I, the undersigned, hereby acknowledge that certain risks of injury are inherent to
participation in recreational activities and athletic activities. These risks and dangers
may be caused by the action, inaction or negligence of the participant or others.
There may be other risks not known or reasonably foreseeable at this time.
I, the undersigned accept and assume such risks and responsibility for the
losses and/or damages following such injury, however caused, and whether
caused in whole or in part by the negligence of the Participant named above.
Having read the above statement I am aware of the inherent risk of injury
involved in athletic participation. Finally, I understand that in accepting the risks
associated with athletic participation I will also share the responsibility of
minimizing those risks.

Poor attendance will affect the progress of the entire class. To ensure that your child progresses well in their dance training, attendance should be taken seriously. Let's make every class count! After the 3rd consecutive absence in a class, your spot can be forfeited and financial actions will be taken.

If Volusia County Schools close due to severe weather, SWDA will also be closed. If severe weather occurs after school hours, the director will decide whether or not to cancel classes. Short notice cancellations due to severe weather will be sent via text message and found on the BAND App.

We support all decisions made by the parents when they feel it is too dangerous to drive to class.

Practice Wear

Practice wear is required for all classes. uniform promotes unity and inclusiveness while decreasing the risk of injury in the classroom! At SWDA, we feel that uniform encourages team spirit and gives students a sense of identity. If a student is not dressed appropriately they will be asked to sit and watch class. Each student should have a dance bag that will hold all shoes. He/she should bring that bag to every class. Always bring a water JUG to class labeled with their name (NOT a capped water bottle due to spillage) to class and keep in the designated area. Street shoes are prohibited on studio floors. You may only enter the studio floors with bare feet or dance shoes. Student’s hair must be tied back and secured for class. No oversized clothing, chewing gum, or excessive jewelry for safety reasons.

Uniform Guidelines:

PDTC Ballet Classes:
Hair: Pulled back into any variation of a bun with no fly-aways.
Attire: Ballet pink dance tights with convertible foot (not bright pink)
Purple leotard with attached skirt -Purchased through studio for $23
(no undergarments visible) .
Shoes: Purchase of pink, professional quality ballet shoes without ties are required for our ballet classes. These ballet
shoes are required for every ballet student (Purchased through studio $28). We request that dancers DO NOT
wear low quality ballet shoes as this hinders your child’s ability to have correct foot placement and for safety
purposes in regards to slipping and falling.
Note- Ballet is a disciplined and structured form of dance. The appropriate attire will allow the Instructor to accurately assess and correct the dancer’s technique.

Minnow / Sea Stars Tap & Ballet Combo Classes:
Hair: Pulled back into any variation of a ponytail or bun (no fly-aways).
Attire: Ballet pink dance tights with convertible foot (not bright pink)
Any color leotard with or without attached skirt - (no undergarments visible) .
Shoes: Combos will also need black patent leather tap shoes, no socks please.

Sea Stars Jazz & Ballet Combo Class:
Hair: Pulled back into any variation of a ponytail or bun (no fly-aways).
Attire: Ballet pink dance tights with convertible foot (not bright pink)
Any color leotard with or without attached skirt - (no undergarments visible) .
Shoes: Jazz combos will also need tan leather split sole jazz shoes, no socks please.

Tap Classes:
Hair: Pulled back into any variation of a ponytail or bun (no fly-aways).
Attire: Form fitted shirt and leggings/pants/shorts
Shoes: Black Split sole tap shoes for Intermediate Tap and up.

Jazz Classes:
Hair: Pulled back into any variation of a ponytail or bun (no fly-aways).
Attire: Any color leotard with pink tights with leggings/ spandex shorts optional. No baggy clothing.
Shoes: Tan leather split sole jazz shoes, no socks please.

Lyrical Classes:
Hair: Pulled back into any variation of a ponytail or bun (no fly-aways).
Attire: Any color leotard with tan stirrup tights ( leggings/ spandex shorts optional-No baggy clothing).
Shoes: Approved tan lyrical half shoes

Hip Hop Classes/ Baby Beats:

Attire: Any variation of athletic wear (sports bras if necessary).

Cheer:

PDTC Acro

Attire: Any variation of athletic wear/Leotard with spandex shorts (sports bra if necessary)/ Black Unitard (PDTC)
Shoes: Clean barefeet.
Boys: Athletic wear and appropriate dance shoes.

Aerial Silks:
Hair: Pulled back into any variation of a ponytail or bun (no fly-aways).
Attire: Any color leotard with sleeved shirt / leggings (No baggy clothing).
Shoes: Barefoot

PDTC KLT Classes:
Hair: Pulled back into any variation of a ponytail or bun (no fly-aways).
Attire: Black leotard with mermaid leggings/ black spandex shorts optional. No baggy clothing.
Shoes: Tan leather split sole jazz shoes, and lyrical half soles- no socks please.

Most importantly: Try your best and have fun!

Make sure your dancer uses the restroom before class starts to limit class disruption.

Be respectful to your instructor and fellow dance-mates.

