A. Divine Dance Studio, LLC Customer Release of Liability and Assumption of Risk
In consideration of being permitted by Divine Dance Studio, LLC to participate in its activities and to use its equipment and facilities, I hereby agree to release, indemnify and discharge Divine Dance Studio, LLC, its agents, owners, shareholders, directors, partners, employees, volunteers, manufacturers, participants, lessors, affiliates, its subsidiaries, related and affiliated entities, successors and assigns on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate as follows:
1. I acknowledge that my participation in Divine Dance Studio, LLC entail known and unknown risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity.
2. I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks.
3. I hereby voluntarily release, forever discharge, and agree to defend, indemnify and hold harmless RELEASED PARTIES from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of Divine Dance Studio, LLC equipment or facilities, including any such claims which allege negligent acts or omissions of RELEASED PARTIES.
4. Should Divine Dance Studio, LLC or anyone acting on their behalf, be required to incur attorney's fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.
5. I certify that I have adequate insurance to cover any injury or damage that I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition that I may have.
6. I agree that if the participant is a minor, this Release of Liability and Assumption of Risk agreement is made on behalf of that minor participant and that all of the releases, waivers and promises herein are binding on that minor participant. I represent that I have full authority as Parent or Legal Guardian to bind the minor participant to this agreement.
7. I agree that if the participant is a minor, I further agree to defend, indemnify and hold harmless Divine Dance Studio, LLC from any and all claims or suits for personal injury, property damage or otherwise which are brought by, or on behalf of the minor, and which are in any way connected with such use or participation by the minor, including injuries or damages caused by the negligence of RELEASED PARTIES, except injuries or damages caused by the sole negligence or willful misconduct of the party seeking indemnity.
By signing this document, I acknowledge that if anyone is hurt or property damaged during my participation in this activity, I may be found by a court of law to have waived my or the minor participant's right to maintain a lawsuit against Divine Dance Studio or any RELEASED PARTIES on the basis of any claim from which I have released them herein. I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms.

As the legal parent or guardian, I release and hold harmless Divine Dance Studio LLC, its owners and operators from any and all liability, claims, demands, and causes of action whatsoever, arising out of or related to any loss, damage, or injury, including death, that may be sustained by the participant and/or the undersigned, while in or upon the premises or any premises under the control and supervision Divine Dance Studio, LLC, its owners and operators or in route to or from any of said premises.

B. The undersigned gives permission to Divine Dance Studio, LLC, its owners and operators to seek medical treatment for the participant in the event they are not able to reach a parent or guardian. I hereby declare any physical/mental problems, restrictions, or condition and/or declare the participant to be in good physical and mental health.

C .I understand and agree that it is my responsibility to read all emails and to keep my email information updated with Divine Dance Studio, LLC. I also understand that all statements, class changes, holiday reminders, recital Information, and other information sent via email.

D. All adult classes are to be paid for before the class starts.

E. There are to be no refunds given for classes. Punch cards can not be redeemed for cash but may be transferred to another person.

F. I hereby give consent for Divine Dance Studio, LLC to take and post pictures of me/ my child for all advertising purposes on all Divine Dance Studio media pages as well as the teacher/choreographer media pages.

G. There are no refunds for merchandise. All merchandise, except sale items, may be returned for store credit within 30 days of purchase.

Customer Release of Liability, Policies, and Assumption of Risk

In consideration of being permitted by Divine Dance Studio, LLC to participate in its activities and to use its equipment and facilities, I hereby agree to release, indemnify, and discharge Divine Dance Studio, LLC, its agents, owners, shareholders, directors, partners, employees, volunteers, manufacturers, participants, lessors, affiliates, subsidiaries, related entities, successors, and assigns on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representatives, and estate as follows:

