Service Providers and their employees, directors, officers, committees, officials, volunteers, affiliates, sponsors, suppliers, and agents, and their respective successors and assigns as follows:

1. Assumption of Risk and Responsibility.

A. Participant recognizes, understands, appreciates and acknowledges: (i) the risks and dangers of injury that may occur in the course of being on the grounds of and participating in the Activities (including but not limited to, activities involving heights and rotation, skills and techniques, and facilities, equipment, apparatus, mats, and pits unique to the various disciplines of circus arts); (ii) that my presence at Tribe Body and/or my participation in Activities may involve risk of bodily injury (including but not limited to injuries to bones, joints, muscles and internal organs), illness, disability or paralysis (whether temporary, permanent, total or partial), death, or other harm; and (iii) that Participant voluntarily engages in the Activities with adequate prior knowledge of such risks and dangers.

B. Participant voluntarily decides to participate in the Activities, and agrees to and does assume all legal and financial responsibility for: (i) any and all risks and dangers referred to in the preceding paragraph; (ii) any and all injuries, damages and losses, whether to person or property, and whether physical, psychological, social or economic, that Participant may in any manner and from whatever cause sustain in connection with attendance and participation in the Activities, including such injury, damage or loss that may result from the negligence of Tribe Body, Service Providers, or from any other cause; and (iii) all treatment, hospitalization and other care rendered to Participant in the event of his/her injury, illness or other emergent circumstance in connection with any of the foregoing.

2. Releases and Indemnification. Participant hereby fully and forever releases, discharges, holds harmless and agrees to indemnify Tribe Body, and Service Providers from and against any and all liabilities, losses, damages, claims, demands, litigation, and judgments, present or future, known or unknown, foreseeable or unforeseeable, valid or invalid, direct or consequential, together with reasonable costs and attorney fees (collectively referred to as “Claims”), (i) which result, directly or indirectly, from bodily injury, illness, disability or paralysis (whether permanent, temporary, total or partial), death, or other harm to Participant, third parties, or Participant’s property, or the property of third parties, and (ii) which are caused by or result, directly or indirectly, from Participant’s attendance at and participation in the Activities, or otherwise. Such waiver, release, and indemnification applies to any Claims incurred during or in connection with, or otherwise caused by, arising from, resulting from, or connected to, any of the Activities and the conduct and management thereof by Tribe Body, Service Providers or any third party, including any risks or dangers referred to in paragraphs 1.A. and 1.B. above, whether such Claims result from the negligence of Tribe Body, Service Providers, or from any other cause, to the fullest extent permitted by law.

3. Term. This Waiver and Release of Liability shall remain valid for as long as Participant attends or participates in Activities with Tribe body, or until it is expressly revoked by written notice from me to Tribe Body, whichever occurs first; provided however, that any such revocation shall not in any manner affect the waiver, release of liability, and indemnification given hereunder for any acts or occurrences prior to such receipt of said written notice by Tribe body or prior to termination of my participation.