Notes and information are posted in the hallway and on the bulletin boards. There is also a monthly calendar of events located in the front lobby. Parents need to make sure they check for announcements regularly. BAND App is mandatory to download. This is a private communicative forum allowing parents, teachers and administrators to communicate. All important up to date info is posted on this community page. Please make sure you are in both the SWDA chat and your class specific group.

Siblings of dance students must be with parents at all times.
Make sure your child is not left unattended in the waiting room for any reason.

Do not drop your child off more than 5 minutes before the start of class or you will be charged $1 per minute the dancer is left unattended.
Please pick up your child on time. Our instructors have the responsibility of teaching their next class. There will be a $1 per minute fee applied to your account if your child is not picked up on time.

Costumes will be required to purchase (~$85-$90/costume) for our holiday and annual recital. Costume fees are to be paid in cash or check only. It is extremely important to make sure costume fees are paid on time. Delays in costume payment can prohibit the shipping of product for the entire studio. If costumes are not fully paid by the last payment schedule, your dancer will not be able to participate in the recital and the partial payment will be forfeited. Costume due dates will be posted once available. Costume Fees will incur a $15 late charge if paid beyond the due date.

If you ever have a problem regarding an instructors, other students, or parents, please see a manager to discuss it. By talking about it in the lobby you are undermining the instructor’s authority or hurting the feelings of other dancers and their parents. Please help us to promote the most positive environment and make everyone feel welcome.

We work very hard to keep you informed by communicating on the BAND App and direct messages. However, it is your responsibility to keep up to date by reading newsletters, e-mails, and checking the information board and Website. If you have a question about the dance studio please do not ask instructors during or in-between classes. Please send an e-mail to shellwedanceinfo@gmail.com or visit a director and they will be more then happy to help you with any questions. The Instructors have a very tight schedule and are not able to meet with parents during class because it can use up valuable class time. If you need to talk personally to an instructor please schedule an appointment so that the instructors can give you their full attention.

There is a seasonal registration fee of $85 to enroll each student ($105/ family) into the studio. Tuition is based on an annual rate. Tuition is non- refundable and is paid to save your child’s place in class. Therefore, tuition will remain constant throughout the dance year which runs August - June. Tuition is paid in equal monthly installments. The rate remains the same whether it is a long (5 week) or short (3 week) month. Tuition is based on a full school year, which consists of 40+ classes held between August and June. Some months (especially those with school vacations, ie: Thanksgiving break, winter break, spring break and Memorial Day) may only have two or three classes while others may have five in a month's time. Tuition is based on the total number of classes from August and June, so the monthly installment already accounts for the days off .

There are no refunds for missed classes and all purchases made to SWDA are non-refundable. If a contract is broken, all monies paid into the account are non refundable. Makeup classes are at the discretion of the instructor.
Prorating is not allowed. If classes are started after the beginning of the season, the tuition will be set at a rate equating to the remainder of the season’s tuition. There are no exceptions.

Monthly invoices are a courtesy. Tuition payments will be due by the first class of every month. All accounts with outstanding charges by the 5th of the month will be charged a $15 late fee and the credit card that is on file will be charged with the full amount due on the account. Costume Fees will incur a $15 late charge if paid beyond the due date.

Sibling discounts are provided.

Electronic payments can be accepted through CASH App or Venmo. There is a processing fee of 5% if paid via credit card (It will be added to your next invoice if not paid),or by cash or personal check.

SWDA does not carry medical insurance for its students. It is required that all dance students be covered by their own family insurance policies and if injury occurs it is understood that the student’s own policy is your only source of reimbursement.

I grant permission to SHELL WE DANCE ACADEMY, LLC. and it’s agents or employees, to use
photographs of me, or the minor named below for use in studio publications including, but not
limited to: brochures, newspapers, social media and the SHELL WE DANCE ACADEMY
website at www.shellwedanceacademy.com.

I grant SHELL WE DANCE ACADEMY, LLC. the unrestricted right to use and publish
photographs or video footage taken of me while participating in dance class, performing or in
the company of SHELL WE DANCE ACADEMY, LLC. I waive any right to royalties or other
compensation arising from the use of my photograph, and if signing on behalf of a minor named
below, I waive all such rights of the minor named below.

I agree on my own behalf or on behalf of the minor child named below, to release and hold
harmless SHELL WE DANCE ACADEMY, LLC and it’s agents or employees from any claims
arising from the related use of the photographs. I acknowledge that by signing this form I give
SHELL WE DANCE ACADEMY, LLC. full copyright and authority to publish photography and I
agree to the terms listed above.

