RELEASE AND WAIVER OF LIABILITY AGREEMENT
I, the individual acknowledge by checking this form, am executing this Release and Waiver of Liability Agreement (the Reid Academy) in consideration of myself and/or my child(ren) listed above being permitted to participate in or attend the programs, events, and activities of the Connick School.
Assumption of Risk
I know and understand the scope, nature, and extent of the risks involved in participating in the School's classes, programs, events, shows, competitions, recitals, and activities, including activities at locations and facilities owned, leased, utilized, or attended by the School including virtual lessons, and events, competitions, shows, and activities organized by other schools, associations, or other third parties (collectively the Reid Academy), and that these risks include, but are not limited to, the following: tripping, slipping, and falling; injuries resulting from dancing or collisions with other dancers, spectators, or objects; injuries from exercising and stretching; injuries from lifting, moving, or carrying equipment or supplies; and injuries or death while traveling to or from the designated locations for the Activities.
I agree that the School the Released Parties (defined below) are not responsible for these and other unexpected occurrences and that I and/or my child(ren) will participate at my (or our) own risk. I knowingly, freely and voluntarily assume the risk and choose to incur all risks associated with the Activities, understanding that those risks may include personal injury, damage to property, and/or death.
Covid-19 and Other Infectious Diseases
I know and understand that the novel coronavirus has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, restricted or prohibited the congregation of groups of people. The School has taken reasonable and recommended steps to put in place certain preventative measures to reduce the spread of COVID-19 and other infectious diseases. However, I know and understand that the School cannot guarantee that I, my child(ren) or my invitees will not become infected with COVID-19. Further, participating in or attending any Activities at any location utilized or visited by the School could increase my risk of contracting COVID-19 or other infectious diseases. Participation in and attendance at the Activities includes possible exposure to and illness or death from COVID-19 and other infectious diseases. While participation rules and taking personal steps to protect myself and/or my child(ren) and/or invitees may reduce this risk, the risk of serious illness, permanent disability and death does exist.
By signing this Agreement, I acknowledge the contagious nature of COVID-19 and other infectious diseases and knowingly, freely and voluntarily assume the risk that myself, my child(ren) and my invitees may be exposed to or infected by COVID-19 or other infectious diseases while attending or participating in the Activities and that such exposure or infection may result in personal injury, illness, permanent disability and/or death, and I assume full responsibility for our participation in or attendance at the Activities. I acknowledge and agree that it is impossible to eliminate the risk that I, and/or my child(ren) and/or my invitees could be exposed to and/or become infected through contact with or close proximity with an individual with COVID-19 or other infection disease. Additionally, I understand and agree that the risk to me, and/or my child(ren) and/or my invitees of becoming exposed to or infected by COVID-19 or any other infectious disease may result from the actions, omissions, or negligence of myself and others, including but not limited to the School, its directors, officers, officials, employees, agents, sponsors, advertisers, event organizers, other dance schools, sponsoring agencies, representatives, independent contractors, volunteers, and program participants and their families and/or invitees.
Policies and Procedures
I, and my child(ren) and invitees, will comply with all policies, procedures and rules governing the Activities, including but not limited to policies, guidelines, signage and instructions of the School, including, without limitations, all rules and procedures related to safety and the limitation of the spread of COVID-19 and other infectious diseases. I further agree to make my invitees aware of such policies, guidelines, signage and instructions prior to their participation in or attendance at the Activities.
I understand and agree that the School, in its sole discretion, has established and may further establish and/or modify certain guidelines and protocols for conduct of persons at the Activities and may open, close or reopen its facilities at any time and from time to time. I also acknowledge that my conduct is also subject to all federal, state and local guidelines and requirements and that I, my child(ren), and my invitees will follow all such guidelines and requirements. I understand and agree that the School is under no obligation to notify me of the establishment or modification of any of its policies, procedures, rules, guidelines and protocols or of any governmental guidelines or requirements.
I understand and agree that if I, my child(ren), or my invitees violate any of policies, procedures, rules, guidelines and protocols of the School, or of any governmental guidelines or requirements, or any other safety precautions deemed appropriate to limit the exposure and spread of COVID-19, disease, then I, my child(ren), or my invitees may be asked to leave the Reid Academy's facilities or be removed from the Activities on a temporary or permanent basis. I understand that the School has full and absolute discretion to interpret and enforce all of these policies, procedures, rules, guidelines, protocols, and requirements.
Release of Legal Claims
In consideration of being allowed to attend and/or participate in the Activities, I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any illness and/or injury to myself, my child(ren) and my invitees (including, but not limited to, serious illness, personal injury, disability, and death) of any kind, that myself, my child(ren) or my invitees may experience or incur in connection with our attendance at or participation in the Activities. On behalf of myself, my child(ren) and my invitees, and our heirs, successors, assigns and personal representatives, I hereby forever release, waive, relinquish, discharge and hold harmless the School, its owners, members, directors, officers, officials, employees, agents, sponsors, advertisers, event organizers, sponsoring agencies, representatives, independent contractors, volunteers, and program participants and their families and/or invitees (collectively, the Reid Academy) of and from any and all claims, demands, liabilities, rights, damages, expenses (including attorneys fees) and causes of action of whatever kind or nature (collectively), and other losses of any kind, whether known or unknown, foreseen or unforeseen, that myself, my child(ren) or my invitees may experience or incur in connection with the Activities. I understand and agree that this release includes any Claims resulting from the actions, omissions, or negligence of the Released Parties in connection with infection of COVID-19 or other disease, whether an infection from COVID-19 or other infectious disease occurs before, during, or after attending or participating in the Activities.
I HAVE READ THE FOREGOING RELEASE AND WAIVER OF LIABILITY AGREEMENT AND FULLY UNDERSTAND ITS TERMS. I UNDERSTAND THAT THIS IS A CONTRACT AND A RELEASE AND WAIVER OF LIABILITY, AND THAT BY SIGNING IT I AM GIVING UP IMPORTANT LEGAL RIGHTS FOR MYSELF AND ON BEHALF OF MY MINOR CHILD(REN) LISTED HEREIN. I SIGN THIS AGREEMENT FREELY AND VOLUNTARILY OF MY OWN FREE WILL.
