WAIVER AND LIABILITY RELEASE FORM

This Waiver and Liability Release Form (the "Form") is entered into by this student's parent or legal guardian on their behalf, the student in question hereinafter referred to as the "Participant," and Central New York Dance Studio, LLC, its officers, directors, employees, and agents, collectively referred to as the "Studio." This agreement is effective on the date of the Participant’s signature.

ASSUMPTION OF RISK

The Participant acknowledges and agrees that participation in dance classes, events, and other activities (the "Activities") at the Central New York Dance Studio, LLC, involves inherent risks of injury, which may include but are not limited to strains, sprains, fractures, falls, and other physical injury. The Participant voluntarily assumes all risks associated with these Activities, including those specific to the type of dance style being performed.

Indemnification and Hold Harmless

The Participant agrees to indemnify, defend, and hold harmless the Central New York Dance Studio, LLC, its officers, directors, employees, and agents from any and all claims, losses, damages, or expenses (including attorneys' fees) arising out of or related to the Participant’s involvement in the Activities, including any claims for personal injury, property damage, or other legal claims.

Medical Treatment and Emergency Care

In the event of an injury or medical emergency during the Activities, the Participant consents to the administration of first aid or medical treatment, and agrees that the Central New York Dance Studio, LLC, is not liable for any injuries or medical expenses incurred. The Participant agrees to provide an emergency contact number and any relevant medical information (e.g., allergies, medications) at the time of registration.

Acknowledgment of Physical Condition

The Participant affirms that they are in good physical condition and have no medical conditions that would prevent their safe participation in the Activities. The Participant is advised to consult a physician prior to beginning any physical activity.

Photo/Video Release

The Participant grants permission to the Central New York Dance Studio, LLC, to use photographs, videos, and other recordings taken during the Activities for promotional, advertising, or instructional purposes. The Participant understands that these materials may appear on the Studio’s website, social media, or other marketing platforms.

Acknowledgment of Rules and Policies

The Participant agrees to abide by all rules and policies of the Central New York Dance Studio, LLC, including but not limited to attendance policies, dress code, behavior guidelines, and safety protocols. The Participant acknowledges that failure to follow these rules may result in suspension or termination of participation.

Waiver of Liability

The Participant (or the Guardian, if the Participant is a minor) hereby waives and releases the Central New York Dance Studio, LLC, its owners, staff, agents, and employees from any liability arising out of or in connection with the Activities, including claims for negligence, breach of warranty, or breach of any implied or express duty, except in cases of gross negligence or intentional misconduct.

Limitation of Liability

The Participant acknowledges and agrees that the Central New York Dance Studio, LLC's, liability for any claims arising from participation in the Activities shall be limited to the total amount paid by the Participant for the class or event in question, and that the Studio is not liable for any indirect, consequential, or punitive damages.

Force Majeure (Acts of God)

The Participant acknowledges that the Central New York Dance Studio, LLC, will not be held liable for any failure to perform its obligations under this agreement due to circumstances beyond its control, including but not limited to natural disasters, pandemics, strikes, or other unforeseen events that prevent the Studio from offering the Activities.

Participant’s Personal Property

The Participant agrees that the Central New York Dance Studio, LLC, is not responsible for any loss, theft, or damage to personal property brought onto the premises during participation in the Activities.

Class Schedules and Changes

The Participant acknowledges that class schedules may be subject to change, and that the Central New York Dance Studio, LLC, reserves the right to modify or cancel classes due to unforeseen circumstances, such as instructor availability or weather conditions.

Disability Accommodations

If the Participant has a disability and requires accommodations to participate in the Activities, the Participant agrees to notify the Central New York Dance Studio, LLC, in advance so that reasonable accommodations may be arranged.

Acknowledgment of Risks Specific to Dance

The Participant understands that dance involves activities such as jumping, stretching, balancing, and pivoting, all of which can lead to falls, overuse injuries, or strains. The Participant accepts these risks as inherent in the nature of the sport and agrees to participate voluntarily.

Health Insurance Requirement

The Participant acknowledges that it is their responsibility to have adequate health insurance coverage for any injuries that may occur during participation in the Activities. The Central New York Dance Studio, LLC, is not responsible for any medical expenses incurred due to injuries sustained during the Activities.

Online or Virtual Classes

For online or virtual classes, the Participant acknowledges that the Central New York Dance Studio, LLC, is not liable for injuries that may occur due to improper setup, insufficient space, or improper technique during virtual participation. The Participant agrees to take all necessary precautions to ensure their space is safe for virtual participation.

Governing Law and Dispute Resolution

This agreement will be governed by and construed in accordance with the laws of New York State. Any disputes arising from this agreement will be resolved through binding arbitration, to be conducted in Rome, New York, under the rules of the American Arbitration Association (or applicable arbitration body).

Acknowledgment of Understanding

By signing this Waiver and Liability Release Form, the Participant (or Guardian, if applicable) acknowledges that they have read, understood, and voluntarily agreed to the terms and conditions outlined above. The Participant further acknowledges that they are signing this document freely and without duress.

For Participants under the age of 18, this waiver must be completed by a parent or legal guardian. By signing below, the parent/guardian acknowledges that they have read, understood, and agreed to all of the terms and conditions outlined in this Waiver and Liability Release Form.