Release and Waiver of Liability and Agreement
(Read Carefully )

In consideration of being permitted to participate in any way at SHELL WE DANCE
ACADEMY, LLC. indicated below and/or being permitted to enter for any purpose any
restricted area (here in defined as any area where in admittance to the general public is
prohibited),the participant, and/ OR the parent(s) and/or legal guardian(s) of the minor
participant named below agree:
1. The parent(s) and/or legal guardian(s) will instruct the minor participant that prior to
participating in any related activity or event, he or she should inspect the facilities and
equipment to be used, and if he or she believes anything is unsafe, the participant should
immediately advise the officials of such condition and refuse to participate. I understand
and agreed that, if at any time, I feel anything to be UNSAFE, I will immediately take all
precautions to avoid the unsafe area and REFUSE TO PARTICIPATE further.
I/WE fully understand and acknowledge that:
There are risks and dangers associated with participation in dance, tumbling, yoga or
any related events and activities which could result in bodily injury, partial and/or
total disability, paralysis and death.
The social and economic losses and/or damages, which could result from these risks
and dangers described above, could be severe.
These risks and dangers may be caused by the action, inaction or negligence of the
participant or the action, inaction or negligence of others, including, but not limited to,
the Releasees named below.
(d) There may be other risks not known to us or are not reasonably foreseeable at this
time.
3. I/WE accept and assume such risks and responsibility for the losses and/or damages
following such injury, disability, paralysis or death, however caused and whether caused
in whole or in part by the negligence of the Releasees named below.
4. I/WE HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE

SHELL WE DANCE ACADEMY, LLC. and any facility used by the participant , including its
owners, managers, promoters, lessees of premises used to conduct the event or program, premises
and event inspectors, underwriters, consultants and others who give recommendations, directions,
or instructions to engage in risk evaluation or loss control activities regarding the facility or events
held at such facility and each of them, their directors, officers, agents, employees, all for the
purposes herein referred to as “Releasee”...FROM ALL LIABILITY TO THE UNDERSIGNED,
my/our personal representatives, assigns, executors, heirs and next to kin FOR ANY AND ALL
CLAIMS, DEMANDS, LOSSES OR DAMAGES
AND ANY CLAIMS OR DEMANDS THEREFORE ON ACCOUNT OF ANY INJURY,
INCLUDING BUT NOT LIMITED TO THE DEATH OF THE PARTICIPANT OR
DAMAGE TO PROPERTY, ARISING OUT OF OR RELATING TO THE EVENT(S)

CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE
NEGLIGENCE OF THE RELEASEE OR OTHERWISE.
5. I/WE HEREBY acknowledge that THE ACTIVITIES OF THE EVENT(S) ARE VERY
DANGEROUS and involve the risk of serious injury and/or death and/or property damage.
Each of THE UNDERSIGNED also expressly acknowledges that INJURIES RECEIVED
MAY BE COMPOUNDED OR INCREASED BY NEGLIGENT RESCUE OPERATIONS
OR PROCEDURES OF THE RELEASEES.
6. EACH OF THE UNDERSIGNED further expressly agrees that the foregoing release,
waiver, and indemnity agreement is intended to be as broad and inclusive as is permitted by
the law of the Province or State in which the event is conducted and that if any portion is held
invalid, it is agreed that the balance shall, notwithstanding continue in full legal force and
effect.
7. On behalf of the participant and individually, the undersigned partner(s) and/or legal
guardian(s) for the minor participant executes this Waiver and Release. If, despite this
release, the participant makes a claim against any of the Releasees, the parent(s) and/or legal
guardian(s) will reimburse the Releasee for any money which they have paid to the
participant, or on his behalf, and hold them harmless.
Photo/Video Release
I hereby give permission for images of my child, captured during regular and special dance
activities through video, photo and digital camera to be used solely for the purposes of
SHELL WE DANCE ACADEMY, LLC's promotional material and publications, and
waive any rights of compensation or ownership thereto.

I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION (RISK
AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND
THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY AGREEING TO IT, AND HAVE
SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT,
ASSURANCE, OR GUARANTEE BEING MADE TO ME AND INTEND MY
SIGNATURE TO BE COMPLETE AND UNCONDITIONAL RELEASE OF ALL
LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.

Please do not park or stop on the crosswalk to load or unload.

SWDA is responsible for students only during their scheduled class time. It is the responsibility of the parent or guardian to pick up children at the end of their scheduled class time, event, or performance.

The goal is for our students to be safe at all times. After class, students must wait inside the building for pick-up. We are very sensitive to our student’s safety, but we are not legally responsible for students before or after their class time. Any unattended child after class will receive a charge of $1/min until a guardian has entered the lobby. Drop-offs can only be done 5 minutes prior to class time without a fee.

Parents of students under the age of 7 must be in the lobby the entire duration of their class time. Bathroom trips or other necessary escorts out of the classroom must be supervised by the guardian.

SWDA is not responsible for lost personal items. There is a lost and found located in the studio and should be checked if your child has lost anything.

Smart Watches and cell phones are prohibited in the classroom. They can be checked in at the front desk and returned when class is dismissed.

Students may withdraw from their contract in the event of a physical injury. If a student becomes physically unable to continue with classes, a doctor's note is required in order to be released from the contract. Students who withdraw for any reason other than physical injury are not entitled to tuition forbearance. The remainder of seasonal tuition will be collected upon withdrawal.