A. Release of Liability and Assumption of Risk

1. I acknowledge that participation in activities at Divine Dance Studio, LLC involves known and unknown risks that could result in physical or emotional injury, paralysis, death, or damage to myself, my child, property, or third parties. I understand that these risks cannot be completely eliminated.
2. I voluntarily choose to participate and expressly assume all risks associated with participation.
3. I voluntarily release, forever discharge, defend, indemnify, and hold harmless Divine Dance Studio, LLC and all released parties from any and all claims, demands, causes of action, damages, losses, or expenses arising from participation in studio activities or the use of studio facilities or equipment, including claims alleging negligence by the released parties.
4. If Divine Dance Studio, LLC is required to enforce this agreement, I agree to reimburse all reasonable attorney’s fees and legal costs incurred.
5. I certify that I have adequate insurance to cover any injury or damage sustained during participation or agree to bear those costs personally. I further acknowledge that I assume all risks related to any existing medical or physical condition.
6. If the participant is a minor, I acknowledge that this agreement is made on behalf of the minor and that all releases, waivers, and obligations are binding upon the minor participant. I certify that I am the parent or legal guardian and have authority to enter into this agreement.
7. I further agree to defend, indemnify, and hold harmless Divine Dance Studio, LLC from any claims brought by or on behalf of the minor participant arising from participation in studio activities, except in cases involving the sole negligence or willful misconduct of the party seeking indemnification.

By signing this agreement, I acknowledge that I may be waiving certain legal rights, including the right to bring legal action against Divine Dance Studio, LLC for claims covered by this release. I have carefully read and fully understand this agreement and voluntarily agree to its terms.

As the parent or legal guardian, I release and hold harmless Divine Dance Studio, LLC, its owners, employees, and operators from any liability arising from injury, illness, property damage, or death occurring while participating in studio activities, on studio premises, at off site events, or while traveling to or from such activities.

B. Medical Authorization

I authorize Divine Dance Studio, LLC, its owners, employees, and representatives to obtain emergency medical treatment for the participant if a parent or guardian cannot be reached. I certify that I have disclosed any physical, mental, or medical conditions that may affect participation and affirm that the participant is physically able to participate unless otherwise noted.

C. Communication Policy

I understand that it is my responsibility to maintain an accurate email address on file and to regularly review all communications sent by Divine Dance Studio, LLC. Studio announcements, billing notices, schedule changes, holiday reminders, recital information, competition information, weather updates, and all other important communications will be sent via email. Failure to read studio emails does not exempt me from studio policies or financial obligations.

D. Adult Classes

All adult classes must be paid in full prior to the start of class.

E. Refund Policy

Tuition and class fees are non refundable.

Punch cards are non refundable, cannot be redeemed for cash, and may be transferred to another individual.

F. Photo and Video Release

I grant permission for Divine Dance Studio, LLC to photograph and record me and/or my child during classes, rehearsals, performances, competitions, and studio events. I authorize the use of these photographs and videos for promotional, advertising, educational, and marketing purposes, including but not limited to the studio website, social media platforms, printed materials, and teacher or choreographer professional pages.

G. Merchandise Policy

All merchandise sales are final. Regular priced merchandise may be exchanged for store credit within 30 days of purchase if returned in new condition. Sale items are final sale.

H. Year Round Enrollment Policy

Divine Dance Studio operates as a year round dance program. Enrollment is continuous and will automatically remain active each month until written notice of withdrawal is received.

Families wishing to withdraw from any class or program must submit their withdrawal request by email to info@divinedancestudio.com before the first day of the month in which they wish to discontinue classes. Withdrawal requests received on or after the first of the month will become effective the following month, and tuition for the current month will remain due. Enrollment is not canceled by verbal notice, missed classes, or non attendance.

I. Tuition Policy

Monthly tuition is based on the total number of instructional weeks offered throughout the dance year and is divided into twelve equal monthly payments for your convenience. Tuition is not calculated based on the number of classes held in a particular month.

As a result, monthly tuition remains the same regardless of whether a month contains three, four, or five class meetings. Scheduled studio breaks, holidays, and one annual snow day have already been factored into the yearly tuition calculation.

Tuition reserves each student’s place in class and supports the overall operation of the studio, including instruction, curriculum planning, and studio programming. Tuition is not prorated or adjusted due to holidays, scheduled studio closures, or variations in the number of class meetings during any given month unless otherwise determined by Divine Dance Studio, LLC.
